Supreme Court Rules on Detention of "Enemy Combatants"
The Supreme Court has declared that the Bush administration's 'enemy combatant' detention procedures are unconstitutional, and Yaser Hamdi should have an opportunity to contest his detention. "The Bush administration has maintained that the courts may not 'second-guess' the commander-in-chief's enemy combatant determination," said Cato's Timothy Lynch in a recent statement, "The Supreme Court said the President has no such power over the citizenry."
