John Roberts: Will He Be Just As "Bad" As Liberals?


Kurt Andersen of New York magazine writes about Supreme Court nominee John Roberts and says liberals like him have to hope Roberts shows more restraint when he's on the top court than liberals ever did. Andersden confuses Roberts' comment that Roe v Wade was "settled law," apparently not realizing Roberts has already made clear that attitude -- appropriate for an appelate judge -- does not apply to a Supreme Court justice. He also says this:
Since the pro-choice position is one of the defining and unquestionable articles of faith for liberals, most of us don’t realize that the Supreme Court’s constitutional logic in Roe v. Wade is considered very iffy by many (maybe most) mainstream legal scholars, including liberal gods like Lawrence Tribe and Cass Sunstein. Yet for better or worse, it is settled law; to overturn it now would be a radical act of judicial hubris, socially disruptive in the extreme.

In other words, now that the era of activist liberal judicial hegemony is over, we liberals have to hope that Roberts and Bush’s other appointees really are devoted to judicial restraint—the way liberals were not, back in the day.
Andersen goes on to compare how racists used the fillibuster to fight civil rights legislation and now liberals use it to fight bad nominees. And how the far right's demands for "states rights" are now echoed by the left.

Where to begin? Even many lay people know that Roe v Wade is considered a legally muddled, messy decision. It wouldn't be the first and the fact that it was tackling a muddy, messy ethical issue just might have something to do with it. And the "states rights" comments by the left are usually jibes pointing out the hypocrisy of the far right who abandon that "principle" when it proves inconvenient. They are not embracing that idea, just showing how Republicans cynically tossed it away.

But what really bothers me is the moral equivalency here -- what conservatives would term the "relativism" of Andersen's argument. It's all "judicial activism" to Andersen -- whether you're trying to keep ten percent of the population as second class citizens or ensure they have the right to vote. Whether you're recognizing certain basic civil rights that all Americans deserve or trying to DENY them those rights, it's all the same to him. So when the left was expanding the American Dream to more and more Americans, it was engaging in the same practices as the right does when it tried to turn that dream into a nightmare.

So spreading rights to more and more people is the same as curtailing those rights. Under Andersen's twisted logic, there's no difference between the North and the South during the Civil War -- sure, the Southerners were trying to tear this country apart and the Northerners were trying to hold it together, but they were all using the same tactics to accomplish their goals. But the truth is that the judges who ended segregation in the schools, ended the "right" of states to throw gay people into jail and so on weren't being "judicial activists." They were recognizing the basic rights that all American have always deserved but were often denied. Throwing those people back into jail, denying those people the right to vote or marry or get a decent education is not the same thing. Not by a mile.

I don't hope Roberts behaves differently than liberal judges in the past. I hope he behaves the same -- putting aside his personal prejudices to decide the cases before him and recognizing that ALL Americans -- regardless of what state they happen to live in -- have certain basic rights. Bush might tap strategic petroleum reserve to help oil industry


He's going to do it to help the oil industry:
The White House said Monday it was willing to use the government's emergency oil stockpile to help refiners hurt by Hurricane Katrina's rampage through the Gulf of Mexico, but that it was too early to decide if or how much crude should be released.
Oh, how times have changed.

You may recall that in fall of 2000, the Bush campaign brutally attacked the Clinton administration for considering doing the same thing in order to lower what were then skyrocketing oil prices in order to help average Americans:
Republican presidential candidate George W. Bush's campaign criticized Gore's proposal, calling it an "election year political ploy" that could threaten national security.

Bush's communications director Karen Hughes told reporters in New York: "That reserve is intended for strategic and national security purposes, not for election year political purposes."
Amazing, but not surprising they can find a way to help the oil industry during a national crisis. And what a convenient way to address the truly skyrocketing oil prices which are damaging Bush and the GOP. Yeah, that's not politics.

UPDATE: AP reports that the oil industry didn't suffer serious damages:
Oil refiners said damage to their equipment in the Gulf region appeared to be minimal, and oil prices dropped back from the day's highs above $70 a barrel. But the refiners were still assessing the damage, and the Bush administration said it would consider releasing oil from the nation's emergency stockpile if necessary.

And as an aside, the trolls are really out today - I've gotten emails from a number of them, and boy are they pissed. Guess we hit a nerve by pointing out that their president abandoned them during the hurricane crisis just like he abandoned them during 9/11 when he ran and hid in a missle silo out in North Dakota.

More Republicans Distance Themselves From Iraq


Sen. John Warner of Virginia admits the obvious: voters are very unhappy with Iraq. Warner's going to demand Rumsfeld come testify to the Armed Services Committee.
"The level of concern is, I think, gradually rising," Mr. Warner said in an interview on Friday. "Our nation has given so much to the Iraqi people, and what are they giving us in return?"
He also made a vague promise to hold hearings in the next several weeks on whether the Pentagon has failed to hold senior officials responsible for the prison abuse scandals. (Warner, we can save you some time. The answer is "yes.") Maybe Dems could get us out of this mess if they weren't so mealy-mouthed. Steny Hoyer of Maryland -- the number two Dem in the House -- said this:
"I think the public is losing patience with the effort because they don't see it succeeding. In fact, from their perspective, they see the attacks increasing. We haven't done what we need to do for the infrastructure in Iraq. We haven't got the economy going."
They don't see it succeeding? Who does? From THEIR perspective the attacks are increasing? Is there a "perspective" where the attacks AREN'T increasing? The non-reality based perspective of Bush, perhaps? Attacks ARE increasing. Deaths are increasing. The insurgency is increasing. Katrina is smashing the Gulf Coast


Non-stop coverage on cable and the morning shows. The hurricane is slightly east of New Orleans meaning the city won't bear the absolute brunt, although they are getting pounded. Word on CNN was that there were leaks in the Superdome.

"Why do I feel like I'm in a f------ Vietnam movie?"


Watching the Retired General talking heads on Meet the Press this weekend, the Freudian slip of Vietnam rose its ugly head. It made me curious, are we drawing parallels to Vietnam that don't make sense? That go to far? From a Knight Ridder article via Yahoo I'll let those with the most experience -- the troops -- speak for themselves:
"I tell the guys not to lose their humanity over here, because it's easy to do," said Marine Capt. James Haunty, 27, of Columbus, Ohio. "I tell them not to turn into Col. Kurtz."

Haunty was referring to a character in Joseph Conrad's novella, "Heart of Darkness." It became the basis for the Vietnam War movie "Apocalypse Now," in which Kurtz has a mental breakdown and murders suspected Vietnamese double agents.

Asked for an example of the kind of pressure that could cause Marines to crack, Haunty talked about the results of a car bomb: "I've picked up pieces of a friend, a Marine. I don't ever want to see that s--- again."

"It's a lot like it was in Vietnam, when the VC's (Viet Cong) would come out and pretend to be your friends," said Marine Lance Cpl. Jared Vidler, 23, of Syracuse, N.Y. "You're fighting an enemy on his home ground and you don't know who's who."

Last week, one gov't official refused to hide the facts about racial profiling among cops and was demoted. MONDAY

Pat Robertson proved the far right is far from moral by calling for the killing of a democratically elected leader in Venezuela. John (temporarily) in Paris mocked him with the posting "Who Would Jesus Assassinate?"

Joe in DC dissected Bush's (lack of an) Iraqi plan with "Bush Iraq Strategy = 9/11 x 5 + WWI + WWII." That gets my vote for cleverest headline of the week.

"'Peak Oil' Makes It To The New York Times Magazine," satisfying Michael in New York and Americablog readers who had been pushing this topic.

"Reuters Nails Bush" according to John (temporarily) in Paris.

And a series of NYT articles on creationism were increasingly disappointing, highlighted by "Still More On The False God Of Intelligent Design" said Michael in New York.


TUESDAY

"Bush says that if you disagree with his handling of the war in Iraq, you hate America" reported John (temporarily) in Paris.

Joe in DC played off that posting with "Bush, Rumsfeld and the MSM Hate Most Americans."

"School Lunches: The Fight Over Fatty Foods" stirred up a food fight thanks to Michael in New York's item.

"Why Bush Can't Meet With Cindy Sheehan" ended the day thanks to Michael in New York.


WEDNESDAY

John's return to DC brought the renewal of the famed "John in DC" tagline and it immediately scored a hit by focusing the spotlight on "The American Legion will take 'whatever means necessary' to stop anti-war protestors."

Michael in New York pointed the way to the obvious hypocrisy of "First Pat Robertson Calls For Assassination; Then He Lies About It."

Joe in DC kept Sheehan front and center with "Bush Takes On Cindy" and enjoyed "Dowd on W's 'twisted logic.'"

And Michael in New York hadn't forgotten the man who should be getting measured for an ankle bracelet a la Martha, commenting on "RoveGate: Bush's WaterGate Ready To Blow?"


THURSDAY

"Cindy is Back in Crawford" says Joe in DC. And so are the wackos, as John in DC made clear with "Pat Boone Says Cindy Sheehan Is A Pot Smoker."

Shoving someone else's religious beliefs down your child's throat gets more popular, according to "McCain Wants To Teach Fables As Science, Too" and Joe in DC.

And John in DC blasts the MSM with "TIME Magazine Tried To Influence The 2000 Election To Bush's Favor."


FRIDAY

John in DC introduced Friday dog blogging.

Michael in New York got annoyed by the MSM and vented in "About Pat Robertson."

Joe in DC hit the MSM again with "Press As Patsies, Redux."

And Joe in DC (and all of us) rejoiced with Bush's polling numbers with "How Low Can He Go?"

When you're preparing for, and delivering, two stump speeches in two different states within hours of each other, you are NOT devoting your full attention to one of the biggest disasters ever to face an American city.
