As usual, BRAD BLOG readers were right in overwhelmingly determining, in our poll just after the New Year, that Senate Majority Leader Harry Reid would fold on his previous rhetoric promising to disallow the seating of anybody appointed by Gov. Rod Blagojevich to replace Barack Obama in the U.S. Senate. Roland Burris was sworn in as the newest U.S. Senator just minutes ago, as Reid and his fellow Dems stood in the background applauding.

Of course, as it turned out, it wasn't a difficult poll question to answer, given both the laws concerning such appointments, and the historical record of Reid's inability to either stick to his guns in any fight (ever) or, perhaps even more disturbingly, his failure to have even the slightest clue of when and with whom such battles should be picked.

Presuming Obama makes smart decisions at the White House (and that's certainly no safe assumption), there will only be so much he'll be able to accomplish --- ultimately, particularly after whatever honeymoon he's allowed is gone --- as long as Reid remains Majority Leader in the Senate, and Nancy Pelosi and Steny Hoyer are Speaker and Majority Leader, respectively, in the U.S. House.

They are all three dinosaur fossils of a failed era, have a record of miserable incompetence and need to be replaced. The only question is will it be before or after a thumping in the midterm 2010 elections.

Dem Leadership Tout Law's New 'Exclusivity' Provision, But None of Three Dems I Tried to Contact Can Adequately Explain Why They're Not Being Fooled Again...

House Majority Leader Rep. Steny Hoyer, (D-MD), one of the new FISA bill's strongest champions, spoke about the bill's new "exclusivity provision" on the floor of the House on March 14, 2008. He proclaimed that "It clarifies that FISA is the exclusive means of conducting surveillance in the United States for foreign intelligence purposes."

On June 20, Hoyer optimistically echoed his previous comment: "This legislation makes clear that FISA is the exclusive means by which the government may conduct surveillance."

Sen. Dianne Feinstein, (D-CA), in an email sent to some constituents, including myself, wrote that the new FISA bill: "Includes provisions I authored that make clear that FISA is the exclusive (or only) authority for conducting surveillance inside the United States...FISA would be the only legal authority for conducting surveillance on Americans for intelligence purposes..."

But the old FISA bill, which was the law when Bush began to spy on us without warrants, also had an "exclusivity" provision that stated:

[P]rocedures in this chapter or chapter 121 and the Foreign Intelligence Surveillance Act of 1978 shall be the exclusive means by which electronic surveillance, as defined in section 101 of such Act, and the interception of domestic wire, oral, and electronic communications may be conducted.

Since the "President" ignored the old FISA law, despite its existing exclusivity provision, what makes Hoyer or Feinstein or any of the other Dems think he'll bother to obey the new version of the law?

The existing law didn't keep Bush from breaking it last time, so it's beyond me what makes law makers think he won't do the same this time around. I decided to contact three different Democratic officials, all in favor of the new law, to try and find out why they believe they won't be fooled again...

Apparently, it's just fine to break the law, as long as the economy is seen as being bad...

Democratic leaders and aides tell The Politico that pursuing the contempt citations in conjunction with the stimulus package would "step on their message" of bipartisanship.
...
“Right now, we’re focused on working in a bipartisan fashion on [the] stimulus,” House Majority Leader Steny H. Hoyer (D-MD) told Politico...

Seriously, we must remember to speak with Hoyer and Pelosi about this terrific bridge we've got for sale. We're certain they'd be interested.

And while there seems to be confusion in the Kucinich camp concerning the Election "Recount" in NH (more soon on that, hopefully), at least there's no confusion for Kucinich when it comes to what's going on in either the White House, or among his party's "leadership," according to the New York Times:

[T]oday Mr. Kucinich took to the floor to fire off his latest salvo at the Bush administration: his plans to introduce Articles of Impeachment against President Bush on Jan. 28 — the day of Mr. Bush’s State of the Union speech.

Accusing the administration of lying about the need for the war in Iraq, Mr. Kucinich said he did not need to hear the president’s
assessment. “We know the State of the Union,” he declared. “It’s a lie.”

He also fired a volley at House Speaker Nancy Pelosi of California who has maintained that impeaching Mr. Bush is not on the table for Congressional Democrats. “If impeachment is off the table,” Mr. Kucinich said, “truth is off the table. If truth is off the table then this body is living a lie.”

Yes, a lie. Some 935 of them to be exact-ish, on just one aspect of what the Kucinich Impeachment articles will detail.

As we reported last December, Kucinich has been preparing, for some time, to file Articles of Impeachment against George W. Bush. While the Democratic "Leadership" may not like the notion, it should come as welcome news to the country's few remaining admirers of the U.S. Constitution.

Kucinich Proposal Eventually Referred to House Judiciary Committee for Further Action, Study...
UPDATE: Judiciary Committee 'Suprised' by Minority Move, Plans to 'Continue to Consider' Matter...

Wasn't able to follow things live, as David Swanson did, so still trying to unravel what specifically happened today on the floor of the U.S. House, where Rep. Dennis Kucinich (D-OH) used a "privileged resolution" to try and force a vote on his measure to begin Impeachment proceedings of Dick Cheney.

But as best as we can tell, and if we're reading this correctly, it seems the Republicans are playing a very interesting game of chicken here. From RAW:

Although the roll call vote had initially appeared to favor Hoyer's motion to table, Congressional Quarterly's Ed Epstein told CSPAN that Republicans had switched their votes at the last minute in an attempt to embarrass the Democratic leadership, who is not keen on seeing further action on the impeachment resolution.

"Midway through the vote, with instructions from the GOP leadership, Republicans one by one changed their votes from yes --- to kill the resolution --- to no, trying to force the chamber into a debate and an up-or-down vote on the proposal," reports the Washington Post.

And then from WaPo...

At one point there were 290 votes to table. After the turnaround, the final vote was 251-162 against tabling, with 165 Republicans voting against it.

Democrats countered by offering a motion to refer the proposal to the House Judiciary Committee for further study, effectively preventing a debate on the House floor. That motion passed by a largely party-line vote of 218-194.

So, in trying to summarize: While the Democratic House Leadership had initially tried to table Kucinich's resolution to Impeach Dick Cheney, the Republicans voted against that, presumably after making some sort of calculation (an incorrect one, in our opinion, but it's just our opinion) that a debate on whether he should be Impeached would somehow benefit Republicans. They would seem to share that calculation with the Democratic House leadership.

The effort to table discussion of the matter thus failed. But Hoyer's next attempt to dispatch with the measure (for the moment) was his call for a vote to send the matter to Committee for further consideration, instead of debating it on the floor of the House.

Which, if we've got our analytics correct here, means the ball gets tossed over to HJC Chairman, John Conyers for now...

UPDATE: Statement just in from a U.S. House Judiciary Committee spokeswoman, in response to the referal of the Impeachment resolution to the committee...

"The Committee has a very busy agenda - over the next two weeks, we hope to pass a FISA bill, to vote on contempt of Congress citations, pass legislation on prisoner re-entry, court security and a variety of other very important items. We were surprised that the minority was so ready to move forward with consideration of a matter of such complexity as impeaching the Vice President. The Chairman will discuss today's vote with the Committee members but it would seem evident that the committee staff should continue to consider, as a preliminary matter, the many abuses of this Administration, including the Vice President."

Tomorrow's NY Times features an article describing Rush Limbaugh as the "Latest Victim" in the "War of Condemnation" following his characterization of Iraq War vets calling for a pull-out as "phony soldiers." Limbaugh's comment was made to his 14 million or so listeners across America and on Armed Forces Radio.

In the last graf of the Times piece, discussing whether or not the U.S. House will vote on a resolution to condemn Limbaugh --- just as they voted to condemn MoveOn.org for asking whether Gen. Petraeus should better be described as "General Betray Us?" in a single Times ad (seen by millions, only due to the "Conservative" Media exploitation of it), Democratic House Majority Leader Steny Hoyer is quoted thusly:

“I think, frankly, I would like to see us restrain ourselves in condemning through resolutions all of that with which we disagree,” Mr. Hoyer said. “I have a zillion resolutions that I could think of pursuing that objective.”

Well gosh golly gee willickers, Mr. Hoyer. Shouldn't that have occurred to you before you allowed a vote on a resolution condemning MoveOn? A resolution, we should add, which you voted in favor of?!

P.S. Jane Hamsher is absolutely right. Limbaugh should be taken off of Armed Forces Radio immediately. What should be done with Hoyer is another question entirely.
