 Jonah Goldberg was not pleased with Banned Books Week: Just a Lot of Propaganda Says Jonah Goldberg, the post that I wrote for the Turley blog last Sunday. In my post, I criticized Goldberg’s op-ed titled Banned Books Week is just hype, which appeared in USA Today on September 5th. Goldberg responded to my criticism of his op-ed with a blog post titled Banned Book B.S. Cont’d at the National Review Online (NRO). He said that my effort to come “to the rescue of the Banned Book Week crowd” was “entirely underwhelming.” He added, “A big chunk of her response restates my op-ed while casting her incomprehension as if it’s a rebuttal.”

Goldberg said my insinuation that the threat of book banning is a more serious problem than we realize because of the book challenges that go unreported to ALA (American Library Association) was “incredibly lame.”

As We Careen Towards a Dream of Armageddon

To my mind the greatest movie satire on the idiocy of the Cold War and the fear it inspired in humanity, was Stanley Kubrick’s masterpiece “Dr. Strangelove, or How I learned to Stop Worrying and Love the Bomb”,  released in 1964. The plot in brief was, “An insane general starts a process to nuclear holocaust that a war room of politicians and generals frantically try to stop”. Rent the movie if you haven’t seen it, for it will bring you dark laughter and present you with much to ponder. At the time of its release, some disparaged the movie as being un-credible in its characterizations and not believable in it premises. I hadn’t thought of the movie in years until I came across this article at the website Buzzflash.com titled “The Theology of Armageddon” by Robert Koehler. http://blog.buzzflash.com/node/13024 . The article is relatively brief, but well worth your time.

 The article deals with a course titled “Nuclear Ethics and Nuclear Warfare” at Vandenberg Air Force Base, given under Air Force auspices. As the Robert Koehler states:

“(I)t turns out that the point of the mandatory course, which was recently canceled by the Air Force after officers of numerous faiths complained to the Military Religious Freedom Foundation about it and Truthout published an exposé in July, was to give officers in the first week of missile-launch training a Bible-verse-studded indoctrination in faux-Just War Theory (cynically known in the ranks as the “Jesus Loves Nukes” training)”.

What got me thinking of the movie Dr. Strangelove was a quote in the article from Dr. Wehrner Von Braun, which makes credible the satiric reality of the movies title character, Dr. Strangelove, hysterically portrayed as a heavily accented former NAZI, by Peter Sellers. Seller’s character was widely denounced as being unfair to Von Braun, at the time, but seeing this quote from him makes me wonder:

“We knew that we had created a new means of warfare and the question as to what nation . . . we were willing to entrust this brainchild of ours was a moral decision more than anything else,” von Braun is quoted as saying. “We wanted to see the world spared another conflict such as Germany had just been through and we felt that only by surrendering such a weapon to people who are guided by the Bible could such an assurance to the world be best secured.”

To me this is post facto justification by von Braun of his choice of the comfort of an honored life in the U.S. mirroring his NAZI lifestyle and providing a sop to detract from the truth that he was an enthusiastic war criminal. Von Braun had developed the V (I & II) guided missiles for the NAZI’s and became the head of the United States Ballistic Missile Program. Von Braun was a NAZI Party member of distinction and it seems dedication. His missiles fell upon Great Britain in the closing days of WW II as an attempt to cause terror within the British people and were random in their destruction. That he then became an honored man in the U.S., rather than a defendant at Nuremburg, is a tribute to our own hypocrisy in prosecuting the Cold War. Honey Badgers Don’t Need A Guide

The honeyguide is a bird famous for leading humans to bee hives. The humans raid the hive of its honey and leave some of the spoils in a convenient location for the honeyguide. It’s an incredible example symbiotic behavior. It has also been claimed that honeyguides lead honey badgers to hives. This turns out to be false. The origin of the misconception may have occurred since honeyguides would follow honey badgers and partake of the badger’s leftovers. It’s also a good excuse to embed this cool video:

In another bad turn for the White House, Solyndra executives repeatedly invoked the Fifth Amendment on the company’s financial collapse and its receipt of $535 million federal loan guarantee. Judges Behaving Badly (3): Chief Judge Dennis Jacobs Attacks Civil Libertarians and Lawyers Before Second Circuit

We recently discussed the shocking outburst by conservative judges on the Seventh Circuit and Fifth Circuits. Now, a judge on the United States Court of Appeals for the Second Circuit has joined the ranks of jurists engaging in visceral and, in my view, inappropriate commentary from the bench. The circuit sitting en banc split 6-6 Wednesday on whether to grant en banc review on a challenge of the federal wiretap law. What was most striking, however, was not the sharp division but the rhetoric of Chief Judge Dennis Jacobs. Building on a trend of federal judges to so narrow standing as to block any meaningful avenue to challenge government actions. However, Jacobs decided to vent his anger at public interest attorneys and their causes and clients.

Student Disciplined For Telling Friend In Class That He Views Homosexuality As Wrong

There is an interesting controversy in Fort Worth, Texas where Dakota Ary, an honors student was suspended for turning to another student in his German class and saying that he viewed homosexuality as wrong. The teacher at Western Hills High School became angry in overhearing the comment and accused Ary of being a bully.

Texas Ends Last Meal Tradition After Brewer Execution

It has long been a tradition to give a dying man his last requests for dinner. Lawrence Brewer took that request to an extreme, ordering a meal fit for an entire cellblock. That produced a backlash from state Senator John Whitmire who demanded an end to the tradition in Texas. He succeeded and now death row inmates will simply get whatever is served that night at the prison.

It turns out that Einstein was a bit slow after all. Scientists at the European Organization for Nuclear Research (CERN) has made a subatomic particle go faster than the speed of light for the first time — something that shattered one assumption of Einstein’s theories. Texas Judge Rules Gay Father Cannot Leave Children With His Husband

Harris County judge Charley Prine, a Republican judge in Texas, is under fire for a clearly homophobic order barring a gay father from leaving his children alone with his husband. William Flowers (pictured, left below) and Jim Evans (right) were legally married in Connecticut and are appealing the order that says that the children cannot be left alone with with any man who is not related to them by blood or adoption unless his ex-wife consents.

Space Torts: NASA Puts Risk of Being Hit By Falling Satellite At 1 in 3200

Former Harvard Law Professor Pleads Guilty to Vehicular Homicide

Retired international law professor Detlev Vagts, 82, has pleaded guilty to vehicular homicide in the death of Marcia Kearney in Newton, Massachusetts. In light of his plea and presumably his age, Vagts was spared prison time in favor of three years probation and six months of house arrest. He has been ordered not to drive for the rest of his life.

Supergrass: Courts Find Police Informer Not Only Had 51 Convictions But Is A “Pathological Liar”

The use of informers by police have always been criticized, particularly jail house snitches who will implicate anyone for a better deal. Scotland Yard has used 158 “supergrasses” used since 2006, including Gary Eaton, 51, who is now the center of a scandal over such procured testimony. Called a “pathological liar” by two courts, the Metropolitan Police still used Eaton to the trial of various people of murder. While records show the police were aware of his prior record, pathological lying, and mental instability, Scotland Yard has announced that no officers or prosecutors will be punished for his use as the star witness in two murder trials.

Eating Out of House and Home: Republican Opposes New Taxes By Noting That He Needs $200,000 a Year for Food

There may be need for an intervention in Congress after Rep. John Fleming, a Louisiana Republican, admitted to what appears an eating disorder. Fleming went on television to denounce Obama’s plans to tax the wealthy and explained how he really does not have a lot of income left over from earning $6.3 million a year from his string of Subway and UPS businesses. He insists that after paying taxes, salaries, and support for his businesses, he only takes home $600,000 — of which $200,000 goes to food for his family. Fleming is the father of four adult children and lives alone with his wife.

First Circuit Reinstates $675,000 Verdict Against Boston University Student For Downloading Songs

For years, we have discussed the abusive litigation by the Recording Industry Association of America in seeking obscene damages against people for downloading songs. Congress, again, caved to demands by lobbyists to allow for such lawsuits. The result has been thuggish lawsuits where industry lawyers threaten not only citizens with ruin but, in the case of the Copyright Group, those who try to help them. Now, one of the most obscene verdicts against Boston University student Joel Tenenbaum has been reinstated by the First Circuit — $675,000 for downloading and sharing 30 songs. The court, however, takes the rare step of suggesting that Congress may want to look again at the law. The problem is that these citizens do not have well-paid lobbyists and massive campaign funds to motivate many members to act. The Obama Administration joined the industry in defending the law and the original fines as not unconstitutional.

Posner Ridicules Right of Citizens To Film Police in Seventh Circuit Oral Argument

Judge Richard A. Posner is a legal icon who has had more impact on the development of the law. As the father of the Law and Economics movement, Posner’s writings are featured heavily in my classes as well as other classes around the country. While I disagree with him, I have tremendous respect for his scholarship and jurisprudence. However, a recent oral argument revealed a less flattering side of the former University of Chicago professor. Faced with an attorney from  the American Civil Liberties Union in a case involving the right of citizens to film police in public, Posner cut him off after 14 words and spoke derisively of the right of citizens and groups to engage in such protected conduct.

Fidler in the Subway: New York Council Member Calls For Censorship of Pro-Palestinian Ads in Subway

Councilman Lewis Fidler (D-Brooklyn) is calling for the Metropolitan Transit Authority (MTA) to pull down ads critical of funding for Israel. Fidler is demanding that MTA President Thomas Prendergast put an end to billboards calling for an end to funding for Israel as “a highly political campaign with a controversial underlying anti-Israel message.” Apparently, amid all of the graffiti and ads and pamphlets in the MTA there is no room for messages critical of Israel. Fidler wrote I would urge you to disallow and/or remove these advertisements.”

Redistricting and the Citizen Legislator

The decennial exercise in legislative self-dealing known as redistricting has been frequently assailed as corrupt.  Efforts to eliminate the incentive to treat redistricting as an incumbency protection racket by placing term limits on House and Senate members have run afoul of the Constitution.  But Floridians may have found a partial solution.  As Republicans were strengthening their super-majority status in the state legislature this past November, eagerly anticipating the opportunity to redistrict the remaining Democrats to somewhere in the middle of the Gulf of Mexico, voters were simultaneously adopting by substantial margins two amendments to the Florida constitution intended to eliminate gerrymandering.  And a federal judge has now thrown out the Florida legislature’s constitutional challenge to one of those amendments.

Baldwin Accuses News Corp of Censoring Joke on Murdoch

There is an interesting censorship allegation this week after Alec Baldwin walked out on the Emmy telecast in response to the decision by News Corp to cut a joke about CEO Rupert Murdoch and the expanding phone-hacking scandal. Comedians have always been a central part of political speech in the United States as have cartoonists and others who use art or prose to address matters of public interest. The alleged censorship of the material by Fox or News Corp shows, at very best, a lack of judgment by company officials and attorneys.

A Startling Lack of Compassion

Webster’s defines compassion as:

compassion \kəm-ˈpa-shən\, n.,
: sympathetic of others’ distress together with a desire to alleviate it

In yet another instance of corporate callousness, Claudia Rendon, a 41-year old mother from Philadelphia, was fired from her job at Aviation Institute of Maintenance after taking leave to donate a kidney to her son, Alex.  Kidney transplant surgery normally takes six to eight weeks recovery time.  Rendon had discussed taking unpaid leave from  July 19 to undergo the kidney transplant surgery on July 21 at the Hospital of the University of Pennsylvania and to return to her job on September 1.  She told ABC News that on her last day of work, her manager presented her with a letter to sign acknowledging that her job was not secure one hour after telling her that she would have her job upon her return.  On August 24, Rendon informed  Aviation Institute of Maintenance that she might not be able to return to work September 1 due to severe lower back pain; a common complication of such surgery.   Aviation Institute of Maintenance said they wanted a letter from the doctor.  The University of Pennsylvania hospital and her short-term disability provider each wrote letters to Rendon’s employer stating she would return to work Sept. 12.  Upon making a social visit to Aviation Institute of Maintenance on September 8, she found out her position had been filled by someone else on September 6.  Alex, who was a student at AIM, has also suffered repercussions of undergoing this lifesaving transplant.  The school is trying to collect $2,000 related to time he took off in addition to trying to charge him $150 to re-enroll. Did  Aviation Institute of Maintenance break the law?  Or are they just another example of a callous employer lacking in compassion?

Banned Books Week: Just a Lot of Propaganda Says Jonah Goldberg

Banned Books Weeks 2011 will be observed September 24-October 1.

 

Jonah Goldberg claims that Banned Books Week (BBW) is nothing but hype. In a column he penned for USA Today in early September, Goldberg wrote that BBW “is an exercise in propaganda.” He continued, “For starters, as a legal matter no book in America is banned, period, full stop (not counting, I suppose, some hard-core illegal child porn or some such out there). Any citizen can go to a bookstore or Amazon.com and buy any book legally in print — or out of print for that matter.”

I admit that I get a headache when I read any news about former Bush administration officials, but it seems that former Vice President Dick Cheney is in the news again and I am left scrambling for my migraine medicine.  He has written a book detailing all the wonderful things he accomplished as Vice President under George W. Bush.  Unfortunately for Mr. Cheney, in his efforts to explain his work as Vice President under George W. The Christian Zionist Movement and Jewish Confusion

Most people who regularly visit this blog know that I am Jewish. While I am not what one would call a pious Jew, being a Deist in outlook, I have always been very proud of my ethnicity and of the religion, which plays a central part in it. From their infancy, my children were immersed in Judaism both through education and by our family regularly taking part in Jewish Rituals, including regular Synagogue attendance. Where I part personally from normative Judaism is that I view the Torah, The Five Books of Moses, as primarily allegory with some real history thrown in. To me it is a work of some wise and some not so wise men, not the writings of God. I believe and have seen demonstrated in many families though, that the Torah and its 613 Commandments can serve as blueprint for living a fulfilling life.

The issue becomes complicated when it comes to my feelings about Israel. To me the existence ofI srael is a necessity for Jews to have a future in this world and if it comes to it, a final haven to make our last stand. I am an American first, so I would not willingly emigrate away from the country of my birth, unless those who hate Jews come to power. Contrary to the opinion of many, Jews are far from being a homogeneous ethnicity/religion. One cannot for instance refer to being an Orthodox Jew with any precision of description since that movement is in itself splintered on many details of interpretation. This is true of the other main branches of Judaism: Conservative, Reform, and Reconstructionism. Perhaps it is because there is no central Jewish religious authority speaking for all Jews, as much as organizations like ADL, AIPAC, et. al. would claim to, that the range of Jewish opinion is so wide on so many subjects.

This brings me to an article I read at the PublicEye.org titled: “The New Christian Zionism and the Jews”. Its’ thesis is that many Jewish supporters of Israel and the current Israeli government have allied themselves with Christian Fundamentalists whose “love” for Israel and Jews come from the wish to fulfill the prophecies of The Book of Revelations, where in fact Jews not willing to accept Jesus, will die in a horrid holocaust.  This trend has been one disturbing me for a long time. Chant Wars

St. Xavier is an all-boys Jesuit high school in Cincinnati, Ohio. During a football game with long-standing intra-city rival Colerain, the St. Xavier student section chanted “We’ve got Jesus!”, moments after Colerain missed a game-tying field goal. Do they really think that Jesus cares about who wins a football game?

The Colerain student body responded with their own chant: “We’ve got girls!”

While St. Xavier won the football game, by a score of 17-14, they lost the chant war.

White House Warned in 2009 That Solyndra Was Poor Investment

For about a week, I have been hesitant to post on the Solyndra scandal. There seemed to be a bit of too much of a pile on due to this being a green tech company. However, it is now serious and new evidence suggests that the White House was not just cavalier with such stimulus funds but willfully blind that this company (run by a major Democratic donor who visited the White House repeatedly before the public support by the President) was likely to fail. At best it was a remarkably moronic move by the President and his staff.

General Accuses White House of Pressuring Him To Change Testimony To Favor Company Run By Democratic Donor

There is a disturbing story out this week that four-star Air Force Gen. William Shelton testified under oath that the White House tried to pressure him into changing his testimony on a new wireless project in a way that would benefit a large Democratic donor. There is also an allegation that someone in the Administration leaked the intended testimony to the company.

Report: English Police Officers “Barely Literate” Due To Lowering Entry Standards

A new report on the quality of police in England found that some officers are “barely literate because entry standards are so low.” The author suggests that these standards were lowered to allow for greater numbers of minority officers. However, now the lack of literacy is delaying proceedings and causing problems for judges and lawyers alike.

Illinois Associate Justice Lloyd Karmeier is under fire this week after a petition was filed with the court detailing what is alleged to be previously undisclosed support from State Farm Insurance Company before Karmeier voted in favor of its side in a dispute. Previously, State Farm told the court that it had given $350,000 to Karmeier. Now plaintiffs lawyers, including former Sen. Fred Thompson, allege that he actually received between $2.4 million and $4 million from State Farm sources.

Mao’s Little Mandarins: Chinese Communists Lead List of The Super Wealthy

The concept of a millionaire Communist might not sit well with Mao’s Little Red Book, but it appears to be just fine with the modern Chinese Communist Party. The Forbes China 400 Rich list revealed this week that ‘over 90% of the 1,000 richest people tracked by the Hurun Report are either officials or members of the Chinese Communist Party.” The list reinforces the view that the CCP has become more of a cartel or, in some cases, a criminal enterprise than a true political party. Communist officials are routinely accused of breathtaking corruption and use of state power to force peasants from their land in development schemes.

FBI Raids Home Of CBS Correspondent By Mistake

Florida Woman Found Guilty of Criminal Neglect In Leaving Dog At Store For A Day Despite Absence of Necropsy

There is a fascinating case out of Florida this week that raises questions over the required proof needed for a criminal conviction — in this case, animal cruelty. Carla Ann Thomas was convicted of animal neglect after her a 5-year-old Akita named Sache was found dead after being left over the weekend at Healthy Paws, Thomas’ health food store for dogs and cats in St. Petersburg. She was convicted despite the fact that there was no necropsy and no one knows why the dog died. The prosecutor says that that is immaterial.

Cherokee Tribe Asserts Right To Expel Blacks

The Cherokee Tribe is in an interesting confrontation with the federal government over the right of the tribe to ban 2,800 African Americans from its citizenship rolls. Joe Crittenden, the tribe’s acting principal chief, insists that the Bureau of Indian Affairs has challenged the sovereignty of the tribe and “The Cherokee Nation will not be governed by the BIA.”

A story today should prompt some discussion in how our society is changing as more and more Americans work for the government. Following up on a previous post titled Libyan Rebels Claim To Find Evidence That CIA Helped Capture Libyan Dissidents and Used Regime For Renditions and Torture:

Human Rights Watch (HRW), an organization that discovered hundreds of archived documents in Tripoli, said the documents provide evidence of US and UK complicity in torture crimes in Libya during the rule of Col. Muammar Gaddafi. From Human Rights Watch: “Among the files were documents confirming that both the US Central Intelligence Agency (CIA) and the United Kingdom’s MI6 sent terrorism suspects to Libya for detention – despite Libya’s notorious record for torturing prisoners.” The documents appear to show that Libyan cooperation with both the Central Intelligence Agency and Britain’s MI-6 agency under Gaddafi was closer than had been acknowledged in the past. According to the New York Times, the CIA sent terrorism suspects to Libya for interrogation at least eight times.

Amputee Must Prove It Every Three Years to Keep Handicapped Parking Permit

It’s nice to see our government off the “Stupid Train” for once. Swedish officials continue to require Fredrik Jansson of Skelleftea to verify that he has trouble walking after his leg was surgically amputated ten years ago. Jansson who suffered the procedure as part of his bid to fight off bone cancer, finds the regulation ridiculous.  He is mandated to see a physician to verify the loss every three years.

Texas v. White

On November 9, 2011, Justice Antonin Scalia will preside over the reenactment of Texas v. White (1869). The event is part of the Frank C. Jones Reenactment Lecture hosted by the Supreme Court Historical Society.

Each side get 20 minutes to present their case and then Justice Scalia will render his opinion. These reenactments are apparently enjoyed by the Justices who participate.

Carjacker’s Wild Ride

Dionette L. Price may need some basic crime lessons. Seeking to carjack a vehicle driven by Rayna Garrett, Mr. Price opted to stand in the middle of busy U.S. Highway 71. When Ms. Garrett attempted to drive around the would-be felon, Price leaped onto the hood of her car, brandished a .357 semi-automatic handgun, and told her, through the glass, to “..drive or I’ll blow your head off.”  Ms. Garrett obliged the 26 year-old and took him directly to the Kansas City police station garage. Finding no one in the garage, she rammed the door and alerted the attendant. A foot chase ensued between the Kansas City police and our ersatz “Mr. Toad,” resulting in felonious restraint and weapons charges.

Is This Man The Founder Of The Republican Party?

Not quite. The Republican Party was founded in 1854 by a coalition that included anti-slavery activists. The Republican Party name was christened in an editorial written by New York newspaper magnate Horace Greeley. The first Republican National Convention was held in the Musical Fund Hall in Philadelphia, Pennsylvania, on June 17 to June 19, 1856, where  John C. Frémont was nominated for the President of the United States and William L. Dayton was nominated for vice-president over Abraham Lincoln.

Yet President Obama, in Thursday’s speech before Congress, said: “We all remember Abraham Lincoln as the leader who saved our Union. Founder of the Republican Party.”

Reflections On 9/11

Below is today’s brief essay in the Los Angeles Times that is part of a series called Reflections on 9/11. I was asked that day after the attacks to write a column for the newspaper, which ran on September 13, 2001. As I wrote the piece, I could still see smoke rising from the Pentagon. The plane in Washington hit just behind my car a minute or so after I passed the Pentagon on my way to work from Alexandria. On that day, my greatest concerns were two-fold: a change in the definition of war and the expanded use of assassination. Unfortunately, my worst predictions were exceeded by the Bush Administration and later the Obama Administration. It is shocking to think that this was ten years ago. The images and feelings remain so vivid. My car was forced into a curb by a careening car that morning and I had to replace my tire as the smoke bellowed from the Pentagon. The thought of all the innocent people lost in Washington, New York, and Pennsylvania remains an open wound for so many of us. The sheer savagery and inhumanity of the attacks shocked the conscience — a feeling only magnified later when Bin Laden was shown gloating over how he personally advised the terrorists on the best place to hit the buildings. The cautionary piece on September 13th was not meant to take away from the legitimate and collective anger that we felt — and still feel. However, it was already clear within two days of the attacks that Bush officials were going to seek the radical expansion of presidential powers and were already referencing our civil liberties as an impediment to our safety. My heartfelt sympathy to all who lost friends and family on that day.

Speak Not of the Dead

Cecelia Ingraham had a daughter.  Her name was Tatiana.  In 2003, her then teen-aged daughter was diagnosed with leukemia.  After a brief period of remission, the cancer returned.  An opportunistic infection claimed Tatiana’s life in 2005.  Tatiana was an only child.

Cecelia Ingraham had a job.  It was in New Jersey.  She worked for Ortho-McNeil Pharmaceutical for 12 years as an administrative assistant in the marketing department.  At this job, she had a cubicle.  In this space, Cecelia kept mementos of her daughter not unlike any grieving parent might; pictures and a pair of ballet slippers.  On this job, like any job, not all discussions are about business matters.  In the course of meandering discussions, Cecelia sometimes talked about her deceased daughter not unlike any grieving parent might.  In the spectrum of trauma human beings can face, “what’s the worst trauma” is a zero sum game, but in that spectrum there are certainly forms of trauma that are uniquely painful due to their nature.  In that regard, for a parent to lose a child is a unique trauma.  It leaves an emotional scar that for most never fully goes away.

About a year and a half after Tatiana’s death, Carl DeStefanis, Director of Marketing, at the urging of Human Resources, had a discussion with Cecelia Ingraham “to convey complaints [Human Resources] had received about plaintiff’s conduct and interaction with co-workers. Several of those complaints were unrelated to Tatiana, but administrative staff in the department had also remarked about plaintiff’s tendency to speak to them about Tatiana’s tragic passing. The co-workers said they sympathized with plaintiff, but they felt uncomfortable and at a loss for ‘what else that we can say that we have not said already.’  The co-workers said they tended to avoid contact with plaintiff and to take work or questions elsewhere.” DeStefanis told Cecelia Ingraham that she needed to remove the pictures and ballet shoes of her deceased daughter from her cubicle and that she could “no longer speak of her daughter because she is dead” and should act as if her daughter “did not exist”.

Distraught, Cecelia left work that day and did not return.  Over the next few days, she began to have sudden heart palpitations that required surgery.  After the surgery and some recovery time, Cecelia Ingraham resigned her position at Ortho-McNeil Pharmaceutical.  She then filed suit for Intentional Infliction of Emotional Distress (IIED) against Ortho-McNeil Pharmaceutical, their parent company Johnson & Johnson, and Carl DeStefanis.  What happened next might be seen by some people as adding insult to injury.  Her case was dismissed.  But was it a result of bad law or a failure in basic empathy?

The President Has Been Afraid of What?

As someone who voted for and rejoiced in Barack Obama’s election in 2008, I had certain expectations for his Presidency. My expectations heightened with the Democratic party’s majorities in Congress. Foremost I wanted to see a swift end to both wars, which I believe are unjust and draining the resources of this country. Since Obama was presumably a constitutional law scholar, I expected that he would return this country to the Rule of Law. I expected the new President to eliminate the Bush constitutional usurpation of our government and people, occurring with Democratic Party compliance. The Administration would end the widespread use of torture, rendition, and the excesses of The Patriot Act. His Department Of Justice would prosecute those who were responsible. As far as the economic crisis engendered by Wall Street excesses, I had faith that he would deal with it through FDR like projects, by re-regulation/prosecution of the financial industry and ending the unjustified Bush Tax cuts for the wealthy.

 That none of this has happened, or was even attempted has filled me with disappointment and anger towards this Administration’s performance. In my mind as I tried to make sense of it of this betrayal, there was a nagging suspicion. What if the “powers that be” in our Country including the Military-Industrial complex had sent the word to the newly elected President: “Play ball”, or find yourself and your family grievously threatened? I was a young adult through the 60’s as I watched the assassinations of my heroes, one of whom was a President. I’m not  comfortable with the official explanation of these deaths, since there was much that didn’t make sense. In the 70’s The Pentagon Papers, Watergate, and later the Church Committee Report on the CIA gave credence to the possible actions of a secret government. In addition, we learned from General Smedley-Butler, http://en.wikipedia.org/wiki/Smedley_Butler  that a group of businessmen had contacted him in 1934 about leading a coup against FDR. One of those conspirators was Prescott Bush, father of Bush I and grandfather of Bush II. Later, Prescott Bush was involved in a Bank that had financed the NAZI’s rise to power. http://www.guardian.co.uk/world/2004/sep/25/usa.secondworldwar.

Pay to Say: Paul Ryan Charges His Constituents to Talk to Him

During the recent Congressional recess, House Budget Chairman Rep. Paul Ryan (R-WI) decided that he wasn’t going to hold any public face-to-face town meetings with the constituents in his district. Instead, according to Politico, he opted for town hall-style meetings that were strictly “pay-per-view.” And Ryan wasn’t the only member of Congress who chose to charge people for the privilege of speaking to them.

In a Politico article, Reid Epstein wrote:

By outsourcing the events to third parties that charge an entry fee to raise money, members of Congress can eliminate most of the riffraff while still — in some cases — allowing reporters and TV cameras for a positive local news story.

Evidently, Ryan didn’t want to be confronted at public forums with any protesters or with angry backlash or questions from voters upset with his positions on issues like taxes, Medicare, and Social Security—as he was last spring.

New Mexico Gov. Susana Martinez took office in part based on her hard stance against illegal aliens. After being given 1930 Census records by reporters, however, she has now acknowledged that her grandparents illegally came to the USA from Mexico. In the meantime, another family member of President Obama has been arrested as an illegal alien.

Scientists Find 2 Million Old A. Sediba; Creationists Find a 6000 Year Old Dead Ape

Scientists have again embarrassed themselves . . . this time in that fanciful Science Magazine. While creationists (including many of the GOP presidential contenders) have shown that the Earth is only 6000 years old, scientists insist that they have found Australopithecus sediba fossils with the skull, pelvis, hands and feet of the ancient hominin. The fossils with both ape and human characteristics were unearthed three years ago in South Africa.

Armed Man Assaults Clerk, Hops Over Counter With Gun, Fires At Man . . . Walgreen Denies Armed Robbery In Progress

We have previously followed employees fired or denied benefits for resisting robberies, even when coming to the aid of customers. In the case of Jeremy Hoven, the pharmacist says he was fired by Walgreens after he foiled a late-night robbery in Michigan. He has now filed a wrongful termination lawsuit and Walgreens’ answer to the complaint has an interesting reported twist.

Galliano Found Guilty Of Anti-Semitic Comments

CNN is reporting that fashion designer John Galliano was found guilty Thursday in a French court on charges of making anti-Semitic comments against at least three people in a Paris café. He has been fined 6,000 euros. It is the latest example of a crackdown on free speech in the West. As obnoxious and reprehensible as these comments were by Galliano, the case would have been dismissed on free speech grounds in the United States.

Florida Teen Arrested After Successfully Posing As Physician’s Aide At Hospital ER

Matthew Scheidt, 17, has been charged in a bizarre case where he successfully posed as a physician’s assistant for two weeks at a hospital. He was able to work in the ER, remove IV, and perform examinations at the Osceola Regional Medical Center in Kissimmee, Florida.

Police in Ogden, Utah, were called to a man’s home when neighbors say that they heard a moo, a shot, and saw the man cutting off a cow’s head. The police came and declared that the man is allowed to butcher the animal at his home. And you thought your neighbors’ lady leg lamp in the front window was disturbing.

In Hot Water: Arkansas Weatherman Found In Hot Tub With Dead Man Wearing Dog Collar

Arkansas weatherman (KARK 4) Brett Cummins is at the center of a bizarre case after he was discovered in a hot tub with a dead naked man wearing a dog collar around his neck. It is still unclear what killed Dexter Williams, but (even if not charged in a homicide) Cummins could face charges on drug use or possession given a witness’s statement to police.

Study Estimates Roughly 40 Percent of Europeans Suffer From Mental Illness

We have previously discussed studies showing high levels of mental illness in the United States. Now a Europeans shows a similarly high rate with “almost 165 million people or 38 percent of the population suffering each year from a brain disorder such as depression, anxiety, insomnia or dementia.” What is interesting is that the rate is higher in Europe as compared to the U.S. study cited earlier. The European study however appears to be broader in considering neurological conditions associated with illnesses like stroke.

It may be true that “Ye cannot serve God and mammon,” but Jay Sekulow, the advocate for conservative religious causes, seems to have found a way. A new report alleges that Sekulow and his family have reaped millions in defending religious organizations and fighting the separation of church and state. What is clear is that his decision to fight for religious groups did not involve a vow of poverty.

This extraordinary picture was just released by NASA showing the footprints, moon buggy ruts, and garbage left by the Apollo astronauts from 1969 to 1972. Toledo Police Chase Results In The Death of Innocent Driver and Seven Other Injuries To Innocent Bystanders

There has long been controversy over high-speed chases by police that result in the deaths of innocent drivers. Some jurisdictions have sharply curtailed the circumstances under which police can engage in such chases. Those concerns are likely to be heard in the aftermath of a tragic death of Larry Collins, 63, after a police cruiser collided with his car during a chase of a robbery suspect. The police were chasing Brian Lipp on a highway . . . going against the traffic.

La Loi D’Amour : French Judge Awards Damages To Ex-Wife For Lack of Sexual Relations With Former Husband

A judge in Nice has not only granted a divorce but damages to a 47-year-old wife for insufficient loving by her 51-year-old husband (known only as Jean-Louis B.). The damages appear to work like a type of loss of consortium claim against a spouse and was issued under article 215 of France’s civil code, which states married couples must agree to a “shared communal life.”

Nuremburg Revisited and Revised: The Legitimation of Torture in the United States

With the approach of the ten-year anniversary of September 11th, this chapter of a new book may be of interest. I agreed to join authors from both sides of the debate in a discussion of the legacy of the attacks, though the book is heavily weighted with conservatives ranging from John Ashcroft to Michael Mukasey to John Yoo. I was not aware when I agreed to do the chapter that Yoo would join Dean Reuter as an editor on the book. Despite my strong feelings about Yoo’s infamous role in the torture program, I felt that I had to fulfill my promise so I wrote a chapter on torture and the torture lawyers, including Yoo. The book is entitled Confronting Terror: 9/11 and the Future of American National Security.

ADA Ugly: Texas Professor Proposes Extending Federal Protection To Unattractive People

An opinion piece by University of Texas economics professor Daniel Hamermesh makes a novel argument that, because studies show that “ugly” people are paid less and receive lower benefits, the Americans With Disabilities Act (ADA) should extend protection to them in the same way of workers protected from discrimination for conventional physical disabilities like blindness. This would lead to a new term “ADA Ugly” to replace “coyote ugly.” Yet, it might be a bit premature to cancel that botox and cosmetic surgery.

Libyan Rebels Claim To Find Evidence That CIA Helped Capture Libyan Dissidents and Used Regime For Renditions and Torture

With increasing reports that the Libyan rebel forces include extreme Islamic elements and ties with Al Qaeda, a new press report is not going to help matters in the creation of the first new government vis-a-vis the United States. Rebels say that they have discovered documents in intelligence files that show that the U.S. and Britain helped capture and turn over dissidents to the regime. The papers also reportedly show that the CIA used the regime in rendition cases where suspects were handed over to be tortured.

Guiltless Meat? Scientists Developing Stem Cell Sausage As First Artificial Meat

In the Netherlands, scientists are close to producing the first artificial meat — stem cell sausage grown in the lab without the need to slaughter animals. The question is whether this means that vegetarians who now refuse to eat meat for philosophical reasons would be able to eat a ribeye without moral qualms.

Perp Walks: Bronx Man Accused of Attempted Murder of Police Officer Allowed to Walk Due to Mishandling of Case By Prosecutor

Darren Morris, 27, a parolee accused of trying to kill a police officer, has hit the jackpot. Morris will walk after Bronx prosecutor Christine Scaccia missed a series of court dates that resulted in the judge eventually forcing all charges to be dropped for lack of prosecution.

Maricopa County Settles First Case Over Abuses By Joe Arpaio and Andrew Thomas

While Maricopa County Sheriff Joe Arpaio continues to spend money on such things as giving Steven Seagal a tank and army to raid homes for his reality television program, county lawyers are trying to settle one of the many lawsuits over his abuse of his office. The latest payment of tax dollars went to retired county Superior Court Judge Kenneth Fields. We previously detailed the disgraceful actions taken by former County Attorney Andrew Thomas and Arpaio against judges who did not bend to their will.
