Is the evil, that many cite as indicative of the 'failure' of the 'War on Drugs,' actually a perverse indices of its success?

Even a glimpse at the statistics leads knowledgeable sources, like Ethan Nadelmann, founder and executive director of the Drug Policy Alliance, to describe the 'War on Drugs' as a "failed prohibitionist policy."

"Over the last 40 years, more than 45 million drug-related arrests have cost an estimated $1 trillion," Amy Goodman reported on Democracy Now! "Yet drugs are cheaper, purer and more available today than ever."

And that's just in the U.S.

According to the United Nations' 2011 World Drug Report [PDF], "in 2009, between 149 and 272 million people...aged 15-64 used illicit substances at least once in the previous year." The UN estimated that Cannabis was "consumed by between 125 and 203 million people worldwide in 2009," adding:

Drug traffickers and organized criminals are forming transnational networks, sourcing drugs on one continent, trafficking them across another, and marketing them in a third. In some countries and regions, the value of the illicit drug trade far exceeds the size of the legitimate economy.

But Nadelmann's description of the 'War on Drugs' as a "failed prohibitionist policy" is derived from the supposition that the 'War on Drugs', at least here in the U.S., was actually formulated with a desire to suppress or eliminate drug abuse.

In PART 1 of this series, we examined the question of whether the U.S. Government's effort to challenge legalization of marijuana in California and elsewhere was akin to shutting down the competition, given the CIA's long-documented history of profiting from the world-wide drug trade. In PART 2 we posited that an end to the 'War on Drugs' could deliver a devastating blow to the bottom line of American corporations who have come to depend upon the Prison Industrial Complex in the U.S. and its huge pool of slave laborers --- most, non-violent drug offenders.

So now, we must examine the hypothesis that, if accurate, should rock us all to our core.

What if the horrific consequences of the worldwide drug trade, which, per the UN 2011 World Drug Report, includes an annual death toll of 200,000, are precisely what President Nixon and the covert branches of U.S. Empire had in mind when formulating a policy that would enhance the domination of the 1% over the 99%? Are we now living in a form of Aldus Huxley's Brave New World in which "Failure is Success" can be added to the three slogans from George Orwell's 1984 --- "War is Peace," "Freedom is Slavery" and "Ignorance is Strength" --- a world in which a vote against legalization is actually a vote in favor of illicit distribution by organized crime and their allies in the CIA?...

Tomorrow (Tuesday), there's yet another "make-or-break" set of Primaries for the GOP establishment's preferred front-runner Mitt Romney in both Arizona and his home-state of Michigan. While pre-election polls suggest Romney's the run-away favorite in AZ, he reportedly has only a marginal lead in MI. Should he lose that state tomorrow, his party, and their nomination process, could well descend into complete chaos (even more so than it already is.)

But here's the good news for Election Integrity fans keeping an eye on the race track for tomorrow's horse race: Both Arizona and Michigan allow all voters to vote on paper ballots at the polling place if they wish. So there's actually something to count that reflects the voters' intent.

The bad news: Rather than count those ballots, the states will run them through oft-failed, easily-manipulated optical-scan computer systems and report whatever it is that the computers announce as "the results."

While many Americans mistakenly place faith in these systems, a report in today's New York Daily News illustrates --- yet again --- how foolhardy that is. And this one is a doozy (yes, yet another one)...

My full story on this is at Salon today. But, here's the skinny.

It looks like Indiana's now-former Republican Sec. of State, Charlie White, who was found guilty of three voter fraud felonies and three other felonies early this month, has now been sentenced.

And it also looks like the old adage --- It's Okay If You're a Republican (IOKIYAR) --- continues to ring true in the Hoosier State. Despite being the top election official in the very first state in the union to institute disenfranchising polling place Photo ID restrictions, Charlie White has gotten off with a slap on the wrist, essentially, for three intentional voter fraud felonies, and the three others he was found guilty of as well.

His sentencing hearing was held last week. He pretended to be contrite before the judge (unlike when he appeared days earlier on Fox "News"), so it turns out he'll serve just one year in home detention for all of his crimes. The sentencing, naturally, has left him "elated."

The fates of other, less Republican, less high-ranking folks however, such as those who were prosecuted with the full force of the federal government during the George W. Bush Administration's unprecedented, if failed attempt to ferret out "voter fraud" crimes, were not quite as lucky. Unfortunately, they were used as fodder to help Republicans push for those polling place Photo ID laws (which would have failed to deter either them or White from committing voter fraud) by Bush's wholly politicized Dept. of Justice.

For folks like Wisconsin's Kimberly Prude and Florida's Usman Ali, to name just two examples of those who were caught in that buzz-saw, and who each committed far less egregious --- far far far less egregious --- crimes than those intentionally committed by White, the legal system was not nearly as kind.

Prude, who tried to rescind her own absentee vote before the 2004 election, immediately after learning from her probation officer that she was not allowed to vote --- despite never having served time in jail and being on felony probation for having passed a bad check four years earlier --- was forced to serve more than a year in prison. Ali, who never even voted at all, had it even worse. He was deported to Pakistan where he hadn't live in more than 10 years, destroying his life in this country for not just himself, but for his American wife and daughter as well.

Controversy over replacement of state's chief election official kicks off; Epidemic of high-profile GOP voter fraud continues...

The chief election official in the very first state in the nation to implement polling place Photo ID restrictions --- under the guise of preventing "voter fraud" --- has been found guilty of three counts of felony voter fraud today.

In an early morning verdict following 12 hours of deliberation, a jury in Hamilton County found Indiana's Republican Secretary of State Charlie White guilty of three counts of voter fraud related to having voted in a precinct where he did not live and where he was illegally registered to vote. The Hoosier State's controversial first-in-the-nation Photo ID restrictions, originally implemented in 2008, did nothing to prevent either White's illegal registration or his unlawful vote for himself as Secretary of State in 2010 when he was elected to office.

Of the seven criminal felony counts White had been charged with in March of 2011, the jury also found him guilty of three other Class D felonies related to perjury and theft, while clearing him of one Class C felony for fraud on a financial institution.

White has vowed to appeal the decision in hopes of lowering the convictions to misdemeanor charges, rather than felonies.

Under Indiana law, a felony conviction makes White ineligible to serve in state office and would create a vacancy to be filled by Republican Governor Mitch Daniels. However, even if today's felony charges are upheld, the fight over who will replace White as Indiana's chief election official is likely to continue for some time, since a separate recent ruling against him in a related civil case could take precedence over today's verdict.

Republicans are hoping Daniels will be allowed to name White's replacement, even though a judge last December ordered White immediately removed from office and replaced by his Democratic opponent from the 2010 election, after determining that White had been illegally on the ballot in the first place thanks to his improper registration.

White's conviction is the latest in what is shaping up as spate of voter fraud convictions, allegations, and investigations of high profile GOP officials, including allegations against several of the party's 2012 Presidential candidates...

The voting systems in use for the nation's first three all-important electoral contests in the 2012 primary --- from Iowa to New Hampshire to Saturday's South Carolina Primary --- go from pretty great to intolerably horrible. And then comes Florida, which deserves its very own special category, thereafter.

The "First-in-the-Nation" caucuses in Iowa allowed voters to vote on hand-marked paper ballots, counted by hand in front of the public at the caucus site, with results announced to everyone right then and there before being called in to GOP headquarters and before ballots were move anywhere. The wonderfully transparent system allowed for Republican voters by the Iowa GOP (which they hypocritically fight against allowing for everybody else in other states, and even in their own during general elections) is just about as close as we general get in this country to Democracy's Gold Standard. It's also what allowed reporting errors to be discovered and confirmed by the public after an election with some 122,000 votes counted transparently within an hour or so of polls closing, leading to almost nobody charging "fraud" even though just 34 votes are said to separate first and second place in the certified results of the impossibly, and historically, close election.

As of the "First-in-the-Nation" primary in New Hampshire, however, election transparency for voters and their ability to oversee their own elections began to disappear. While a lucky 10% of voters enjoyed hand-marked, publicly hand-counted paper ballots, the rest of the state's voters were allowed to vote on hand-marked paper ballots, but forced to tolerate secret tabulation on oft-failed, easily-manipulated Diebold optical-scan systems programmed by a company (LHS) with a history of criminal behavior and convictions. The results from those 90% of Granite State voters may have been tallied accurately by the Diebold op-scanners or, as seen in the disastrous 2008 Presidential Primary, not. Since NH doesn't bother to actually check to see if their machines tallied the hand-marked paper ballots correctly, we're unlikely to ever know if they did --- barring a recount request where, by then, the secure chain of custody of the paper ballots would be uncertain (to put it mildly.)

And now we come to the "First-in-the-South" Republican primary in South Carolina, where all evidence of how voters vote disappears entirely as the voters will be forced across the entire state to vote on easily-manipulated, oft-failed, 100% unverifiable touch-screen voting systems made by the nation's largest voting machine company, ES&S. When the machine-reported results are announced tomorrow night they will either be accurate or not. Either way, there will never be a way for anybody to know one way or the other as there will be nothing to prove how voters voted and nothing to "recount", even if anybody wanted to.

Appropriately enough, perhaps, Saturday's primary in the Palmetto State will offer 100% "faith-based" voting, since it will be scientifically impossible to prove that even a single vote for any candidate on the ballot has been recorded accurately by the ES&S iVotronic touch-screens as per any voter's intent. Known what we mean, Alvin Greene?...

For first time, compromised federal agency admits their previous certification was deeply flawed...

Not to say we told ya so, but, ya know, we've been telling you so for years (and years.)

A new finding by the U.S. Election Assistance Commission --- a rare finding, first of its kind, in fact, as the woeful EAC has never before taken the time to investigate and report on serious failures of e-voting systems that it has previously blessed with federal certification --- reveals that ES&S paper ballot optical-scan systems used in a bunch of large swing states, result in machines freezing during elections, failing to log system events correctly, and, perhaps most troubling, ballots being misread and votes being lost entirely.

The EAC's "Formal Investigation Report" follows on April 2010 revelations by the Cleveland Plain Dealer that some 10% of Cuyahoga County (Cleveland)'s EAC-certified ES&S Precinct Count Optical Scanner and Unity 3.2.0.0 tabulator voting systems failed in pre-election testing last year.

The paper ballot scanning computers were purchased as a replacement for the 100% unverifiable Diebold touch-screen systems used previously in Ohio's largest county, after a massive analysis of all of the state's e-voting systems, overseen by former Sec. of State Jennifer Brunner (D), revealed serious security issues and other major flaws in the touch-screen voting machines used there and in many other states.

Relatedly, Diebold's own paper ballot optical-scan system has similarly been found, in the past, to include a flaw which results in votes being lost entirely, though the EAC never issued a warning about that system, to our knowledge, even after it led to hundreds of votes going uncounted in at least one election in Northern California (and lord only knows how many elsewhere that the same system is used.)

The new findings of the failures of the ES&S op-scan system led Plain Dealer reporter/blogger Laura Johnston today to worry: "If the company can't correct the flaw, the government could decertify the machines --- leaving Cuyahoga and jurisdictions [throughout] the country no way to conduct elections in a presidential year."

Um, did the citizens of Cleveland lose their eyeballs? Or the ability to add 1 + 1 + 1, Ms. Johnston? Yes, there are other ways "to conduct elections in a presidential year." For example, one could simply count the ballots by hand in public, at the precinct, in front of all voters, all parties and video cameras, and report the results right then and there before the ballots are moved anywhere --- just as they still do in some 40% of the towns in the "First-in-the-Nation Primary" state of New Hampshire.

The flawed scanners manufactured by ES&S, the nation's largest e-voting vendor, are currently set to be used again in 2012, not only in Ohio, but also in Florida, Illinois, Indiana, Ohio, New York and Wisconsin, among others states...

It's most definitely turning out to be a "White Christmas" for Democrats in the Hoosier State this week!

Some remarkable news late today. Finding he was not eligible to be a candidate on the ballot in the November 2010 election, a Marion County Circuit judge has ordered Indiana's Republican Sec. of State Charlie White removed from office and replaced by his Democratic challenger Vop Isili, the second highest vote getter in that election.

The order comes as part of a civil suit brought by the state Democratic Party which has long charged, both before and ever since the election, that White was not eligible to be a candidate on the ballot.

Judge Louis Rosenberg's ruling today overturns a previous determination by the Republican-majority Indiana Recount Commission, which had initially dismissed the Dems contest, but then took it up again after being ordered to do so by the court. The Recount Commission --- on which White himself is a member, though he recused himself from this case --- had found in a unanimous 3-0 decision that White was eligible to serve. Today's decision overturns that Commission's ruling and is likely to be challenged at a higher court.

Separately, White still faces seven criminal felony charges, including three of them for voter fraud, related to the fact that he did not live at the address where he was registered to vote in the 2010 election. As he was not a properly registered Indiana voter, he was not eligible to be a candidate on the ballot, Rosenberg has ruled. Moreover, at the time of his election, White was a member of the Fishers Town Council --- a town in which he no longer lived since separating from his wife and moving out of her house, where he remained registered to vote, several years earlier. Democrats charge he retained his registration at the house so that he could continue to collect his salary as a Council Member.

Since divorcing his wife White had remarried and purchased a condominium in a different town, but claimed the reason he stayed registered at his former wife's house was because he had hoped to move back some day. The Indiana Recount Commission accepted that explanation. The Marion County Circuit judge, apparently, did not.

The stunning turn of events, along with additional bad news that White received earlier this week in his separate criminal case, where he is facing seven felony charges, all serves to highlight no small amount of irony in the Hoosier State, where the first polling place Photo ID restriction law to pass U.S. Supreme Court muster, under the disingenuous claim of fighting "voter fraud", has been used as a model for similar laws across the country ever since. The ruling, if it is not overturned on appeal, could also turn out to have very far reaching consequences on all Republican officials statewide...

The documentary premiered on AJE this week, and both starts and ends with the "Secret Koch Tapes" we exclusively published last month in a series of articles at Mother Jones and here at The BRAD BLOG.

There are a number of noteworthy points in this investigative look at the Kochs, co-owners of Koch Industries, the nation's second largest private corporation (the giant oil conglomerate inherited from their father), and how they are spending just some of the extraordinary $18 billion increase in personal wealth they've enjoyed over just the last three years under the tyranny of the Obama administration.

But among the interesting points revealed here, is the fact that this detailed exposé, a behind-the-scenes examination of two of the most powerful puppeteers behind American democracy, comes not from the far larger and better funded corporate news networks here in the U.S., but from from Al Jazeera. Go figure...

Last week we wrote about Venango County, PA's landmark independent forensic audit of their 100% unverifiable ES&S iVotronic touch-screen voting machines. The heavily-Republican county will be moving to paper ballots this November, as their systems are now being examined by computer scientists from Carnegie Mellon University following what Marybeth Kuznik of the non-partisan Election Integrity group VotePA.us described to us as "numerous reports of vote-flipping, candidates missing from screens, write-ins missing, and high undervote rates in their May 17 Primary."

In our coverage last week, we highlighted the comments of Venango's Republican Election Director Craig Adams who asked at a presser, as the examination finally got underway following months of legal wrangling and opposition, "What is a vote worth?"

"If the vote is counted it is priceless," he continued. "If it is not counted, I don't care what it costs. Let's get a right."

On Friday night, as I was guest hosting the nationally-syndicated Mike Malloy Show last week, Adams was kind enough to call in to the show. [Audio posted below.] We didn't know we'd hear from him, but when he called in I was delighted to take his call, as he had more information to share on what had led to his Election Board --- currently comprised of two Republicans and one Democrat --- fighting together to move to paper ballots, and to see their machines independently examined.

"It started with an election in 2008 when the machines were basically showing a large number of undervotes," he explained. "And then there were candidates for positions in the county and they had zero votes, but there was like 250 or 260 undervotes..."

"Wait a minute," I interrupted. "There were people who had zero votes on the ballot? Is that normal?," I asked.

"No. No, it is not normal," he responded bluntly. "And so, ya know, that was a red flag"...

Kuznik explained that the study comes in the wake of the heavily Republican-leaning county having experienced "numerous reports of vote-flipping, candidates missing from screens, write-ins missing, and high undervote rates in their May 17 Primary." Some candidates on the ballots even were reported by the voting machines to have received zero votes...

Sanders' question is indeed one of the "great" ones for our time. But, as Yoda said, "there is another."

If there was ever a candidate perfectly suited to expose the lie that is to be found in the pseudo-populism of the mega-billionaire Koch brothers funded and controlled 'Tea Party' that helped Scott Brown (R-MA) secure a reported upset win in the 2010 special election to fill the U.S. Senate seat vacated by the death of the late Edward "Ted" Kennedy (D-MA), it would be Elizabeth Warren, a Democrat.

The brilliant, straight-talking Harvard Law Professor and special adviser appointed by President Barack Obama to oversee the development of a new Consumer Financial Protection Bureau (CFPB), whose interview with Michael Moore for Capitalism: A Love Story (see video below) established her to be the same thorn in the side of Wall Street's financial "products" that Ralph Nader was to GM when he exposed the Corvair in Unsafe at Any Speed, announced last week that she is a 2012 candidate for the U.S. Senate seat now occupied by a GOP Senator who has turned to Wall Street, in a big way, for financial support.

There is little question but that Warren's brilliance, eloquence, and sincerity will come into play during the ensuing campaign. But while Warren plants her flag in the fight for oversight, transparency, and accountability for our financial system, will she (and other candidates) come to understand the importance of oversight, transparency, and accountability for our electoral system before it's too late? Before yet another election --- like the one which brought Brown to the Senate in the first place --- is decided under a cloud of unverified results reported by easily-hacked, oft-failed, optical-scan voting systems such as those made by Diebold and programmed by a company with a criminal background in the great commonwealth of Massachusetts?...

Yesterday, The Post & Courier of Charleston, South Carolina reported that a local "Council of Governments [COG] approved a resolution...asking for the state to audit how its voting machines are working."

The "machines" are the 100% unverifiable ES&S iVotronic touch-screen Direct Recording Electronic (DRE) voting systems.

The Post & Courier not only mentions the fact that state election officials insist that the "iVotronic machines reliably tally votes," but buys into the canard that "increased skepticism" is based upon [emphasis added] "human errors made during last year's elections." It adds that the COG resolution expressed "a concern [that the] voting machines...do not incorporate a 'paper trail' that could facilitate unequivocal confirmation of election results."

If there is any state in the nation that should realize that casting a vote on the ES&S iVotronic amounts to an exercise in blind-faith, with or without a so-called "Voter-Verifiable Paper Audit Trail" (VVPAT), it would be South Carolina...
