Sherri Shepherd's divorce trial just got nasty today, when the co-host of "The View" testified ... while her newborn was in the ICU, she found pictures of her husband having sex with someone.
Shepherd testified after having a preemie baby weighing 1 pound, 10 ounces, she was going back and forth to the neonatal intensive care unit for several months. She said one day upon returning home, she found pictures of her husband Jeff Tarpley having sex with a random woman, whom he later impregnated.
Shepherd filed for divorce shortly after finding the photos, back in 2006.
We talked to Sherri in the courtroom hallway just a few minutes ago, and she wanted us to say Jeff's a good dad.

Lindsay Lohan has officially hired Bob Shapiro to represent her in her ongoing DUI probation case ... but only on condition that she goes to jail.
TMZ broke the story earlier this week that Shapiro was stepping in after Shawn Chapman Holley quit. Shapiro, who repped O.J. Simpson, tells TMZ, "I have agreed to represent Ms. Lohan on the condition that she complies with all the terms of her probation, including a requirement of jail time that was imposed by Judge Marsha Revel."
Shapiro added, "Ms. Lohan is suffering from a disease that I am all too familiar with." The lawyer's son died of a drug overdose in 2005.

For the first time since filing legal documents to end her domestic partnership with Tammy Lynn Michaels two weeks ago, Melissa Etheridge emerged in Manhattan on Friday.
Earlier this week, an L.A. County Superior Court judge ruled Melissa did not have to pay her ex an additional $25K because the Grammy-winning singer is paying for all of Tammy's and their children's bills. Both Melissa and Tammy are fighting for custody of their twins.
The next hearing is set for September.

The judge in the Oksana Grigorieva/Mel Gibson custody war does not believe that Mel poses any danger to his daughter ... sources tell TMZ.
Sources connected with the case say Robyn Gibson's declaration was "powerful evidence" in yesterday's hearing. TMZ broke the story ... Robyn swore under oath Mel never physically abused her or their kids in the 28 years she was married to him ... and we're told it had an impact on Judge Scott Gordon.
Before becoming a judge, Gordon was a prosecutor in the L.A. County D.A.'s Office, specializing in domestic violence. The D.V. Unit has a mantra ... a man who commits domestic violence against one woman does it to everyone he's involved with. We're told Robyn's declaration resonated in the courtroom.
Sources say in the end, Judge Gordon felt Mel posed no danger to his daughter and allowed the status quo to stand. So Gibson continues to have visitation rights with baby Lucia as well as one overnight a week.
There is a report out that Judge Gordon issued an order yesterday, requiring Gibson to surrender all firearms. That is not true. Last month, when the court issued a restraining order against Mel to stay away from Oksana, the judge followed standard procedure -- ordering the surrender of firearms. That automatically happens when the court issues a temporary domestic violence restraining order. We're told Gibson's firearms were turned over immediately.

Wesley Snipes just got his ass kicked by a federal appeals court -- which denied the actor's claim that his 3 year prison sentence for tax evasion was "unreasonable."
Translation -- dude will definitely serve hard time.
Back in 2008, Snipes was found guilty of not filing tax returns from 1999 to 2001 ... and consequently failing to pay the government nearly $12,000,000.
Snipes was sentenced to 36 months in prison -- but appealed the case claiming, among other things, that his sentence was "unreasonable."
But today, the appeals court backed the original ruling -- shooting down Snipes' claims that his punishment was way too severe.
No word on when Snipes will officially check in to the big house.

The dentist who treated Oksana Grigorieva does not believe she was struck in the mouth as she claims ... and his evaluation raises serious questions about her injuries ... TMZ has learned.
Sources familiar with Dr. Ross Shelden's medical charts, photos and examination notes tell TMZ ... Dr. Shelden saw no evidence Oksana was struck in the mouth. TMZ broke the story ... Oksana told Sheriff's deputies Mel Gibson struck her in the mouth twice, knocking one tooth out and chipping another.
Although Dr. Shelden sees no evidence of a strike to the mouth, he does have a different scenario. We've learned Dr. Shelden believes Oksana was struck in the left temple, which caused her to bite down so hard, one veneer was completely knocked out and another was damaged. The charts reflect that Oksana's teeth were fully intact.
Dr. Shelden observed a bruise on Oksana's left temple, however, we know the photos he took in his office show no such bruising. The doctor's explanation -- Oksana was reluctant to have her picture taken and covered up the bruising with her hair and makeup -- plus she was looking off to the side. As we previously reported, Oksana told the doctor Mel had hit her.
As for the mouth area, Dr. Shelden's charts reflect two bite marks on the inside of the lower lip. The doctor says there was no swelling or bruising consistent with a punch to the mouth but believes instead the bite marks are consistent with "a chain reaction" after allegedly being hit in the temple.
There is nothing in the records indicating whether the doctor believes Oksana's wounds may have been self-inflicted.
Sources connected with Mel Gibson tell TMZ the actor did not strike Oksana.

Sherri Shepherd was in court today to tie up loose ends in a lengthy divorce from her ex-husband -- but despite the bad experience overall, Sherri says she'd get married again in a heartbeat.
"The View" star was leaving court in Los Angeles when we asked her if divorce had made her bitter toward marriage -- she said no ... in fact, she "loves marriage" and she'd "absolutely" do it again ... just not with her ex.
Sherri and ex-husband Jeff Tarpley -- who went to court to divide leftover assets and iron out child support details -- officially divorced in 2009 ... three years after Sherri filed papers.

Sources connected with the Mel Gibson investigation say the photos and video of Oksana
Grigorieva's alleged injuries are raising "serious questions" about her story that Gibson struck her.
Law enforcement sources who have analyzed the pictures and video -- yes, we've learned she had video shot as well -- tell TMZ there is "no evidence of external or internal damage," making it inconsistent with being punched in the face.
As we have already reported, Oksana's teeth were not damaged -- they were intact. The dentist has submitted a sworn declaration saying one veneer was out and one was cut in half, but the teeth were not damaged.
Furthermore, several experts who have examined the photos and video say there is no evidence of any soft tissue damage, which would be present if someone were struck in the mouth, and it would be "highly irresponsible" for the dentist to so quickly replace Oksana's veneers.
We're told law enforcement is investigating the scenario that the damage to the veneers could have been self-inflicted. We're told at least one expert who has evaluated the photos and video believes it's a self-inflicted injury.
As we first reported, Gibson's lawyers will make a presentation to the Sheriff's Department ... in part arguing that Oksana made false statements to authorities.

TMZ has learned Donald Trump is getting in on the action with Tiger Woods mistress numero uno Rachel Uchitel ... because he's offered her a job on the next season of "The Celebrity Apprentice."
Trump -- a longtime friend of Tiger's -- told TMZ he personally called Uchitel three weeks ago and offered her a spot on the show .... telling her she'd be "awesome."
We called Uchitel and asked if she was going to take the offer -- and she said, "Absolutely."
We're pretty confident she'll excel in business -- since she's already proved she can handle the load.
NBC has the final say on whether Uchitel will be on the show, but Donald usually gets his way.

UPDATE: Steve Jaffe, Oksana's rep, tells TMZ they have evaluated the photo and believe it is a "true and accurate photograph."
Sources connected with the dentist who treated Oksana Grigorieva tell TMZ the dentist believes "100% the photo circulating on the Internet has been altered."
We're told Dr. Ross Shelden is saying, "The nose is not hers. The lips are not right. It's not a true and accurate picture. It has definitely been altered."
We're also told the doctor says the teeth are in fact Oksana's, reaffirming that the teeth are intact, but one veneer was damaged and one was broken.
We have specific information about the dentist's observations ... and they raise serious questions about the nature of Oksana's alleged injury.
