Why OWS must become the egalitarian democracy it seeks - Part I: Ill-defined 'consensus' is not democracy'

A post on Tuesday on the hard right Republican website Free Republic suggests that opponents of the Occupy Wall Street movement may well be injecting themselves into the demonstrations' open consensus process in order to confound the objectives of the nascent movement.

"[We n]eed LA Freepers to show up to block this vote by the Occupy LA General Assembly," the poster identifying themselves only as "joinedafterattack" wrote in apparent hopes of scuttling a discussion that night about a proposal being negotiated with the LA City Council to trade 10,000 square feet of office space and some farmland with demonstrators in exchange for their voluntary exodus from the lawn in front of City Hall.

The call by the rightwingers to take part in a General Assembly meeting at OccupyLA for the specific purpose of blocking a proposal (one that was rejected, in any case, by the majority of demonstrators that night) exposes the vulnerability of Occupy Wall Street's "consensus" decision-making and an internal contradiction between a movement which rails against rule by the 1% even as it permits the one to block the will of the many...

The photo at right may well provide a pivotal moment in a new American revolution. It exposes a crack in the façade of the corporate security state that could grow to the point that rule by and for the 1% may some time soon internally collapse.

The real story lies not in the fact that retired Philadelphia Police Captain Ray Lewis was arrested by the NYPD during an Occupy Wall Street confrontation. (Video of arrest posted below). It's the potential that Lewis' recognition of immense betrayal will spread throughout the rank and file of the security apparatus even as the clueless and increasingly desperate power elites seek to effectuate a coordinated crackdown on Occupy Wall Street encampments...

As tens of thousands march tonight in celebration of 2-month anniversary of Occupations...

Well this is a fun one...on a day where we could use a momentary breather...

...but on a day when the OWS folks are taking anything but.

Today is the 2 month anniversary of Occupy Wall Street, which has, at this hour, brought tens of thousands of demonstrators to downtown NYC tonight (and many more elsewhere at Occupations around the country.)

BONUS VIDEO: OccupyDC takes over Brookfield Properties DC headquarters in solidary with Occupy Wall Street...

As you know, just after midnight on Tuesday, NYC Mayor Michael Bloomberg had to forcibly evict peaceful Occupy Wall Street protesters with NYPD riot police, in order to send them in to the streets in middle of the night, for their "health and safety." As we reported yesterday, one of those cops reportedly threatened a Mother Jones journalist by dragging him behind a truck that was backing up, telling him "you could get hurt."

After the NYPD succeeded in removing the peaceful demonstrators --- or "thugs," as they are often described to propaganda-receptive Fox "News" viewers --- from Zuccotti Park, these are the fine folks (off-duty NYPD officers?) hired by the park's owners, Brookfield Properties, to replace them as it was cleaned...

In very related news...the Occupiers in Washington, D.C., in solidarity with their brethren in New York City, decided to Occupy the headquarters of Brookfield Properties yesterday. Some video of their "People's Mic" session in the lobby follows below...

As tweeted live during last night's raid on Occupy Wall Street...

One of the most remarkable moments we were able to follow, as it occurred, during the events of last night, as NYC Mayor Michael Bloomberg carried out his middle-of-night eviction of Occupy Wall Street demonstrators at Zuccotti Park, happened at about 4am or so Eastern Time.

Despite the (outrageous) ban on media at the park, as hundreds of NYPD cops in riot gear cleared the peaceful demonstrators for "health" reasons --- tossing them out of their tents, onto the streets and into the night --- Mother Jones reporter Josh Harkinson was able to make his way under the barricades and back into the park.

At the time he did so, there were a few dozen protesters left, holding firm around what had been the Kitchen Tent. It seems he may have been the only reporter in the park at that moment. Then, as he described this morning, the cops began "indiscriminately dousing the peaceful protesters with what looked like pepper spray or some sort of gas." He tweeted at the time that "Everyone I witnessed being arrested was resisting peacefully."

But it was his incredible account of what had happened to him after that moment, as told in a series of tweets that he shared after he had made his way back out of the park last night, which was extraordinary. Here is that remarkable set of tweets, in the order he tweeted them...

I was up most of the night following Mayor Bloomberg's NYPD eviction of the original Occupy Wall Street demonstration at Zuccotti Park, as it happened, via live streaming video (which may still be rolling at this hour right here) and via Twitter.

The surprise eviction by hundreds of cops in riot gear after midnight in NYC was done as protesters were told to suddenly clear the park for "health" reasons. In other words, Bloomberg threw hundreds or thousands of folks onto the streets of NYC in the middle of the night, for their health.

If I can offer any order out of the pointless, NYPD-caused chaos tomorrow, I will. Hopefully by then, others will have offered sufficient coverage.

Suffice to say for now, at least, what thousands of us witnessed tonight was appalling. At least those of us who sought it out, as none of the NYC local channels were covering it live and neither were any of the cable news channels MSNBC, CNN or Fox. As a matter of fact, other than citizen media streaming live on the Internets, only Al-Jazeera jumped in to offer live coverage.

Hours on end, thousands of peaceful demonstrators were roaming and marching the streets after being evicted from the park, all of the belongings, tents, gear, from two months of the Occupation in the park --- including thousands of books from The People's Library and their bicycle-powered generator --- were trashed and thrown into garbage trucks.

Network news helicopters were reportedly grounded during the raid, as air space above the park was shut down and --- perhaps most maddeningly --- media were not allowed into the park itself as the park was cleared, and as the last of the demonstrators who refused to leave were evicted, arrested, and, reportedly either tear gassed or pepper sprayed (though that is not confirmed --- because media were not allowed in the park!)

First Amendment, RIP.

I took a "quick poll" of my Twitter followers late at night to ask who would be hurt the most by the events of tonight, #OWS or Bloomberg? The vast consensus --- all but one --- replied to say that Bloomberg would be hurt, and that OWS would grow because of this. I don't know if that'll prove to be the case or not, but if I had to guess, I'd say they're probably right. The entire thing does seem to have been incredibly stupid and ill-considered on the part of Bloomberg and the NYPD.

UPDATE 11/16/11: After the riff-raff was cleared from the park, they were replaced by upstanding folks hired by Brookfield Properties, the "owner" of the public park, as security. One of those fine folks called a citizen journalist a "faggot" on video, in the bargain. Details/video...

An October 9 Time Magazine poll revealed that 89% of Americans agree that Wall Street exerts too much influence on our political system; 79% feel the gap between rich and poor is too large; 71% feel the executives from the major financial institutions responsible for the 2008 economic meltdown should be prosecuted; and that only 6% of Americans identify themselves as "Tea Party" followers.

Previous MSM efforts to either ignore what amounts to a genuine democratic uprising or to disparage Occupy Wall Street by falsely claiming the movement has no goal have obviously fallen flat. Against that backdrop, the corporate-owned Los Angeles Times launched a desperate effort to deceptively depict the movement as a transient phenomenon which has had its say and should now fade away.

That effort was apparent in both an October 27 front-page news article in the LA Times, "Putting the move in Occupy movement", as well as a lead editorial in the October 28 paper.

Despite such efforts, neither the dire underlying conditions which have been brought on by history's greatest wealth disparity and the tyranny of the corporate security state, nor the people's desire to realize America's still-unfilled egalitarian democracy is likely to dissipate any time soon. As the Mavis Staples song says, "We shall not be moved!"...

As there are still a number of brain-dead and/or entirely corrupt and/or entirely dishonest phonies who, even now, pretend they're unclear on what Occupy Wall Street's message is, Dahlia Lithwick smartly dispatches with their hooey today. Those folks aren't really worth our time.

But the fact is, the wholesale takeover of the American government by corporate "persons" --- and the (at least) 30 years of corruption and crapping on the middle class that has come with it --- has some 99% of us with a long, 30 year-list of complaints. They don't easily fit on one single bumper sticker. Ultimately, though, there seems just one thing that underscores all of those complaints: the end of any real accountability for every one of those corrupting influences and often criminal acts.

It has become almost unimaginable that flagrant lawlessness by the elite --- be they in government or corporatist America --- will ever be met with any sort of real accountability, any kind of accountability that might actually dissuade others from the same behavior in a way that might serve to reverse the ever increasing race to lower the bar below ground. That, I suspect, is the frustration at the heart of every Occupation and ever Occupier or those who support them in the country.

Two back-to-back interviews on Tuesday night's Rachel Maddow Show seemed to make these points as plain as could be, and one even offered some hope in the bargain. The first was with NY state Attorney General Eric Schneiderman who actually suggests he gets it, and is actually pursuing real accountability, with real investigations into criminality by the banks and the banksters before, during and after the explosion of the mortgage crisis. We'll see if he means it (or if he gets "caught" with a hooker first.) The second interview was with Constitutional attorney, Salon blogger and author of the new book, With Liberty and Justice for Some: How the Law Is Used to Destroy Equality and Protect the Powerful, Glenn Greenwald.

Now this is more like it. As described by RAW STORY...

Occupy Albany protesters in New York’s capital city received an unexpected ally over the week: The state and local authorities.

According to the Albany Times Union, New York state troopers and Albany police did not adhere to a curfew crackdown on protesters urged by Gov. Andrew Cuomo (D) and Albany mayor Gerald Jennings.

Mass arrests seemed to be in the cards once Jennings directed officers to enforce the curfew on roughly 700 protesters occupying the city owned park.
...
With protesters acting peacefully, local and state police agreed that low level arrests could cause a riot, so they decided instead to defy Cuomo and Jennings.

What part of the Constitutional First Amendment "right of the people peaceably to assemble, and to petition the Government for a redress of grievances," do so many of the other cops across the nation not yet understand?

By the way, with Cuomo's attempted crackdown and Obama's former Chief of Staff, now Mayor of Chicago Rahm Emanuel's approval of the arrests of 175 peaceful Occupiers in Chicago over the weekend, can we stop with the "Occupiers are just fronts for Democrats!" bullshit yet?

As registered nurses --- a number of whom were held in jail for some 23 hours after being arrested Saturday night, early Sunday morning while offering medical services to demonstrators in Grant Park --- protested the arrests outside Emanuel's office this morning, he was quoted by the Chicago Trib as saying: "I have to enforce the law as well as respect peoples’ 1st Amendment rights."

And when those two things come in to conflict, which one do you suppose Emanuel decided took precedence over the other?

The First Amendment of the U.S. Constitution declares:

...the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Isn't that quaint?

Josh Holland takes a look at what happened to that apparently antiquated notion from the document which used to carry some weight in the way this country was governed, as he notes that some 1,500 American citizens have now been arrested while peaceably assembling to petition the Government for a redress of grievances over the past month since Occupy Wall Street began.

Last night, while the GOP debated Casino Capitalism (in an actual casino!), Give Me Liberty author and reporter Naomi Wolfe became one of the latest to have had her Constitutional right to peaceably assemble for redress of grievances taken away from her, as seen in the following video (in which that "Democrat Party-sponsored" "mob" was attempting to petition Democratic NY state Governor Andrew Cuomo for a redress of grievances)...

Wolf wrote about her arrest seen above, "for standing lawfully on the sidewalk in an evening gown" at the UK's Guardian today, noting that she explained to the NYPD before she was cuffed that she was both a "NYC citizen and a reporter".

As her article's sub-header notes, "Arresting a middle-aged writer in an evening gown for peaceable conduct is a far cry from when America was a free republic."

"I became exhibit A in a process that I have been warning Americans about since 2007," Wolfe writes. "First they come for the 'other' – the 'terrorist', the brown person, the Muslim, the outsider; then they come for you – while you are standing on a sidewalk in evening dress, obeying the law."

This afternoon she told Huffington Posts' Jason Cherkis, "I didn’t choose to get myself arrested. I chose to obey the law and that didn’t protect me."

So, where are all the outraged "Tea Partiers" who used to decry supposed abuses of the U.S. Constitution under our authoritarian regime? Oh, right, they were just pretending to give a damn about any of it...like good little scammed Fox "News" soldiers.

P.S. Here's hoping Wolf makes out as well following her inappropriate arrest as Democracy Now!'s Amy Goodman did after hers.

UPDATE 10/19/11: In her Guardian piece, Wolf explained that the NYPD had told her the permit for the event she was attending (an annual Huffington Post event which Gov. Cuomo was also scheduled to attend, thus the protesters) when she came across the #OWS folks, forbade protesters from using the public sidewalks outside the building. Suspecting the claim from the police was bullshit, she says she requested to see a copy of that permit prior to her arrest, but was not allowed to.

Since posting the article above, Wolf contacted me to note that she has finally tracked down a copy of the type of permit HuffPo had last night and --- surprise, surprise --- the claim by cops appears to, in fact, be bullshit...
