"did anyone else have to swear on a bible that their address was correct before they were able to vote? just wondering, because i did," Philadelphia voter Lindsay Granger wrote on her blog after voting in last Tuesday's mid-term election. "i had to lay my palm on the good book and state my name and address before i was allowed to sign my name in the voting log and enter the booth. they called it an affirmation. i call it creepy… and a little offensive…"

Granger notified VotersUnite.org last week after the incident which, she told the non-partisan election watchdog organization, made her "extremely uncomfortable because i'm not a Christian, and when i brought that up I was told to do it anyway."

In her blog item, Granger, an African-American, admitted to being "hypersensitive" given "the historical context of black people voting in america".

When informed of the incident, Bob Lee, the Voter Registration Administrator for the Philadelphia City Commissioners, confirmed to The BRAD BLOG that Bibles are, indeed, included in the package of election materials provided to each polling site, but says no such oath is required before casting a vote.

The incident reportedly took place at Philadelphia's Ward 15, Division 01 polling place at Trinity Baptist Church on Poplar Street. It was Granger's first time voting at that precinct after having moved recently from another area in the city.

Lee conceded that, based on Granger's description of the incident --- which he hadn't heard about until we contacted him for comment --- it sounded like the election board at the precinct "needs some training"...

Good for Sinclair Broadcasting, in this case, pulling an inaccurate commercial off the air that was being run by the despicable corporate money-launderers of the U.S. Chamber of Commerce, attacking Democratic U.S. Senatorial candidate Joe Sestak in Pennsylvania.

Of course, the ad was run on television before it was pulled. The fact-checking was not done in advance, so lies such as health insurance reform being "a government takeover of healthcare" were allowed to be aired as if they were legitimate claims.

Naturally, the campaign of Sestak's Republican opponent, Pat Toomey, backed up the Chamber's ads, even as they are not supposed to be coordinating with such groups, according to the law. But what do quaint old notions like "the rule of law" really mean anymore in these United States anyway?

What is underscored again here, is that corporate lobbyists and criminals like those at the U.S. Chamber of Commerce are now free to wield millions --- even billions --- of dollars for or against candidates they don't like, or who may not meet with their corporate approval for any reason.

That's what the U.S. Supreme Court has recently deemed "free speech". And you, dear private citizen of the United States of America, can do nothing about it --- unless you happen to have a few hundred million extra dollars sitting around the house and want to exercise your "free speech" in producing and airing TV commercials in opposition. Good luck with that.

UPDATE 4:04pm: Looks like the Rightwing corporate bosses at Sinclair may have come down on the local stations. AP is now reporting the Chamber says the ads are being restored:

Two Pittsburgh-area TV stations are reversing a decision to pull a commercial attacking Democratic policies and the voting record of U.S. Senate candidate Joe Sestak.

The U.S. Chamber of Commerce said Friday that the stations are restoring the ad that the business advocacy group sponsored.

An official for sister stations WPGH and WPMY declined to comment.

'Intellectual Property' of voting systems still owned by firm linked to Venezuelan President, despite press statement to the contrary
PLUS: The election official/e-voting company revolving 'oversight' door continues to turn...

Canadian-based Dominion Voting Systems has quietly announced its second acquisition of a major U.S. voting machine company in as many months and, right out of the gate, they've lied about it. Not an auspicious beginning for the company which may now, virtually overnight, have become the dominant private e-voting machine company in this country.

In our recent breaking coverage detailing the SEC's fraud lawsuits filed against Diebold and a number of their top executives --- including their former Chief Financial Officer who, as we reported exclusively back in 2007, was the top earner from an apparent insider sell-off at the company just days before its stock would plummet from its all-time high on the announcement of spinning off their troubled election division to a "new" company renamed Premier --- we noted that Diebold/Premier's assets had recently been purchased by a small Canadian firm by the name of Dominion Voting. But Dominion hasn't stopped there.

Their purchase of Diebold/Premier's assets was actually made from ES&S, the world's largest voting machine company, who was forced to divest of the assets they'd purchased from Diebold (previously, the second largest voting machine company in the country) for $5 million last year, as part of an anti-trust suit settlement with the DoJ.

In our coverage, we noted the comment of Dominion CEO John Poulos who, in the company's press release [PDF] announcing the Diebold/Premier asset acquisition, stated ominously: "We are extremely pleased to conclude this transaction, which...will allow Dominion to expand its capabilities and operational footprint to every corner of the United States."

Indeed, the DoJ-scuttled ES&S merger with Diebold/Premier had been legally challenged since, among other reasons, the merger of the largest e-voting company with the country's second largest would have given a single company control of at least 70% of all votes cast in the nation.

What we had replaced for length, however, with the ellipses in Poulos' quote above, was this [emphasis added]: "We are extremely pleased to conclude this transaction, which will restore much-needed competition to the American voting systems market and will allow Dominion to expand its capabilities and operational footprint to every corner of the United States."

How much is Poulos actually interested in "restor[ing] much-needed competition" for "the American voting systems market"? Apparently not so much, as according to a company press release [PDF] quietly issued late in the afternoon on Friday, June 4th, Dominion has now also acquired what had previously been the third largest voting machine company in the U.S., Sequoia Voting Systems.

Not surprisingly, that late Friday announcement didn't say anything at all about "competition".

Worse, as The BRAD BLOG has confirmed, the new press release from Dominion simply lied about what the company has and hasn't purchased from Sequoia, a company which had lied themselves, for years, about the real ownership of its proprietary voting systems...

Democratic turnout far outpaces Republican...

Setting aside the unverified (and, in many cases, unverifiable) results of yesterday's elections for the moment, what caught my eye throughout the night were the turnout numbers, Democratic compared to Republican.

While the reported results of the races ran largely counter (surprise!) to the "GOP/TeaParty-fueled Massacre Slated for November!" meme that the corporate beltway media and related villagers have been endlessly re-enforcing with zombie-like precision over the last several weeks and months, the turnout of actual voters in the marquee state-wide primaries (races that we detailed, along with the e-voting systems in use, in our Super-ish Tuesday Backgrounder on Monday) seem to be of note when considering what November might actually look like when all is said and done.

I'd caution not to take too much from these numbers as there are various mitigating factors that could be used to explain them --- or even explain them away --- as noted below, but I think the numbers themselves are very much worth noting here, as I haven't seen much coverage of this over the last 12 hours or so...

Tuesday's election are being called "Super Tuesday" by some in the media hoping to hype the four-state Election Day as a bellwether for the "anti-incumbency fever" predicted by the same media for this November.

But beyond the marquee races in each of the states holding elections tomorrow --- Kentucky, Pennsylvania, Pennsylvania, Oregon (and Hawaii is currently holding an all-mail special election which ends on Saturday) --- as usual, we'll be keeping our eyes on whether voters are actually able to cast their votes, and whether or not those votes are actually counted and counted accurately.

The mix of states holding elections tomorrow also offer a mix of electoral systems --- from a majority of voters using 100% unverifiable touch-screen machines in use in KY and PA, to a compilation of touch-screen and paper ballot systems run by a company with a disastrous reliability record in AR, to the black hole of all mail-in voting in OR (and in HI).

Remember, whatever happens or gets reported (or doesn't) on Tuesday, it's often the case that concerns about failures in the system don't necessarily become immediately apparent on Election Day itself. Sometimes problems in the system and in the tallies do not begin to emerge until days, weeks, and sometimes even months after Election Day. So whatever we see in the surface reports tomorrow, for good or bad (and, as usual, you can count on various reports of "glitches," "hiccups," "snags," and "snafus" which use those words to marginalize problems, instead of the correct word: "failures") may just be the tip of any electoral icebergs beneath the surface. As usual, eternal vigilance by the citizenry is the hallmark of the ongoing fight for electoral integrity and transparency in these United States.

After all these years, not much has changed for the denialist jurisdictions that still insult their voters by using 100% unverifiable electronic voting machines.

Pittsburgh's WTAE filed a report last week with a ring of exhausting familiarity --- at least to long time readers of The BRAD BLOG. This one stars, as usual, both an open, unsecured door to the warehouse, and an election official --- in this case, Allegheny County Pennsylvania's Election Division manager, Mark Wolosik --- claiming he's "seen" no problems before, so everything is just dandy, nothing to worry about when it comes to his support of the use of 100% unverifiable electronic voting systems by his county's voters...

(How else are they gonna be able to 'win' elections at this point?)

Can't tell you how sick I am of the GOP's ACORN nonsense, having long ago exhausted myself in debunking the entire GOP scam to try and use the group as a stalking horse to support their own insidious efforts at imposing polling place Photo ID restrictions in hopes of doing nothing more than keeping 20 to 30 million legal, largely Democratic-leaning voters from being able to cast their legal votes, because they don't own the type of ID that would be required to vote under these draconian, unnecessary, Jim Crow disenfranchisement laws.

But, as a quick perusal of recent 'Daily Voting News' articles will show, efforts are still being doubled, and redoubled, by the GOP in state legislatures across the country in hopes of passing such restrictions into law. It seems these laws, meant to combat non-existent "voter fraud," are the Republicans' last, best hope to be able to actually "win" elections at all these days.

The New York Times just reported:

Senator Arlen Specter of Pennsylvania said on Tuesday he would switch to the Democratic party, presenting Democrats with a possible 60th vote and the power to break Senate filibusters as they try to advance the Obama administration’s new agenda.

Specter's announcement reflects an estrangement from the increasingly authoritarian, hard-right ideologues who now control the shattered remnants of the Republican Party. In California, the Republican Party passed a resolution to deny funding to six Republican lawmakers who joined with Republican Governor Arnold Schwarzenegger and Democrats, passing a budget to prevent this state from falling into an economic abyss. In the U.S. House of Representatives, every Republican acted as one to say “no” to a vital stimulus, offering only the very measures that led to the current economic meltdown—tax cuts for the wealthy. Three Republican Senators, Arlen Specter, Olympia Snowe and Susan Collins, had no sooner broke ranks in voting for a compromise version of the stimulus package before they found themselves targeted by conservative groups, with Specter facing a primary challenge from hard-right Republican Pat Toomey.

It is a testament to how far the remnants of the Republican Party have moved to the right that RNC Chairman Michael Steele suggests Specter would have been defeated by Toomey because of the former moderate Republican's "left-wing voting record."

As we pointed out previously, upon the anticipated denial of former Senator Norm Coleman's appeal by the MN Supreme Court, Senator-elect "Franken...would be in a solid position --- legally and politically --- to then lobby the Senate hard and directly for an immediate seating, even if Coleman chooses to continue his fool's errand with an appeal to the U.S. Supreme Court." Franken would become the 60th member of the Senate Democratic Caucus, ending the ability of the 'Party of No' to block the Democratic agenda --- unless either Susan Collins or Olympia Snowe beat him to it.

UPDATE 4/29, 5:55pm PT: In an op-ed appearing in today's New York Times Senator Snowe observed that "being a Republican moderate sometimes feels like being a cast member of 'Survivor' --- you are presented with multiple challenges, and you often get the distinct feeling that you’re no longer welcome in the tribe." Whether that means that she would be prepared to follow Specter off the reservation remains to be seen.

But it's not too late to save the last transparent electoral system in the United States...

New York is the last state in the nation to have a non-computerized, transparent voting system. We still use immutable, theft-deterring mechanical lever machines to count our votes. (* - Please seen bottom of this article for a quick explanation of how lever machines work, for those who may not know.)

New Yorkers are fighting to keep their current voting system, notwithstanding that New York's legislature passed a law in 2005 that says we should give up our observable, reliable levers in exchange for unreliable, concealed software-based vote counting machines. Nearly 1,800 New Yorkers have signed a petition, and three counties (Dutchess, Ulster, and Columbia, all PDFs), have passed resolutions to save New York's lever voting system.

The Association of Towns (half of New York's entire population lives in towns) recently passed a resolution to save the levers [PDF], and Nassau, Greene, and other counties are presently considering similar action to retain New York's lever voting system.

Moreover, reliable sources have confirmed for me that neither the Governor nor the Attorney General nor the State Legislature that passed the "Election Reform and Modernization Act" (ERMA) want to replace the levers anymore either (what politician would want to be responsible for choosing to cut essential programs for hungry children or the elderly, just to be able to replace our superior and affordable voting system with budget-breaking computers that are notoriously corruptible and defective?). But the State Legislature has not repealed ERMA and the Attorney General, to date, has supported the State (not the citizens).

So what is driving New York State to stick with a law that so many in New York believe to be such a bad idea? As a New Yorker who has been talking to many election commissioners, legislators and citizens, I was surprised to learn how many people believe the "Help America Vote Act" (HAVA) actually banned lever machines.

I read HAVA. It clearly does not ban levers. I recently discovered what has helped fuel this misinformed opinion in part: it is the discredited position of the discredited U.S. Election Assistance Commission (EAC), as detailed in a newly-unearthed document prepared for the state of Pennsylvania, at their request, in regard to the legality of lever voting machines.

Although the agency is not a court of law, and not even an agency deserving of deference for its opinions --- its allegiance has clearly been shown to be not with either voters or democracy --- the "HAVA-banned-levers" rumor was given the imprimatur of the EAC through this little-noticed document...

Pennsylvania voters challenging the continued use of unverifiable electronic voting machines in their state won another major round on Tuesday when the Pennsylvania Supreme Court issued a ruling allowing their case to proceed toward trial. The state’s highest court, in a one-sentence order, denied the Pennsylvania Secretary of State’s petition seeking permission to appeal a lower court ruling decided in the voters’ favor.

In April 2007, the Commonwealth Court of Pennsylvania had ruled that voters have a right under the Pennsylvania Constitution to reliable and secure voting systems and can challenge the use of electronic voting machines “that provide no way for Electors to know whether their votes will be recognized” through voter verification or independent audit. Following that ruling, Pennsylvania Secretary of State Pedro Cortés filed his petition before the Pennsylvania Supreme Court and further proceedings in the case, Banfield v. Cortés, had been suspended pending the outcome of the petition. The order issued on Tuesday gives a green light for the voters to pursue their claims.
