Russian Television's English language satellite broadcast channel, RT, tracked me down on the road to comment on George W. Bush's speech yesterday at a conference on "Internet Freedom" at his George W. Bush Freedom Institute in Dallas.

A speech by Bush on "Internet Freedom"?! Irony much? Um, yes.

As it turns out, the Internet connection in the little town I was in was not stable enough to handle a Skype video interview, so my contribution had to be via telephone. Here's their story...

House Judiciary Chair Rep. John Conyers (D-MI) has just issued a statement [posted in full below] calling on the FBI to fire those who broke the law by issuing improper letters from the FBI in order to receive access to thousands of Americans' phone records from 2003 through 2006 under the guise of "national security."

"I call upon FBI Director Mueller to take immediate action to punish those who violated the rules," Conyers says in the statement, "including firing them from the agency."

"Today's hearing showed that the FBI broke the law on telephone records privacy and the General Counsel's Office, headed by Valerie Caproni, sanctioned it and must face consequences," said Conyers. "In some cases agents sent letters with information known to be false."

His statement even quotes the former Republican chair of the Committee, Rep. James Sensenbrenner (R-WI), sharing the sentiment:

'I'm extremely disappointed that every time Congress has tried to plug potential civil rights and civil liberties violations in our counterterrorism activities, the FBI seems to have figured out a way to get around it.

In a related matter, late last month a federal judge found the Bush Administration's warrantless domestic wiretapping program to be illegal. So this would be the second time in several weeks where the former administration was found to have violated the law and the U.S. Constitution in order to spy inappropriately and illegally on American citizens.

Will those Tea Baggers who claim to believe in the Constitution and the Rule of Law join the call for accountability yet? (Careful: It's a trick question, Tea Baggers, since the accountability would include members of the Bush Administration, and we realize your calls for "accountability" only go so far. On the other hand, if it's okay for Bush to have done it, we'll presume you don't mind if Obama spies on you either.)

Rejects DoJ attempt to invoke so-called 'State Secrets Privilege'...

What a shock...

WASHINGTON — A federal judge ruled Wednesday that the National Security Agency’s program of surveillance without warrants was illegal, rejecting the Obama administration’s effort to keep shrouded in secrecy one of the most disputed counterterrorism policies of former President George W. Bush.

The ruling delivered a blow to the Bush administration’s claims that its surveillance program, which Mr. Bush secretly authorized shortly after the terrorist attacks of Sept. 11, 2001, was lawful. Under the program, the National Security Agency monitored Americans’ international e-mail messages and phone calls without court approval, even though the Foreign Intelligence Surveillance Act, or FISA, required warrants.

[Plaintiff's attorney] Jon Eisenberg, said Judge Walker’s ruling was an “implicit repudiation of the Bush-Cheney theory of executive power.”

“Judge Walker is saying that FISA and federal statutes like it are not optional,” Mr. Eisenberg said. “The president, just like any other citizen of the United States, is bound by the law. Obeying Congressional legislation shouldn’t be optional with the president of the U.S.”

The ruling is the second time a federal judge has declared the program of wiretapping without warrants to be illegal.

But Judge [Vaughn R.] Walker limited liability in the case to the government as an institution, rejecting the lawsuit’s effort to hold Robert S. Mueller III, the F.B.I. director, personally liable.

So, it was illegal, as long argued. Yet nobody will go to jail for it, naturally, because Presidents, particularly George W. Bush, and their men, though theoretically "bound by the law," as Eisenberg says, are still above the law, apparently.

For you Tea Baggers: The comment section below is open so that you can let us hear your arguments as to why you believe that Barack Obama should be allowed to violate the law and the Constitution in order to read your emails and listen to your phone calls, at any time, and for whatever reason he chooses, without ever receiving court approval, the way you used to argue that Bush was allowed to do.

For you non-Tea Baggers in the reality-based world: We'll note here that the Judge in this case also, thankfully, rejected the DoJ's attempt to invoke the so-called "State Secrets Privilege" as "first asserted by the Bush administration and continued under President Obama."

The SSP is what the Bush Administration had twice used to gag FBI whistelblower Sibel Edmonds for so many years, successfully ensuring that her case would never see the light of day in a court of law, despite her appealing the Administration's use of the draconian and (previously) rarely-invoked "privilege" all the way to the U.S. Supreme Court.

Can we assume then that the "State Secrets" the Bush Administration was hoping to keep from seeing the light of day in the Edmonds case were even more of a national security threat than exposing the fact that the Government was spying, illegally, on anybody in this country that they wanted to?

Since I signed off the syndicated Peter B. Collins radio show in March, I've been able to zoom out from the close-up view of day-to-day political combat.

On a daily basis, I reflect on the "change we can believe in" that candidate Obama promised us just a year ago. Certainly, the new administration is better than the Bush/Cheney gang on many fronts; and Bush left Obama an economic meltdown and other serious problems that need attention.

But consider:

  • we still have 135,000 troops and even more contractors in Iraq, with no clear plan or timeline for our exit, just vague promises and the hope that the Iraqis will kick us out next year. Most of the US troops that have left Iraq went to Afghanistan;
  • the escalation of our presence in Afghanistan is very dangerous, and contradicts some of Obama's own statements about the prospects for "success" there. He had the chance to reverse direction after the election, but chose to double down on the "good war";
  • the massive interception of domestic electronic communications continues, and the Obama Justice Department has reinforced and expanded on the bad legal precedents set under Bush/Cheney. Most Democrats are silent on this issue, and I see no effort to restore our privacy rights.

Remember how they dubbed Ronnie Reagan the "Teflon president"? Obama seems to have a new and improved coating, I call it "Leftlon," protecting him from challenges from the progressives who helped him beat Hillary for the nomination.

He keeps reaching out to GOP nuts who want to scuttle his tepid health care "reform," refuses to allow investigations while Cheney spits at him regularly, and expects us to trust the Goldman Sachs Alumni Association to fix the economy that they continue to plunder.

When will Obama deliver for the progressives who got him elected?

On October 20, 2005 Time magazine reported that when confronted with the prospect of an FBI investigation into whether she improperly enlisted the support of the American Israel Public Affairs Committee (AIPAC), Representative Jane Harman (D-CA) left a voicemail stating that any investigation of her would be "irresponsible, laughable and scurrilous."

Yet, as reported by Jeff Stein of CQ Politics on April 19, 2009, Harman “was overheard on a 2005 National Security Agency wiretap telling a suspected Israeli agent that she would lobby the Justice Department to reduce espionage-related charges against two former [AIPAC] officials. “In return, the Israeli agent pledged to help lobby for Harman to become chairwoman of the House Intelligence Committee,” Stein reported.

According to Tim Rutten in the LA Times on April 22, 2009, however, "Harman denies any inappropriate actions, let alone a quid pro quo, and Tuesday sent an angry letter to Atty. Gen. Eric H. Holder Jr. demanding that the full transcripts be released." Rutten, who described it as a "faux scandal," points out that Harman neither "intervened on behalf of the lobbyists" nor became chairwoman of the House Intelligence Committee.

Recently, Marcy Winograd, President of Progressive Democrats of Los Angeles (PDLA), whose 2006 campaign was covered by The BRAD BLOG, announced her intentions to challenge Harman again in the 2010 Democratic primary election. In an email response to our query asking about her intention to run again against Harman, against whom she lost in '06, and about some specific issues of interest to our readers, Winograd noted that she has been a champion of election integrity issues, taking on a Republican CA Secretary of State for his direct work with Diebold lobbyists, as well as challenging U.S. Rep Rush Holt (D-NJ) for his 2007 election reform bill because of "its institutionalization of electronic voting systems."

She also said she intends to hold President Obama "accountable, whether it be closing Guantanamo or ending military tribunals or promoting diplomacy over war," even as she notes that she was "alarmed" by the "recent news reports of Harman's quid pro quo with AIPAC," and writes: "I feel it is my responsibility to run [against Harman], to offer constituents a choice, a real choice."

During the campaign, amid their state of elation, many disregarded Presidential Candidate Senator Barack Obama's past record and took any criticism of these past actions as partisan attacks deserving equally partisan counterattacks. Some continued their reluctant support after candidate Obama became grand finalist and prayed for the best. And a few still continue their rationalizing and defense, with illogical excuses such as 'He's been in office for only 20 days, give the man a break!' and 'He's had only 50 days in office, give him a chance!' and currently, 'be reasonable - how much can a man do in 120 days?!' I am going to give this logic, or lack of, a slight spicing of reason, then, turn it around, and present it as: If 'the man' can do this much astounding damage, whether to our civil liberties, or to our notion of democracy, or to government integrity, in 'only' 120 days, may God help us with the next [(4 X 365) - 120] days.

I know there are those who have been tackling President Obama's changes on change; they have been challenging his flipping, or rather flopping, on issues central to getting him elected. While some have been covering the changes comprehensively, others have been running right and left like headless chickens in the field - pick one hypocrisy, scream a bit, then move on to the next outrageous flop, the same, and then to the next, basically, looking and treating this entire mosaic one piece at a time.

Despite all the promises Mr. Obama made during his campaign, especially on those issues that were absolutely central to those whose support he garnered, so far the President of Change has followed in the footsteps of his predecessor. Not only that, his administration has made it clear that they intend to continue this trend. Some call it a major betrayal. Can we go so far as to call it a 'swindling of the voters'?

On the State Secrets Privilege

Yes, I am going to begin with the issue of State Secrets Privilege; because I was the first recipient of this 'privilege' during the now gone Administration;

I have been known to quote long-dead men in my past writings. Whether eloquently expressed thoughts by our founding fathers, or those artfully expressed by ancient Greek thinkers, these quotes have always done a better job starting or ending my thoughts - that tend to be expressed in long winding sentences. For this piece I am going to break with tradition and start with an appropriate quote from a living current senator, John Kerry: "It's a sad day when you have members of Congress who are literally criminals go undisciplined by their colleagues. No wonder people look at Washington and know this city is broken."

The people do indeed look at Washington and know that this city is 'badly' broken, Senator Kerry. The public confidence in our Congress has been declining drastically. Recent poll results highlight how the American people's trust in their Congress has hit rock bottom. A survey of progressive blogs easily confirms the rage rightfully directed at our Congress for abdicating its role of oversight and accountability. Activists scream about promised hearings that never took place - without explanation. They express outrage when investigations are dropped without any justification. And they genuinely wonder out loud why, especially after they helped secure a major victory for the Democrats. The same Democrats who had for years pointed fingers at their big bad Republican majority colleagues as the main impediment preventing them from fulfilling what was expected of them.

The recent stunning but not unexpected revelations regarding Jane Harman (D-CA) by the Congressional Quarterly provide us with a little glimpse into one of the main reasons behind the steady decline in the integrity of Congress. But the story is almost dead - ready to bite the dust, thanks to our mainstream media's insistence on burying 'real' issues or stories that delve deep into the causes of our nation's continuous downward slide. In this particular case, the 'thank you' should also be extended to certain blogosphere propagandists who, blinded by their partisanship, myopic in their assessments, and ignorant in their knowledge of the inner workings of our late Congress and intelligence agencies, helped in the post-burial cremation of this case.

Ironically but understandably, the Harman case has become one of rare unequivocal bipartisanship, when no one from either side of the partisan aisle utters a word. How many House or Senate Republicans have you heard screaming, or even better, calling for an investigation? The right wing remains silent. Some may have their hand, directly or indirectly, in the same AIPAC cookie jar. Others may still feel the heavy baggage of their own party's tainted colleagues; after all, they have had their share of Abramoffs, Hasterts and the like, silently lurking in the background, albeit dimmer every day. Some on the left, after an initial silence that easily could have been mistaken for shock, are jumping from one foot to the other, like a cat on a hot tin roof, making one excuse after another; playing the 'victims of Executive Branch eavesdropping' card, the same very 'evil doing' they happened to support vehemently. Some have been dialing their trusted guardian angels within the mainstream media and certain fairly visible alternative outlets. They need no longer worry, since these guardian angels seem to have blacked out the story, and have done so without the apparent need for much arm twisting...

President Obama announced the nomination on Thursday of a former government lawyer, who had been critical of the legal rationale for the Bush administration’s warrantless wiretapping program, to lead the Justice Department’s national security division.

The lawyer, David Kris, served as a senior Justice Department official in both the Clinton and Bush administrations from 2000 to 2003, and is widely respected in Washington for his knowledge of intelligence law.

In late 2005, following the public disclosure of the N.S.A. wiretapping program approved by President Bush, Mr. Kris wrote a 23-page legal analysis that described as “weak’’ and likely unsupportable some of the Bush administration’s key legal arguments in justifying the program.

And when he was still at the Justice Department, he advised his boss, who was at the time Deputy Attorney General Larry Thompson, not to sign a mysterious batch of wiretapping warrants — which grew out of the program — because intelligence officials would not reveal how the information in the wiretaps was obtained.

Russell Tice offers additional, startling details on NSA's warrantless eavesdropping on American citizens...

As we've been predicting for some weeks ago, the flood of revelations that would be flowing forth after Obama was sworn in would likely make what we currently know about Bush Era illegalities and incompetence seem like barely the tip of the iceberg.

Just one day after the Inauguration, Russell Tice, the NSA whistleblower who originally participated in that agency's illegal warrantless wiretapping program, and revealed details of same to the New York Times' back in late 2005, has now come forward with more details that he had been disinclined to release previously (he had been, after all, hounded by the FBI, subpoenaed by a grand jury, etc. after his original, heroic revelations.)

He spoke yesterday on MSNBC, revealing that American journalists were targeted by Bush's program which "had access to all Americans' communications." Please watch the remarkable video interview at right. Both that, and the text below, is from RAW STORY's coverage last night...

"The National Security Agency had access to all Americans' communications --- faxes, phone calls, and their computer communications," Tice claimed. "It didn't matter whether you were in Kansas, in the middle of the country, and you never made foreign communications at all. They monitored all communications."

"In one of the operations that I was in, we looked at organizations, just supposedly so that we would not target them," Tice told Olbermann. "What I was finding out, though, is that the collection on those organizations was 24/7 and 365 days a year --- and it made no sense. ... I started to investigate that. That's about the time when they came after me to fire me."

When Olbermann pressed him for specifics, Tice offered, "An organization that was collected on were US news organizations and reporters and journalists."

"To what purpose?" Olbermann asked. "I mean, is there a file somewhere full of every email sent by all the reporters at the New York Times? Is there a recording somewhere of every conversation I had with my little nephew in upstate New York?"

Tice did not answer directly, but simply stated, "If it was involved in this specific avenue of collection, it would be everything."

At the end of the MSNBC interview, Olbermann asked Tice to appear again this evening (Thursday) for more discussion on this issue.

Dem Leadership Tout Law's New 'Exclusivity' Provision, But None of Three Dems I Tried to Contact Can Adequately Explain Why They're Not Being Fooled Again...

House Majority Leader Rep. Steny Hoyer, (D-MD), one of the new FISA bill's strongest champions, spoke about the bill's new "exclusivity provision" on the floor of the House on March 14, 2008. He proclaimed that "It clarifies that FISA is the exclusive means of conducting surveillance in the United States for foreign intelligence purposes."

On June 20, Hoyer optimistically echoed his previous comment: "This legislation makes clear that FISA is the exclusive means by which the government may conduct surveillance."

Sen. Dianne Feinstein, (D-CA), in an email sent to some constituents, including myself, wrote that the new FISA bill: "Includes provisions I authored that make clear that FISA is the exclusive (or only) authority for conducting surveillance inside the United States...FISA would be the only legal authority for conducting surveillance on Americans for intelligence purposes..."

But the old FISA bill, which was the law when Bush began to spy on us without warrants, also had an "exclusivity" provision that stated:

[P]rocedures in this chapter or chapter 121 and the Foreign Intelligence Surveillance Act of 1978 shall be the exclusive means by which electronic surveillance, as defined in section 101 of such Act, and the interception of domestic wire, oral, and electronic communications may be conducted.

Since the "President" ignored the old FISA law, despite its existing exclusivity provision, what makes Hoyer or Feinstein or any of the other Dems think he'll bother to obey the new version of the law?

The existing law didn't keep Bush from breaking it last time, so it's beyond me what makes law makers think he won't do the same this time around. I decided to contact three different Democratic officials, all in favor of the new law, to try and find out why they believe they won't be fooled again...

Congressman Kucinich Takes Hours to Read ALL Articles in Full on the Floor of the U.S. House of Representatives

Rep. Dennis Kucinich (D-OH) is currently reading all 35 Articles of Impeachment, against George W. Bush, on the floor of the House of Representatives.

UPDATE: Now back home, and watching Kucinich myself on C-SPAN. He's been reading for hours, and may have hours ahead still. As mentioned on the air, I was consulted for these Articles of Impeachment and submitted a number of suggestions and material concerning impeachable offenses related to election tampering by George W. Bush and his agents. Don't know whether those articles are still in the final version. We shall see. But I wanted to be sure to disclose that.

No doubt we'll be talking about this tomorrow on the PBC Show (which I'm Guest Hosting all week). We're trying to get Kucinich for tomorrow's show...if he still has any voice left.

FURTHER UPDATE: Looks like the election-related Articles of Impeachment made it into the final version, including a mention of GOP "voter fraud" sheister Mark F. "Thor" Hearne of front-group American Center for Voting Rights (ACVR). Nice to see Hearne get the recognition on the floor of the U.S. Congress that he so richly deserves.

STILL MORE: Reuters coverage notes Kucinich "defied his party leadership" in filing. AP incorrectly writes:

Kucinich introduced a resolution last year to impeach Vice President Dick Cheney. That resolution was killed, but only after Republicans initially voted in favor of taking up the measure to force a debate.

In fact, his Articles of Impeachment against Dick Cheney were not "killed," they were sent to the House Judiciary Committee, where they remain without action having been taken on them by the Dem leadership, despite best efforts by folks like Rep. Robert Wexler (D-FL), and others.

9/11 changed everything. Except for all the stuff the Bush Administration was planning before 9/11 anyway.

Via RAW STORY...

Nearly 1,300 words into Sunday's New York Times article revealing new details of the National Security Agency's domestic eavesdropping program, the lawyer for an AT&T engineer alleges that "within two weeks of taking office, the Bush administration was planning a comprehensive effort of spying on Americans’ phone usage.”

In a New Jersey federal court case, the engineer claims that AT&T sought to create a phone center that would give the NSA access to "all the global phone and e-mail traffic that ran through" a New Jersey network hub.

The former AT&T employee, who spoke on condition of anonymity to the Times said he took part in several discussions with agency officials about the plan.

“What he saw,” Bruce Afran, a New Jersey lawyer representing the plaintiffs, told the Times, “was decisive evidence that within two weeks of taking office, the Bush administration was planning a comprehensive effort of spying on Americans’ phone usage.”

Democrats in Congress have a plan to not take decisive action immediately in regard to this most disturbing news!

***Update: House Judiciary Committee Files Contempt of Congress Report with House Clerk***

(Washington, DC)- Today, at approximately 2:45 p.m., the House Judiciary Committee filed its contempt of Congress report with the Clerk of the U.S. House of Representatives. The full text is available online here.

The report filed (as linked above) is an 842-page PDF file.

Earlier today RAW STORY reported the "one last chance" being offered to the White House by House Judiciary Chairman John Conyers (D-MI), that would lead to his committee dropping the contempt recommendation.

UPDATE: The report filed is for criminal contempt, versus inherent contempt. The former relies on any contempt citation being picked up by the U.S. Attorney from D.C. The latter is an option, rarely used, available to either house of Congress to hold their own hearings in the Capitol, in which the Sergeant-at-Arms could be instructed to jail those found guilty of such contempt. Unlike criminal contempt, inherent contempt would not rely on the DoJ's agreement to pursue the charges. Bush attorneys have already made clear that they would not allow attorneys in the Justice Dept. to do so.
