Narrow margin, 10,000 still-to-be-tallied absentee ballots to test L.A. County's Bowen-approved op-scan system, again

Yesterday, California's Republican-supported Prop 14 --- which voters approved last June, changing the state's separate party primary system to a single primary for all candidates, with the top two vote-getters going on to a run-off election if none receives more than 50% of the vote --- had its first official try-out in the Special Election to replace the resigning Blue Dog Democrat and unrepentant war supporter Rep. Jane Harman in the state's 36th Congressional District.

While similarly "Blue Dog" Democratic candidate and L.A. City Councilwoman Janice Hahn was in the lead last night as results were reported throughout the evening, it was the battle for second place, and therefore the right to participate in the run-off, that presented a real late-night nail-biter twist as unofficial precinct results were completed in the wee hours.

With Democratic CA Sec. of State Debra Bowen running second and seemingly headed for the run-off with Hahn for most of the night, according to L.A. County's running totals, the final unverified results inched self-financed Republican Craig Huey into the second place spot by just 206 votes at evening's end, after all 261 precincts in the very Democratic-leaning CA-36 were tallied.

With nearly 10,000 mail-in, provisional and other votes still to be tallied on the county's optical-scan system, however --- a system which was decertified and then conditionally re-certified, in part, by Bowen herself in 2008 --- the result of the cliff-hanger is likely to ensure "busy days ahead" at the L.A. County Registrar Recorder/County Clerk's office as Dean Logan, L.A. County's Registrar Recorder/County Clerk, noted last night on his personal Twitter account...

'Blue Dog' Harman tries in vain to distance herself from 'Big Pharma,' military-industrial complex...

No doubt, the last person eight-term "Blue Dog" Democrat Rep. Jane Harman (CA-36) expected to see when she sat down for a Progressive Caucus panel discussion on April 20 at the California Democratic Convention was the progressive Democratic challenger for her U.S. House seat, Marcy Winograd. In fact, Winograd wasn't even in the room when Harman began to speak.

Winograd explained:

I spoke, then left, then got a cell phone call: "Get back here. Jane Harman just arrived." I ran back downstairs, returned to the crowded room, and quietly sat down, unbeknownst to Jane, just three bodies down from her on the panel. I waited for her to finish her thought, then jumped in.

Winograd seized the moment to engage in a debate of sorts (video below), confronting the wealthy eight-term Congresswoman on a range of issues, including Harman's committee vote to significantly extend Big Pharma's patent protection over biomedical drugs. Harman's response was remarkably deceptive; yet, perhaps because this was not a pre-scheduled "debate," Winograd failed to seize a rare face-to-face moment to directly confront Harman's conflicts-of-interest and prevarication...

Winograd v. Harman race turns white hot over Winograd's call for peace through an Israel/Palestine 'one-state' solution...

Had Marcy Winograd simply chosen to denounce violence, both individual and state-based; had she objected to the oppressive nature of Iran's theocratic regime, or, during the 1980s, denounced a South African regime mired in racist apartheid, few would so much as raise an eyebrow.

Winograd's Feb. 15, 2008, speech, "Call For One State," delivered at the Friends of Sabeel Conference on behalf of L.A. Jews for Peace, however, was not merely directed against violence per se or against nations that permit a disparity in the rights of their citizens on the basis of race, ethnicity, or religion. She denounced all forms of violence, including "Israeli state terrorism"; asserted that Israel had rendered a two-state solution all but impossible, and said she favored a "one state solution" because you "cannot establish a democracy in a state founded on the institutionalized superiority or exclusivity of one of religion, ethnicity, or culture."

In doing so, the Progressive Democrats of America (PDA)-endorsed Winograd, now seeking to unseat a wealthy seven-term 'Blue Dog' Democrat, Jane Harman (D-CA36), touched what many see as a third rail in American politics.

The real question is whether American criticism of Israel should continue to be a political third rail or whether the courage to challenge "the bipartisan mainstream" consensus is long overdue...

Open letter from PDA details 'appalling record' of Democrat described by PDA-backed challenger as 'Joe Lieberman of the House'
Group seeks signatures in support of 'open letter' to Congresswoman, Co-Chair of Congressional Progressive Caucus...

As The BRAD BLOG reported over the weekend, an internecine firefight has blown up among progressives who support the candidacy of Marcy Winograd against entrenched "Blue Dog" Jane Harman (D-CA), and Rep. Lynn Woolsey (D-CA), long regarded as one of the more progressive members of the U.S. Congress.

Woolsey, the co-chair of the Congressional Progressive Caucus (CPC) and a longtime Advisory Board Member of Progressive Democrats of America (PDA), stunned progressives over the last several days when it was revealed that she was endorsing, and would be participating in a fundraiser for Harman next Saturday, January 16th, as noted in our report yesterday.

In the wake of Woolsey's curious support for the seven term Democrat, PDA is issuing an email blast to supporters tonight, asking them to sign on to an open letter (posted in full below) demanding Woolsey withdraw from the upcoming event, as well as drop her endorsement of Harman who will be challenged this year by Winograd, a longtime leader in PDA's Los Angeles chapter, and the first candidate of 2010 to be endorsed by the group. Winograd ran an unsuccessful challenge against Harman in 2006, but has begun her campaign earlier this year, and hopes to capitalize on growing progressive outrage at entrechned Congressional Democrats such as Harman. In a recent letter to supporters, Winograd described Harman as "the Joe Lieberman of the House."

In the open letter posted here, initially signed by Tim Carpenter, PDA's National Director, Mimi Kennedy and PDA's Advisory Board Chair, the group, describes the process signing the letter as "painful," but describes the negative response from members to the Woolsey endorsement of Harman, and asks for her to withdraw from the event immediately.

"The tone and emphasis of the responses vary, but the overwhelming gist is clear," Carpenter and Kennedy write to Woolsey, "The progressive base is upset about your scheduled involvement [in the January 16 fund-raising event] and hopes that you will withdraw from this event. As an organization, Progressive Democrats of America joins in that request."...

Several weeks ago, in "Winograd, Harman Race Heats Up Again," we noted that the looming 2010 primary contest between Harman, California's powerful eight-term Democratic U.S. Congresswoman and the progressive Winograd "presents a classic David and Goliath match up. With a net worth ranging between $236 million to $558 million, Harman, is said to be one of the richest members of Congress. Winograd, by contrast, is running a bottom-up progressive campaign of the type I advocated for recently in 'Progressives of America - Unite!'."

A little more than seven months after launching her second attempt to unseat California's powerful eight-term Democratic U.S. Congresswoman Jane Harman, the PDA-backed Marcy Winograd recently sent out a fundraising email in which she described Harman as the Joe Lieberman of the House.

In the campaign letter, Winograd notes Harman's claim in her 1998 election, as reported by the Los Angeles Times: "I was flattered to be introduced in the last election as the best Republican in the Democratic primary."

The Harman campaign did not respond to an email requesting comment on the quote above, though a spokesperson from the Winograd camp sent us a copy of the archived 1998 LA Times report on the Congresswoman's comments to "several hundred civic leaders" in downtown Los Angeles, containing her direct quote which ends with Harman adding: "I accept."

A Solution to the 'Progressive dilemma' in U.S. Electoral Politics...

There have been a few occasions during my 62 years when I heard something profound that stuck with me.

The year was 1969. I was attending a freshman college history class, shortly after returning from Vietnam, when my professor said:

If the American Right can be criticized for its insensitivity to the plight of the common man, the American Left can always be criticized for its inability to count.

His words came back to me as Brad Friedman and I simultaneously made guest appearances on Live from the Left Coast with Angie Coiro.

While the topic was Afghanistan, a concern emerged over the splintering of the Left as a product of what Coiro described as strident "rhetoric," such as the suggestion that President Obama was a "sell-out" or the announcement by Rep. Dennis Kucinich (D-OH) that he intended to introduce a privileged resolution to stop the "criminal enterprise" in Afghanistan. The concern was the potential for that "rhetoric" to adversely impact the Democratic Party in the 2010 and 2012 elections.

Unfortunately, in part due to technical difficulties they had on the show that night, I failed to adequately articulate my concerns, which go to the core of the Progressive dilemma in U.S. electoral politics....

House Labor and Education Committee Votes to Permit States to Adopt More Progressive Health Plans...

On Friday the House Labor and Education Committee voted 27 - 19 to adopt an amendment offered by Rep. Dennis Kucinich (D-OH) to HR 3200 [PDF], the hybrid "public option" health care legislation that leaves in place the current multi-payer system. The Kucinich amendment was supported by 13 of the Committee's Republicans. It was opposed by the Committee's chairman, George Miller (D-CA). If it survives a House floor vote and a House/Senate Conference Committee, the Kucinich amendment would insure that efforts to secure single-payer systems at the state level would not be preempted by federal law.

As explained by Donna Smith, co-chair of Progressive Democrats of America's "Healthcare NOT Warfare" campaign during a July 15, 2009 conference call [audio] amongst single-payer activists, the Kucinich amendment does not reflect an abandonment of the effort to enact the national single-payer system embodied in HR 676 [PDF]. As Smith sees it, the right to basic health care is a civil right, and like the earlier civil rights movement, its advocates must be flexible, yet relentless in pressing various strategies to put an end to what I described in "Single-Payer and the 'Democracy Deficit'" as a corrupt, dysfunctional and deadly system which places the obscene wealth of the few over the health and very lives of our citizens.

The Kucinich amendment would permit single-payer advocates in the U.S. to pursue the same strategy used in Canada where a single-payer system was first adopted at the province level, eventually placing pressure on Canada's federal government to adopt a national health care system.

This, by no means, suggests that HR 3200 comes even close to representing meaningful reform...

Progressive Marcy Winograd tells The BRAD BLOG why she plans to run against L.A.'s powerful U.S. Rep once again...

On October 20, 2005 Time magazine reported that when confronted with the prospect of an FBI investigation into whether she improperly enlisted the support of the American Israel Public Affairs Committee (AIPAC), Representative Jane Harman (D-CA) left a voicemail stating that any investigation of her would be "irresponsible, laughable and scurrilous."

Yet, as reported by Jeff Stein of CQ Politics on April 19, 2009, Harman “was overheard on a 2005 National Security Agency wiretap telling a suspected Israeli agent that she would lobby the Justice Department to reduce espionage-related charges against two former [AIPAC] officials. “In return, the Israeli agent pledged to help lobby for Harman to become chairwoman of the House Intelligence Committee,” Stein reported.

According to Tim Rutten in the LA Times on April 22, 2009, however, "Harman denies any inappropriate actions, let alone a quid pro quo, and Tuesday sent an angry letter to Atty. Gen. Eric H. Holder Jr. demanding that the full transcripts be released." Rutten, who described it as a "faux scandal," points out that Harman neither "intervened on behalf of the lobbyists" nor became chairwoman of the House Intelligence Committee.

Recently, Marcy Winograd, President of Progressive Democrats of Los Angeles (PDLA), whose 2006 campaign was covered by The BRAD BLOG, announced her intentions to challenge Harman again in the 2010 Democratic primary election. In an email response to our query asking about her intention to run again against Harman, against whom she lost in '06, and about some specific issues of interest to our readers, Winograd noted that she has been a champion of election integrity issues, taking on a Republican CA Secretary of State for his direct work with Diebold lobbyists, as well as challenging U.S. Rep Rush Holt (D-NJ) for his 2007 election reform bill because of "its institutionalization of electronic voting systems."

She also said she intends to hold President Obama "accountable, whether it be closing Guantanamo or ending military tribunals or promoting diplomacy over war," even as she notes that she was "alarmed" by the "recent news reports of Harman's quid pro quo with AIPAC," and writes: "I feel it is my responsibility to run [against Harman], to offer constituents a choice, a real choice."

I have been known to quote long-dead men in my past writings. Whether eloquently expressed thoughts by our founding fathers, or those artfully expressed by ancient Greek thinkers, these quotes have always done a better job starting or ending my thoughts - that tend to be expressed in long winding sentences. For this piece I am going to break with tradition and start with an appropriate quote from a living current senator, John Kerry: "It's a sad day when you have members of Congress who are literally criminals go undisciplined by their colleagues. No wonder people look at Washington and know this city is broken."

The people do indeed look at Washington and know that this city is 'badly' broken, Senator Kerry. The public confidence in our Congress has been declining drastically. Recent poll results highlight how the American people's trust in their Congress has hit rock bottom. A survey of progressive blogs easily confirms the rage rightfully directed at our Congress for abdicating its role of oversight and accountability. Activists scream about promised hearings that never took place - without explanation. They express outrage when investigations are dropped without any justification. And they genuinely wonder out loud why, especially after they helped secure a major victory for the Democrats. The same Democrats who had for years pointed fingers at their big bad Republican majority colleagues as the main impediment preventing them from fulfilling what was expected of them.

The recent stunning but not unexpected revelations regarding Jane Harman (D-CA) by the Congressional Quarterly provide us with a little glimpse into one of the main reasons behind the steady decline in the integrity of Congress. But the story is almost dead - ready to bite the dust, thanks to our mainstream media's insistence on burying 'real' issues or stories that delve deep into the causes of our nation's continuous downward slide. In this particular case, the 'thank you' should also be extended to certain blogosphere propagandists who, blinded by their partisanship, myopic in their assessments, and ignorant in their knowledge of the inner workings of our late Congress and intelligence agencies, helped in the post-burial cremation of this case.

Ironically but understandably, the Harman case has become one of rare unequivocal bipartisanship, when no one from either side of the partisan aisle utters a word. How many House or Senate Republicans have you heard screaming, or even better, calling for an investigation? The right wing remains silent. Some may have their hand, directly or indirectly, in the same AIPAC cookie jar. Others may still feel the heavy baggage of their own party's tainted colleagues; after all, they have had their share of Abramoffs, Hasterts and the like, silently lurking in the background, albeit dimmer every day. Some on the left, after an initial silence that easily could have been mistaken for shock, are jumping from one foot to the other, like a cat on a hot tin roof, making one excuse after another; playing the 'victims of Executive Branch eavesdropping' card, the same very 'evil doing' they happened to support vehemently. Some have been dialing their trusted guardian angels within the mainstream media and certain fairly visible alternative outlets. They need no longer worry, since these guardian angels seem to have blacked out the story, and have done so without the apparent need for much arm twisting...
