As a disillusioned conservative, what I wouldn't give to have someone who could make logical, fact-based arguments from the right. How interesting would it be to have someone just as intellectually skilled as MSNBC's Chris Hayes, just as sharp as him, just as devoted to sound logic as him-but coming from the opposite perspective?

Where the hell are the public intellectuals on the right, anyway? It used to bug me that Fox "News" Channel would promote Bill O'Reilly and Sean Hannity as the main faces of their network. I never had the sense that O'Reilly was actually a conservative, merely someone who knew that repeating conservative memes over and over again would be lucrative. As for Hannity, he lost me back in 2001 when I tuned into his radio show and heard him declare that he would condemn his kid if he decided to get an earring. What is this, I thought to myself, 1978?

One can debate when the right stopped investing in its intellectual infrastructure, but one cannot debate the reality of this phenomenon. Oh, wait --- the right debates the reality of certain phenomena all the time. Look at global warming, for just a start...

Right to same sex marriage in CA stayed pending filing of a petition to the U.S. Supreme Court...

The U.S. 9th Circuit Court of Appeal issued a terse decision denying a petition for rehearing of the earlier 2-1 9th Circuit panel decision in Perry vs. Brown [PDF] in which the majority ruled that CA Proposition 8's effort to strip away the previously recognized right of same sex couples to marry was unconstitutional.

The court order noted: "The matter failed to receive a majority of the votes of non-recused active judges in favor of en banc consideration." (En banc essentially means 'by the full 9th Circuit', as opposed to a three judge panel.)

The order added, however: "The mandate is stayed for ninety days pending the filing of a petition for writ of certiorari in the Supreme Court. If such a petition is filed, the stay shall continue until final disposition by the Supreme Court."

This essentially means that, despite the determination that Prop 8 is unconstitutional, same sex couples in CA cannot effectuate their right to marry until either 90 days have lapsed, or longer if a Supreme Court challenge is filed.

As The BRAD BLOG previously averred, U.S. 9th Circuit Judge Stephen Reinhardt's earlier majority opinion in this case was "so narrow and so tightly crafted to meet the criteria of a 1996 U.S. Supreme Court decision, Romer v. Evans, that it minimized the chances that the U.S. Supreme Court will decide to hear the case, let alone reverse the decision."

Had a jammed-packed BradCast on KPFK/Pacifica Radio today.

We led off with the breaking news of Obama finally seeing the light on marriage equality.

Then I was joined by Sacramento, CA Registrar of Voters Jill Lavine to discuss the thousands of fraudulent voter registration forms turned in by the GOP-hired firmed Momentum Political Services, as we detailed late last week. Lavine tells me that she's confident that in her nine years as Registrar, there has been no in-person impersonation at the polling place, despite the continuing pattern of GOP voter registration fraud in the state and the Republican push to disenfranchise (largely Democratic) voters by claiming, disingenuously, that polling place Photo ID restrictions have anything to do with "voter fraud".

We then enjoyed a quick visit with the lovely Desi Doyen from the Green News Report, fresh off her guest-hosting gig this afternoon on The Young Turks (I'll try to post that video soon!)

Finally, since it's called The BradCast, I was joined by Brad Jacobson to discuss his terrifying new report at Alternet on the "ticking time-bomb" that is the precarious Spent Fuel Pool --- now fully exposed, 100 feet off the ground in a listing building --- at Fukushima Daiichi's reactor #4. His report should scare the hell out of you. It certainly does me. And the scariest part: It's being covered by virtually nobody in the mainstream corporate media. I guess that's what The BradCast is for.

Pretty big news here. Barack Obama has finally decided to do the right thing by standing up for marriage equality directly. While it took long enough, he now has the distinction of being the first President in the history of the U.S. to do so. This is also another reminder that politicians don't lead, they follow. You lead. So keep up the good work!

Getting ready for my KPFK/Pacifica Show today, so no time for more commentary at the moment. Here's ABC, who broke the news within the hour. Here's TPM's take. And here's the video clip of the President this afternoon acknowledging: "I’ve just concluded that for me personally it is important for me to go ahead and affirm that I think same sex couples should be able to get married"...

I have to tell you that over the course of several years as I have talked to friends and family and neighbors when I think about members of my own staff who are in incredibly committed monogamous relationships, same-sex relationships, who are raising kids together, when I think about those soldiers or airmen or marines or sailors who are out there fighting on my behalf and yet feel constrained, even now that Don’t Ask Don’t Tell is gone, because they are not able to commit themselves in a marriage, at a certain point I’ve just concluded that for me personally it is important for me to go ahead and affirm that I think same sex couples should be able to get married.

Rights will always win. It takes time. But they will always, eventually win.

On Tuesday, a divided three judge panel of the U.S. 9th Circuit Court of Appeal ruled that California's Proposition 8 ban on same-sex marriage --- a right that had otherwise previously existed for same sex couples in the state --- violates the Equal Protection Clause of the 14th Amendment of the U.S. Constitution.

The majority opinion in Perry vs. Brown [PDF] this week decided an issue that was so narrow and so tightly crafted to meet the criteria of a 1996 U.S. Supreme Court decision, Romer v. Evans, that it minimized the chances that the U.S. Supreme Court will decide to hear the case, let alone reverse the decision.

As we examine the future course of the Prop 8 litigation, it's appropriate, if only briefly --- while this particular issue remains far away in the rear view mirror --- to offer a reminder of the still unresolved question as to whether CA voters actually approved the controversial measure at the ballot box in the first place...

Missed this late last week, but it's still well-worth flagging here...particularly for all of the pretend "conservatives" who visit this blog.

Here's UK Prime Minister David Cameron speaking at last week's annual Conservative Party conference in Manchester [hat-tip Towleroad]...

"I once stood before a Conservative conference and said it shouldn't matter whether commitment was between a man and a woman, a woman and a woman, or a man and another man. You applauded me for that. Five years on, we're consulting on legalising gay marriage. And to anyone who has reservations, I say: Yes, it's about equality, but it's also about something else: commitment. Conservatives believe in the ties that bind us; that society is stronger when we make vows to each other and support each other. So I don't support gay marriage despite being a Conservative. I support gay marriage because I'm a Conservative."

So, again, with the vast majority of self-identified "conservatives" in the U.S. not actually conservative at all, and most "liberals" not particularly liberal, we know why Rightwing media love to use those completely misleading labels, but what's the pathetic excuse for the rest of the media doing so?

Moments ago, the New York state Senate approved a marriage equality bill by a vote of 33 to 29. The legislation, previously approved in the state Assembly, will result in NY becoming the sixth state where same-sex marriage is allowed.

After Democratic Gov. Andrew Cuomo signs the bill, as expected, New York will join Massachusetts, Iowa, New Hampshire, Vermont, Connecticut and Washington D.C. in recognizing equal justice for all, as per the U.S. Constitution, in regard to marriage.

The right to marry was confirmed by conservative Supreme Courts in both California and Maine, but in each state, ballot initiatives were passed in hopes of nullifying that right. California's Prop 8, a state constitutional amendment banning equal marriage rights, has since been found unconstitutional in federal court, and is likely to be decided, eventually, in the U.S. Supreme Court.

NY's state Senate is the first legislative body with a Republican-majority to approve a bill for marriage equality.

The victory for real conservatives will result in a doubling of the number of Americans guaranteed equal marriage rights under the law.

And, once again, as a service to fake conservatives --- such as those who oppose equal rights for gay, fellow citizens, to marry each other --- a reminder: Even once this bill is signed into law, gay marriage will remain optional, not mandatory, in the state of New York.

UPDATE 9:18pm PT: Via AP...

ALBANY, N.Y. — Gov. Andrew Cuomo has signed New York's gay marriage bill, starting what is expected to be a crush of gay weddings starting in 30 days.

The Democratic governor signed the measure shortly before midnight Friday, following up on a promise to put his name on the legislation as soon as he received it rather than wait the usual 10 days to sign it for it to become law.

...And the Empire State Building is lit in rainbow colors in celebration.

As horrible as things seem right now --- with sociopathic loons on one side of the aisle, cowardly failures on the other, a mainstream corporate media completely out of touch with virtually everything that matters, an economy in which everyone but the rich are gasping for air --- there is one very bright spot on which we can all take great comfort.

Rights win.

It rarely happens immediately, and almost never without a far-too-long struggle, but rights for we, the people, almost always eventually win in this nation --- usually against all odds, avarice, greed and ignorance --- but our Constitution is brilliant enough that rights eventually win out.

If you have any doubt, look no further than the latest news (video posted below) heralding the last dying gasps of institutionalized homophobia in our laws and in our military.

The good news is: the haters have lost. The question which played such an enormous --- if entirely trumped up --- role in our Presidential elections just 6 years ago has been all but finally settled.

Well before the end of this decade (and likely far sooner than that, perhaps even before the end of Obama's first term in office), marriage equality for gays and lesbians will be recognized in every state in the union, and homosexuals will be as welcome in our nation's military as African-Americans.

It's over. The good guys have won. In these quiet victories of rights over wrongs, we can all take some quiet comfort, even in these maddening, ugly days...

Federal Judge Finds Act Violates First Amendment Rights of U.S. Service Members...

In her Sept. 9 decision [PDF] in Log Cabin Republicans vs. United States, U.S. District Court Judge Virginia A. Phillips, a 1995 Clinton appointee, determined that "Don't Ask, Don't Tell" (D.A.D.T) is unconstitutional as it violates First Amendment rights even within the more restrictive confines of military speech.

The court rejected the government's argument that Log Cabin Republicans lacked standing to initiate the action, noting that at least one member of the group, John Nicholson, was discharged from the armed forces because of "Don’t Ask, Don’t Tell.” It expressly found that D.A.D.T "does not significantly further the government’s interest in military readiness or unit cohesion," and directed plaintiff's counsel to prepare a "Proposed Judgment, including a Permanent Injunction" by no later than Sept. 16.

Whether the Eric Holder Justice Department will appeal, despite President Obama's pledge to seek a repeal of D.A.D.T., is an open question...

Californians have been drawn within the cross-hairs of a propaganda blitz bought and paid for by Meg Whitman, the billionaire former CEO of eBay, who, since declaring her intent to run for governor in February, 2009, has already contributed $59 million of her own money to her "campaign" --- a one-sided political phenomenon which has seen a stealth candidate, with disturbing connections to Goldman Sachs, soar to the top of the polls because the electoral process has been emasculated by the absence of mandatory debates and meaningful investigative journalism.

Apparently Whitman now feels that campaigning exclusively by way of paid-for propaganda (political ads) will not be enough to evade scrutiny of her economic "plan" to "rescue" California's economy (a rehash of Bush tax cuts for wealthy people and business, the elimination of climate change regulations and imposition of further draconian spending cuts to a state government already operating on life support --- a plan which a group of economists, including Stanford University's Kenneth Arrow, a Nobel laureate, have derided as policies which would "deepen California's budget crisis and are likely to reduce employment and economic growth").

Whitman has now pandered to what she may mistakenly believe was a majority of Californians who voted against marriage equality in passing Proposition 8...
