Sources tell TMZ Oksana Grigorieva began secretly recording Mel Gibson shortly after he accused her of messing around with the "tree man."
Sources intimately familiar with the case tell TMZ ... on February 18, Oksana went to Mel's house and he allegedly flew into a rage. Sources say, according to Oksana, Mel had quit smoking that day and was in a "terrible mood." As TMZ first reported, Mel had also tried to quit smoking the day of their nuclear blowup on January 6.
On February 18, we're told Mel became insanely jealous ... allegedly accusing Oksana of having an affair with her landscaper. According to Oksana, she had to leave because she felt if she didn't Mel would hurt her and the baby. We're told after she left, an enraged Mel began calling ... and she began recording.
Sources tell TMZ there was no physical violence on February 18 and the only type of violence between the January 6 encounter and the February 18 encounter was verbal ... not physical.
We're told all of the recordings were made on February 18.

Two weeks after he was spotted with Rachel Uchitel ... Michael Lohan posed with another Tiger Woods mistress, Joslyn James (right), and Gina Rodriguez, an alleged mistress of David Boreanaz.
Michael claims Kate Major's jealousy over his alleged TV deal with Joslyn and Rachel fueled the fight which got him charged with 2nd degree harassment.
This oughta patch things right up.

Christina Milian wants a judge a throw out the divorce papers filed by her baby daddy The-Dream -- claiming that he not only lied about the status of their relationship ... but he also cheated on her.
Milian is pissed over The-Dream's claim that they were legally separated when he filed the divorce docs back in February ... just nine days before she gave birth to their daughter.
In her legal response, filed last week in Georgia, Milian claims the marriage wasn't really kaput when he filed the divorce docs -- and subsequently had "marital relations on numerous occasions."
But Milian also claims that if the court does grant the divorce -- it shouldn't be based on The-Dream's claim that the marriage is "irretrievably broken" -- but rather because the The-Dream was cheating on her.
But it gets worse ...
In the docs, Milian admits that she signed a settlement agreement with The-Dream in which both parties waved any alimony or ownership right's to the other person's property.
But Milian claims she only signed the docs because The-Dream brought them to her bedside when she was 9-months pregnant ... when she was in no condition to sign such important papers.

TMZ has obtained a photo of Michael Lohan's ex-fiancee Kate Major with her left arm in a sling -- just two days after she claims he attacked her in New York.
As we first reported, Kate filed a report with the Southampton Town Police on Monday claiming Michael physically attacked her during an argument earlier that day.
On Wednesday -- the day this photo was shot -- Kate obtained a restraining order against Michael.
Michael says Kate's claims are all untrue.

TMZ has learned ... Mel Gibson has voluntarily arranged for an independent observer to be present when he visits with his daughter in order to protect him from ongoing, fresh child abuse claims by Oksana Grigorieva.
We've learned the observer has been in place for a week. Sources say Mel's lawyers wanted an independent observer for 2 reasons:
-- To refute ongoing allegations by Oksana ... sources say she keeps alleging that Mel is abusing their child.
-- To facilitate and speed up the investigation by the L.A. County Department of Children and Family Services.
We're told the observer -- who is credentialed in the family law area -- is giving regular updates to DCFS. The observer was chosen solely by Mel Gibson's lawyers. Oksana's lawyers and the court were not involved.
Sources tell TMZ ... Mel has had the legal right to unsupervised visitation since the case began in March. The observer is Mel's doing alone and purely voluntary.
