I don't necessarily care for the Affordable Care Act (ACA or "ObamaCare"), any more than any other non-disinformed, non-wingnut. Neither am I enough of a Constitutional expert to argue for or against its Constitutionality, which is currently being argued in front of the U.S. Supreme Court.

But over the last several days, on Twitter, I've been asking to hear from folks who have been negatively affected by "ObamaCare" personally, in any way whatsoever. Given the fits and tortured distortions and twisted outrages that Republicans have been pretending to throw over the law, and its individual mandate requiring those who do not already have health insurance to buy some, I'm sure there must be many personal horror stories to relate, right?

I've got a lot of wingnuts and Breitbots who follow me on the Twitters, and they are usually all too happy to take whatever shots they can at me or Obama or anything else they can imagineer, even if they have to make shit up to do it. But, in this case, not a one of 'em was able to point to a single instance of being negatively affected personally by "ObamaCare" in any way. Go figure.

There is, of course, a reason for that...

Democrats clearly feel they've got a potent campaign year issue in fighting back against what they've described, justifiably, as the "Republican Party's War on Women." In a fundraising email from Sen. Barbara Boxer's "PAC for a Change," the California Democrat writes:

My work is my words, and it is rare for me to admit that I need help expressing the depth of my feelings. But given recent events surrounding the vicious attacks on women's health in the Senate, in the House, and on the radio airwaves, I have turned to music to help me express why it is so crucial to elect more women who will stand up for our rights and for the respect we deserve.

The email includes a link to a music video meant to support her WinWithWomen2012.com campaign. The webpage for the campaign, described as "a Project of Barbara Boxer's PAC for Change," asks supporters to "Elect the most women Senate candidates in history," and highlights 11 different female Democratic U.S. Senate candidates who are set to be on this year's ballot.

The video, obviously, speaks for itself...

One unfortunate aspect of the firestorm surrounding Rush Limbaugh's profoundly uninformed, deceptive and misogynistic vitriol and calls for accountability for the Rightwing radio blowhard, is that it has completely overshadowed the substance of Fluke's testimony on the importance of access to prescription contraceptives to women's health.

The Limbaugh firestorm has also overshadowed the fact that the American Taliban (aka the elected Tea Party House Republicans) prevented Fluke from testifying at a House Oversight Committee hearing, framed by the Republican majority as a hearing on "religious freedom", because, as the Washington Post described, "she was not a member of the clergy."

Indeed, while much is made of the fact that the first panel at the 2/16/12 House Oversight Committee examining an issue vital to women's health was all-male, few have taken note that it was also all-clergy. In opening the hearing, Committee Chairman Darrell Issa (R-CA) announced: "Today, the committee will hear testimony from leaders of different faiths."

Not only did the right-wing GOP House leaders fail to so much as recognize Fluke's right to be heard, but, according to Minority Leader Nancy Pelosi (D-CA) (see video embedded in above-linked Washington Post article), they also refused to permit House Democrats to use the House Recording Studio as part of an effort to try and prevent the public from seeing and hearing Fluke's testimony at all. Instead, Pelosi and the Democrats of the Democratic Steering Committee were forced to hold a separate, unofficial "forum", in order to hear Fluke's testimony.

The video of Fluke's opening statement, the testimony that Republicans sought to prevent from being heard at all, is now posted below.

But it is the larger, arguably more disturbing constitutional ramifications of the actions of House Republicans that we'd like to take a moment to highlight on, as they have been almost entirely overlooked in this unnecessary brouhaha...

In light of GOP Presidential front-runner Newt Gingrich's recently revitalized attacks on the judiciary as, apparently, not yet extreme or activist enough for his tastes --- though he finds, like most of the other GOP candidates, Justices Roberts, Scalia, Thomas and Alito to be "pretty darn good" --- it's worth taking note of just some of the recent behavior, judicial temperament and fundamental principles of those far-Right extremist Supreme Court Justices he apparently does approve of.

To that end, the opening paragraph of a Nov. 14 Los Angeles Times article was disturbing but not surprising:

The day the Supreme Court gathered behind closed doors to consider the politically divisive question of whether it would hear a challenge to President Obama’s healthcare law, two of its justices, Antonin Scalia and Clarence Thomas, were feted at a dinner sponsored by the law firm that will argue the case before the high court.

While basic canons of judicial ethics suggest that judges should avoid even the appearance of impropriety, it remains exceedingly doubtful that the gathering of signatures on a Credo Action Petition will prompt either of these two "radicals in robes" to recuse themselves...

An October 9 Time Magazine poll revealed that 89% of Americans agree that Wall Street exerts too much influence on our political system; 79% feel the gap between rich and poor is too large; 71% feel the executives from the major financial institutions responsible for the 2008 economic meltdown should be prosecuted; and that only 6% of Americans identify themselves as "Tea Party" followers.

Previous MSM efforts to either ignore what amounts to a genuine democratic uprising or to disparage Occupy Wall Street by falsely claiming the movement has no goal have obviously fallen flat. Against that backdrop, the corporate-owned Los Angeles Times launched a desperate effort to deceptively depict the movement as a transient phenomenon which has had its say and should now fade away.

That effort was apparent in both an October 27 front-page news article in the LA Times, "Putting the move in Occupy movement", as well as a lead editorial in the October 28 paper.

Despite such efforts, neither the dire underlying conditions which have been brought on by history's greatest wealth disparity and the tyranny of the corporate security state, nor the people's desire to realize America's still-unfilled egalitarian democracy is likely to dissipate any time soon. As the Mavis Staples song says, "We shall not be moved!"...

Contrary to the Republican Party's recently launched, all-out War on the EPA, the 40-year old Environmental Protection Agency, founded during the Richard Nixon Administration with strong bi-partisan support, is a job creator, according to a newly released report by the Majority Staff of the U.S. Senate Environment and Public Works Committee.

Chaired by Sen. Barbara Boxer (D), the committee's 29-page report [PDF] touts "essential contributions that the Environmental Protection Agency (EPA) and landmark environmental laws" contribute towards "protecting public health and promoting economic growth."

It also highlights quotes from radical leftists like George W. Bush's Republican EPA Director, Christie Todd Whitman ("[I]t is easy to forget how far we have come in the past 40 years. We should take heart from all this progress and not, as some in Congress have suggested, seek to tear down the agency that the president and Congress created to protect America’s health and environment.") and President Gerald Ford ("Nothing is more essential to the life of every single American than clean air, pure food, and safe drinking water").

The Democrats' report excoriates the deceptive partisan attacks embodied in recently introduced GOP House legislation meant "to weaken EPA's authority to regulate toxic emissions," and concludes by underscoring the EPA's role in promoting both environmental and economic health in the nation...

Now, in the midst of this Los Angeles Times front-page headline, U.S. poverty totals hit a 50-year high, comes the loud “yes” (several, actually) from the audience at the CNN 'Tea Party' debate, applauding the prospect of simply letting those who can’t afford healthcare insurance die...

Ah, the 2012 election cycle is fast approaching. The Plutocrat (aka 'Republican') Party is in the process of garnering funds from far-right billionaires like the Koch brothers in order to present their usual "jobs, jobs, jobs" propaganda.

"Jobs, jobs, jobs" will come to us not only by way of paid-for political ads, but by way of corporate MSM "coverage" which will conveniently neglect to mention that the GOP-controlled House has not offered a single bill that would create a single job, or that the 2010 GOP "victories" have merely produced an all out assault on the middle-class including an effort to eliminate Medicare, an assault on the fundamental right to engage in collective bargaining, and drastic cuts in programs designed to protect the health, safety and economic well being of the vast majority of the American people at the same time they tirelessly strive to protect subsidies for the oil cartel and tax breaks for billionaires.

Against this backdrop, Robert Reich has come up with this two minute, fifteen second explanation of "What’s Wrong with the Economy..."

From Maggie Mahar at Health Beat...

You may have seen the  headline: “DIRE FORECAST SPARKS NEW MEDICARE DEBATE TRUSTEES' REPORT USED AS FODDER FOR POLITICAL SALVOS BY BOTH SIDES,” but the date may come as a surprise:  June 6, 1996.

At the time, the Chicago Tribune warned its readers: “Medicare trustees reported Wednesday that the program's financial outlook is getting worse, touching off a new round of debate over the future of the federal health insurance system for the elderly and disabled. According to the trustees, who give the program a fiscal checkup every year, the fund that pays Medicare hospital bills dipped into the red last year and will go broke in early 2001. That's a year earlier than they predicted in 1995.”

Sound familiar? How about these warnings:

Chicago Tribune July 2, 1969: “The Medicare hospital trust fund faces bankruptcy by 1976 and taxes must either be raised or benefits reduced the senate finance committee was told today.”

Washington Post, April 1, 1986: “The Medicare hospital insurance program faces bankruptcy by 1996, two years earlier than projected last year.”

New York Times, January 20, 1985: In the last few years, when it appeared that the Medicare trust fund would run out of money in 1987-89... But the need seemed less urgent after the Congressional Budget Office issued new estimates last September indicating that the Medicare trust fund would not go bankrupt until 1994.

(Hat tip to Chicago Tribune columnist Eric Zorn who culled eighteen stories from the Tribune, the Washington Post and the New York Times over a period of four decades, each predicting that the Medicare Hospital Insurance Fund was teetering on the brink of disaster.)

But of course Medicare didn’t “run out of money” in 1994, and it won’t go belly-up now, in large part thanks to health care reform legislation.  According to the Congressional Budget Office (CBO), the Affordable Care Act (ACA) raises and saves over $950 billion. (Below, I spell out how the legislation generates those dollars). In the process, as the Medicare Trustees’ Report 2011 points out, the ACA reduces Medicare spending “by 25 percent”—without cutting health benefits, or shifting costs to seniors.

Our thanks to Digby for pointing us to the above in her article this afternoon describing today's as usual right-leaning Meet the Press roundtable as "vapid" and "braindead" featuring just one of six panelists who "might not be called [conservative]," in a discussion "about the immediate deficit catastrophe" which, she believes, would likely cause "all elderly people [to be] extremely worried that they will be barred from going to the hospital next week because Medicare has gone belly up."

She goes on to quote samples of the "verbal compost" of today's roundtable discussion on NBC, adding "I don't think I've ever had the misfortune to see a bigger load of pompous Villager pap and GOP propaganda in one place."

Sanders introduces 'Medicare-for-All,' single-payer bill in Senate; Paul argues it would 'enslave' physicians...

With the backing of the AFL-CIO, National Nurses United, and the International Federation of Professional & Technical Engineers, Sen. Bernie Sanders (I-VT) and Rep. Jim McDermott (D-WA) simultaneously introduced the American Health Security Act of 2011, a Medicare-for-All single-payer system.

The move triggered a "provocative, interesting discussion," as Sanders described it, during a Health, Education, Labor, and Pensions subcommittee hearing in the Senate last week in which the Vermont Senator squared off with Sen. Rand Paul (R-KY) (see video below). Sanders and a physician-witness agreed that treating healthcare as a "right" is consistent with the Hippocratic Oath. For his part, Paul, a self-certified physician, claimed that the establishment of healthcare as a right would turn physicians and their staffs into slaves, with the possibility of police barging into their houses at night to arrest them. Paul's theory that medical care for all "enslaves" doctors and all of those who choose to work in their offices, would no doubt come as a surprise to many physicians who live comfortably in single-payer countries, like the wealthy UK physician interviewed by Michael Moore in Sicko!

Dr. Paul's remarks underscore the extent to which ideology has obscured a basic reality that the core problem is not the ability of American physicians to deliver quality healthcare, but the absurdity of a society which places a greater value on accumulating obscene wealth in the hands of the privileged few above the health and very lives of its citizens...
