3/18/05: Defendants USA Next and its advertising agent Mark Montini today gave up all opposition to an injunction pending trial in the case of the gay couple, Rick Raymen and Steve Hansen, whose picture the defendants stole for what the Court has called an "incendiary" advertising campaign. On Wednesday, the Court issued a ten-page opinion excoriating the defendants and detailing why Hansen and Raymen have a substantial likelihood of prevailing in their case for damages, and how they would be irreparably injured if an injunction is not in place pending trial. USA Next originally opposed the injunction and dragged its feet until the last minute to agree to an injunction that will last until the end of the case.
3/16/05: Judge issues Memorandum Opinion supporting the Temporary Restraining Order, March 16, 2005.
3/9/05: Plaintiffs' lawyer files $25 million lawsuit against USA Next and Mark Montini International for libel, invasion of privacy (appropriation of likeness), invasion of privacy (false light), and intentional infliction of emotional distress. Copy of complaint for $25 million lawsuit and press release.
2/28/05: Plaintiffs' lawyer, Christopher Wolf, writes USA Next CEO Charles Jarvis demanding Jarvis cease and desist from using any image of plaintiffs, and that he apologize to plaintiffs. Jarvis never responds. Copy of Wolf letter and press release about Wolf letter demanding apology. (Christopher Wolf is a partner in Proskauer Rose, LLP, one of the nation's largest law firms, with offices in New York, Los Angeles, Washington, Boston, Boca Raton, Newark, New Orleans, and Paris.)
2/15/05 - 2/21/05: Defendant publishes gay-bashing ad on American Spectator Web site. Ad includes stolen wedding photo of plaintiffs, and associates plaintiffs with un-patriotic and un-American beliefs. Ad republished countless times on Internet, TV and print media.
