The voting systems in use for the nation's first three all-important electoral contests in the 2012 primary --- from Iowa to New Hampshire to Saturday's South Carolina Primary --- go from pretty great to intolerably horrible. And then comes Florida, which deserves its very own special category, thereafter.

The "First-in-the-Nation" caucuses in Iowa allowed voters to vote on hand-marked paper ballots, counted by hand in front of the public at the caucus site, with results announced to everyone right then and there before being called in to GOP headquarters and before ballots were move anywhere. The wonderfully transparent system allowed for Republican voters by the Iowa GOP (which they hypocritically fight against allowing for everybody else in other states, and even in their own during general elections) is just about as close as we general get in this country to Democracy's Gold Standard. It's also what allowed reporting errors to be discovered and confirmed by the public after an election with some 122,000 votes counted transparently within an hour or so of polls closing, leading to almost nobody charging "fraud" even though just 34 votes are said to separate first and second place in the certified results of the impossibly, and historically, close election.

As of the "First-in-the-Nation" primary in New Hampshire, however, election transparency for voters and their ability to oversee their own elections began to disappear. While a lucky 10% of voters enjoyed hand-marked, publicly hand-counted paper ballots, the rest of the state's voters were allowed to vote on hand-marked paper ballots, but forced to tolerate secret tabulation on oft-failed, easily-manipulated Diebold optical-scan systems programmed by a company (LHS) with a history of criminal behavior and convictions. The results from those 90% of Granite State voters may have been tallied accurately by the Diebold op-scanners or, as seen in the disastrous 2008 Presidential Primary, not. Since NH doesn't bother to actually check to see if their machines tallied the hand-marked paper ballots correctly, we're unlikely to ever know if they did --- barring a recount request where, by then, the secure chain of custody of the paper ballots would be uncertain (to put it mildly.)

And now we come to the "First-in-the-South" Republican primary in South Carolina, where all evidence of how voters vote disappears entirely as the voters will be forced across the entire state to vote on easily-manipulated, oft-failed, 100% unverifiable touch-screen voting systems made by the nation's largest voting machine company, ES&S. When the machine-reported results are announced tomorrow night they will either be accurate or not. Either way, there will never be a way for anybody to know one way or the other as there will be nothing to prove how voters voted and nothing to "recount", even if anybody wanted to.

Appropriately enough, perhaps, Saturday's primary in the Palmetto State will offer 100% "faith-based" voting, since it will be scientifically impossible to prove that even a single vote for any candidate on the ballot has been recorded accurately by the ES&S iVotronic touch-screens as per any voter's intent. Known what we mean, Alvin Greene?...

"What is a vote worth?" Venango County, PA's Election Board Chairman Craig Adams, a Republican, asked last week. "If the vote is counted it is priceless. If it is not counted, I don't care what it costs. Let's get a right."

"After months of legal wrangling," Marybeth Kuznik of the non-partisan Election Integrity advocacy group VotePA told The BRAD BLOG last week, Venango County's landmark independent forensic examination of the notoriously unreliable and 100% unverifiable ES&S iVotronic Direct Recording Electronic (DRE, most often touch-screen) e-voting system finally got under way.

Kuznik explained that the study comes in the wake of the heavily Republican-leaning county having experienced "numerous reports of vote-flipping, candidates missing from screens, write-ins missing, and high undervote rates in their May 17 Primary." Some candidates on the ballots even were reported by the voting machines to have received zero votes...

It is now officially impossible to know whether thousands of paper ballots being counted in the state of Wisconsin's Supreme Court election "recount" are the same ones actually cast on Election Day. It didn't have to be that way, unlike in Kentucky, where the voters never had a chance, and where high-ranking election officials have now been sentenced to more than 150 years in federal jail following "decades" of manipulated elections.

Thanks to serious chain of custody violations in Wisconsin --- such as ballot bags discovered to have been left "wide open" and unsealed in Waukesha County, and ballots left completely unsecured for weeks in the office of the Verona City Clerk in Dane County --- that now make it quite likely the real winner of the April 5th election for a 10-year term on the bench of that state's highest court will never be known for certain. That, even though thousands of votes have now been verified as having been miscounted during the state's partial hand-count, and even as the hotly-contested seat in question will determine the ideological balance of the court during one of the most contentious moments in Badger State history.

The majority of voters in Wisconsin cast their votes on hand-marked paper ballots. However, due to a failure to count those ballots publicly on Election Night, at the precinct, in front of the public (as per "Democracy's Gold Standard"), citizens are left guessing and forced to place misguided trust in partisan election officials like GOP activist and Waukesha County Clerk Kathy Nickolaus and her unsecure chain of custody and election reporting procedures.

With results that will never be known for certain, the razor-thin contest has now become a fully "faith-based election," in contradiction to the checks and balances necessary for true self-governance.

But where Wisconsin could have had an overseeable and fully verifiable election in which voters might have had confidence, voters in Kentucky, for years, never even had a chance as they were forced to vote on 100% unverifiable touch-screen voting machines.

The good-ish news? That is changing, as much of the Bluegrass State is finally turning to the use of hand-marked paper ballots, though they plan on tallying them similarly to Wisconsin, via oft-failed, easily-manipulated optical-scan systems manufactured by private vendors, rather than counting them transparently in front of the public.

Given Kentucky's recent history, that's a particularly troubling prospect, as underscored by several developments in two different counties in the state of late.

In 2009, a spate of high-ranking election officials in Clay County, KY --- including the County Clerk, a Circuit Court Judge, the School Superintendent, a former Magistrate, and several polling place officials --- were arrested in a massive vote buying/selling and electronic vote-machine rigging conspiracy which netted the criminals millions of dollars over the past decade. The federal charges included the County Clerk and other members of the Board of Elections having intentionally falsified election reports to include inaccurate voting results when submitted to the state.

One Republican election official pleaded guilty after the arrest two years ago, and the other eight were found guilty and convicted last year in federal court. They were sentenced this past March to a total of more than 1,871 months in federal prison.

And last week, in a separate, newly developing case, state officials impounded electronic voting machines in Perry County, KY, after Republican candidates in last November's election complained of "vote rigging" on the county's 100% unverifiable electronic voting machines...

When it comes to elections, it seems there are no rules, laws, morals, or ethical boundaries which Republicans aren't willing to happily violate in order to be "victorious."

Our latest two examples:

  • Over at Daily Kos today, a commenter has been outed as a "concern troll" hoping to deflate progressive support for KY's Democratic U.S. Senate candidate Jack Conway, while serving on the payroll of Republican candidate Rand Paul.

So what wouldn't these guys do to ensure a "victory"? Stay classy, GOP. The founders would be very proud!

It is vital that the American people come to appreciate the danger to liberty as well as community posed by doctrinaire libertarianism.

Despite widespread coverage of Rand Paul's absurd criticism of the provisions of the 1964 Civil Rights Act as applied to private businesses, there has been a dearth of analysis as to how this absurdity was brought about by the serious intellectual deficiencies in doctrinaire libertarian philosophy; a philosophy which led to a second astounding Rand Paul remark.

In the face of horrendous safety records on the part of both Massey Energy, which had been found to have violated federal safety regulations thousands of times over the past several years, and BP, which had steadfastly fought off safety measures for deep water oil rigs, Rand summarily dismissed the significance of both the deadly West Virginia mine disaster and the deadly explosion at BP's deep water facility that has produced the worst oil spill in U.S. history with the cavalier, "accidents happen."

What Rand Paul has done is open a window into "libertarianism," which, contrary to the current Wikipedia definition, does not merge into "anarchism." The principle distinction arises because, as explained by Noam Chomsky, anarchism challenges not only authoritarian government but all authoritarian societal structures, including the work place.

Libertarians like Ron and Rand Paul focus exclusively on individual liberty vis-a-vis the government. They fail to appreciate that, especially in the 21st Century, the removal of government as a check against unfettered corporate wealth and power leads to "the tyranny of a corporate controlled economy"...

BTW, for those who had been paying attention, I predicted all of this Rand Paul fun earlier in the week, when I wrote in my "Super-ish Tuesday Backgrounder" on Monday:

The "Tea Party," however, may be in for a surprise should Paul win tomorrow and then in November, as he is an actual conservative candidate --- now otherwise known as a libertarian --- meaning he, like his father, calls for removing government entirely from all but those functions called for directly in the Constitution. For example, he supports an immediate pull out of U.S. troops from both Iraq and Afghanistan, an idea that, in truth, is largely anathema to the bulk of the grossly disinformed "Tea Baggers"/GOP base (versus the true "Tea Partiers" who first emerged in 2006 in support of Ron Paul, against George W. Bush, and who were consequently marginalized as wackos back then by the bulk of the GOP and its Bush-lovin' base.)

I just didn't think it was gonna happen on the Wednesday after his Tuesday election! :-)

Democratic turnout far outpaces Republican...

Setting aside the unverified (and, in many cases, unverifiable) results of yesterday's elections for the moment, what caught my eye throughout the night were the turnout numbers, Democratic compared to Republican.

While the reported results of the races ran largely counter (surprise!) to the "GOP/TeaParty-fueled Massacre Slated for November!" meme that the corporate beltway media and related villagers have been endlessly re-enforcing with zombie-like precision over the last several weeks and months, the turnout of actual voters in the marquee state-wide primaries (races that we detailed, along with the e-voting systems in use, in our Super-ish Tuesday Backgrounder on Monday) seem to be of note when considering what November might actually look like when all is said and done.

I'd caution not to take too much from these numbers as there are various mitigating factors that could be used to explain them --- or even explain them away --- as noted below, but I think the numbers themselves are very much worth noting here, as I haven't seen much coverage of this over the last 12 hours or so...

It's been an ugly day at the polls in Kentucky, at least between supporters of the two highest profile candidates on the ballot today, in what's become a highly contentious race. Allegations of vote buying and intimidation have been coming out all morning in county after county.

Nate Hodsen, the campaign manager for Grayson (who is responsible for overseeing his own election as the state's chief election official) released a statement to say: "This despicable behavior should not be tolerated. Bullying and intimidation should have no place in our elections. Rand Paul needs to rein in his goon squad and follow the law."

David Adams, the campaign manager for Paul (the son of TX U.S. House Rep. Ron Paul) responded in kind to call the allegations "ridiculous" and "much ado about nothing," before going on to blame them on Democrats somehow. "We had a tip over the weekend that some of our volunteer activities have been infiltrated by (national) Democratic operatives planning to cause problems," he told reporters.

Tuesday's election are being called "Super Tuesday" by some in the media hoping to hype the four-state Election Day as a bellwether for the "anti-incumbency fever" predicted by the same media for this November.

But beyond the marquee races in each of the states holding elections tomorrow --- Kentucky, Pennsylvania, Pennsylvania, Oregon (and Hawaii is currently holding an all-mail special election which ends on Saturday) --- as usual, we'll be keeping our eyes on whether voters are actually able to cast their votes, and whether or not those votes are actually counted and counted accurately.

The mix of states holding elections tomorrow also offer a mix of electoral systems --- from a majority of voters using 100% unverifiable touch-screen machines in use in KY and PA, to a compilation of touch-screen and paper ballot systems run by a company with a disastrous reliability record in AR, to the black hole of all mail-in voting in OR (and in HI).

Remember, whatever happens or gets reported (or doesn't) on Tuesday, it's often the case that concerns about failures in the system don't necessarily become immediately apparent on Election Day itself. Sometimes problems in the system and in the tallies do not begin to emerge until days, weeks, and sometimes even months after Election Day. So whatever we see in the surface reports tomorrow, for good or bad (and, as usual, you can count on various reports of "glitches," "hiccups," "snags," and "snafus" which use those words to marginalize problems, instead of the correct word: "failures") may just be the tip of any electoral icebergs beneath the surface. As usual, eternal vigilance by the citizenry is the hallmark of the ongoing fight for electoral integrity and transparency in these United States.

After all these years, not much has changed for the denialist jurisdictions that still insult their voters by using 100% unverifiable electronic voting machines.

Pittsburgh's WTAE filed a report last week with a ring of exhausting familiarity --- at least to long time readers of The BRAD BLOG. This one stars, as usual, both an open, unsecured door to the warehouse, and an election official --- in this case, Allegheny County Pennsylvania's Election Division manager, Mark Wolosik --- claiming he's "seen" no problems before, so everything is just dandy, nothing to worry about when it comes to his support of the use of 100% unverifiable electronic voting systems by his county's voters...

Legal action NOW may help to prevent surprises later...

Rand Paul, son of Rep. Ron Paul (R-TX) is running for the GOP nomination for U.S. Senator to replace the retiring Sen. Jim Bunning in the state of Kentucky. Paul, who has been endorsed by the likes of Sarah Palin, is running against Republican Party insider, KY Sec. of State Trey Grayson, who has been endorsed by the likes of Dick Cheney. Primary Election Day is set for May 18th.

Grayson's disturbing history of misrepresenting the truth in regard to certification of the state's electronic voting systems should be of great concern to Paul and his supporters, particularly given the state's rich history of confirmed election fraud by election insiders --- which includes tampering with e-voting systems to change voters votes --- and the fact that much of the state still uses electronic voting systems which are 100% unverifiable in any way, shape or form.

Of equal concern are the hand-marked paper ballot systems used in other parts of the state. Those electronic systems are also at risk to both simple, nearly undetectable manipulation by insiders as well as tallying errors, and have been found to feature serious security flaws highlighted in the past by the state's own former Republican AG. Even admissions by one of the voting machine companies, Diebold, that systems in use in the state did not meet certification requirements, were largely dismissed, and all but ignored for years by Grayson, the state's chief election official who will be overseeing his own election against Paul in May...

Mixing it up with, and calling out the mainstream media...

I had the pleasure to appear on San Francisco public radio's "Friday Media Roundtable" on their Your Call program today (heard on KALW in San Francisco and KUSP in Santa Cruz).

Along with the NYT's massive ACORN "Pimp" Hoax fail, we also discussed and critiqued media coverage of healthcare insurance reform, the latest in the U.S./Israel diplomacy theatrics, and even a bit on the guilty verdict for Kentucky election officials yesterday. Joining me on today's panel, along with host Sandip Roy, were Alex Wayne of Congressional Quarterly and Sherine Tadros of Al Jazeera English.

The audio is posted below, and I believe it's well-worth giving a listen to --- particularly in regard the direct disagreement that Wayne and I got into over the media's failure (as I see it, though he didn't), to have covered the substance of healthcare insurance legislation, while devoting an inordinate amount of coverage to the politics of that debate instead.

Convicted high-ranking officials include a circuit court judge, county clerk and school superintendent
Each face up to 20 years in broad conspiracy that included manipulation of electronic voting machines...

All eight defendants in Clay County, Kentucky's election fraud trial have been found guilty today by a federal jury. Six of those eight were high-ranking election officials, including the county clerk, a circuit judge and the school superintendent. The conspirators were charged with having manipulated federal elections in 2002, 2004 and 2006 by buying and selling votes and manipulating electronic voting machines.

According to AP, each of the now-convicted felons could face up to 20 years in prison for what prosecutors had described as a conspiracy to manipulate elections for decades in the rural, heavily Republican county.

In additional to federal racketeering, several of the defendants were also convicted of charges that included mail fraud, extortion and laundering money used to buy votes.

The BRAD BLOG has been following this story since the conspirators were originally arrested in March of last year, and as details of the election officials' manipulation of ES&S iVotronic touch-screen voting machines has emerged...

Republican official says she was asked to change party affiliation to serve as 'Democratic' precinct official...

Meanwhile, back in Clay County, Kentucky, where election officials (including the county clerk, a district court judge, and the school superintendent) were arrested last year, and are now on trial, accused of having "fix[ed] elections for decades," a "precinct worker testified...that top election officers in the county taught her how to change people's choices on voting machines to steal votes in the May 2006 primary." The vote stealing was accomplished on ES&S touch-screen electronic voting machines, without the knowledge of legitimate voters, after they'd left the booth thinking they had cast their votes.

The scheme also included Republicans changing their party registration to Democratic in order to serve as Democratic poll judges and officers on Election Day, as has been alleged elsewhere (for example, in Ohio in 2004)...
