The Jones County, Mississippi, slogan is "A Great Place to Live." While this may or may not be true, and I've never been there, it's clearly not a great place to vote. At least if voting in a way that is verifiably accurate for the citizenry is something one might care about. A remarkable statement by the county's Circuit Clerk, and a unanimous decision in support of it by the County's Board of Supervisors this week, has made that as clear as can be.

You may recall that just last week, e-voting system failures --- such as e-voting machines that wouldn't start up at all and votes that were counted twice --- led to chaos and uncertain results in Mississippi's state primaries, leading one official to declare days afterward, as they were all struggling to sort out results of several close elections: "At this point there is no election...Everyone is baffled."

Against that backdrop then, behold what Jones County, MS, Circuit Clerk Bart Gavin is now calling for --- and receiving unanimous approval from the Jones County Board of Supervisors for(!) --- as irresponsibly reported without even a hint of fact-checking by Laurel Leader-Call reporter Charlotte Graham under the laughably misleading headline, "Improving the voting process" [emphasis added]...

Tony Pierce, filling in for Andrew Malcolm (columnist and Laura Bush's former press secretary) at Los Angeles Times' "Top of the Ticket" blog picks up (with attribution, gracias) on our scoop earlier this week about the 100% unverifiable, yet highly hackable Diebold touch-screen e-voting machines out of Van Wert County, Ohio, now for sale, on the cheap, at eBay...

100+ Diebold voting machines, known for how easily they can be hacked, available now on EBay

You really can get anything on EBay, even electronic voting machines proved to be easy to corrupt for purposes of voting fraud.

Brad Friedman of the Brad Blog first noticed that "more than 10" AccuVote-TS voting machines, built by Diebold, were being sold on the online auction site for the buy-it-now price of $1,200 (plus $50 shipping and handling).

The machines are used and don't come with user's manuals, power supplies, batteries or memory cards, which may explain their discounted price. However, for those who wish to rig elections, machines like these are priceless.

Friedman was contacted by the seller, who told him that he had more than 100 of the electronic voting machines that were originally used in Van Wert County, Ohio.

AccuVote-TS voting machines were also used in New Jersey, when a professor at Princeton demonstrated how easy the Diebold machines were to manipulate for nefarious means.

Pierce offers more information in his piece on that landmark Princeton hack from September 2006 and the hackability of these systems in general.

Long time readers of The BRAD BLOG likely recall the Princeton hack came about when VelvetRevolution.us (as co-founded by The BRAD BLOG) gave the Diebold touch-screen system to computer scientists there for the --- at the time --- highly secretive, first-of-its-kind examination, after we'd received the machine from a source of ours. We originally broke the story of that hack exclusively both here at The BRAD BLOG and in a slightly shorter version at Salon.

The alarming hack --- which demonstrated how a virus could be inserted into one of these systems and invisibly flip the results of an entire election --- received a great deal of attention from the mainstream media at the time, and was even covered in a live video demonstration on Fox "News". (See that video at right.)

Though the Princeton hack was on a Diebold AccuVote TS (with no so-called "Voter Verifiable Paper Audit Trail" printer) versus the TSX model (with VVPAT) being sold now on eBay, the many ways available to game them in order to flip election results with very little possibility of detection are essentially the same...

NBC affiliate WBCD reports, inaccurately, that state's ES&S touch-screen voting machines include 'independent paper back up'...

The local Charleston, South Carolina, NBC affiliate, WCBD, was hoodwinked by someone; apparently it was the SC Election Commission. In the following report, WCBD's Larry Collins says that he has checked on the claim that "there is no independent paper back up from [South Carolina's] touch machines." He then goes on to inaccurately report, presumably from information given to him by the state election commission, that "there is a paper trail" on the state's ES&S iVotronic voting systems...


Collins' reporting is patently inaccurate.

The pieces of paper seen hanging in the background behind him are end of the day reports or possibly some "poll tapes," printed out after polls close, showing the purported tallies from each machine or precinct. They are not auditable "paper trail" records of voters' votes, and they are not verified in any way, shape, or form by the voter.

Those printouts can say absolutely anything, as printed, including the actual vote counts, erroneous vote counts due to machine malfunction or misprogramming, or, as seen in the following Fox "News" clip, vote counts that have been purposely manipulated by tampering and/or the inclusion of a virus implanted on one of the voting machines' memory cards...

RELATED...Princeton University moves to ban freshmen from the sidewalks: "The Princeton Proposition 8 campaign aims to secure the definition of Princeton University sidewalks as a means of pedestrian transit for sophomores, juniors, seniors, graduate students, faculty, staff, and other members of the university community, but supports the elimination of the right of freshmen to walk on sidewalks."

The majority supporters of the measure note that "they are not 'froshophobic' and that some of their best friends are freshmen, but they maintain that freshmen on the sidewalk degrade the sacred institution of sidewalks."

Straight-Party Ticket Votes Failed to Allow Voters to Review Names of Presidential Candidates Before Casting 'Ballot'

All 185 of the completely unverifiable Diebold touch-screen voting machines used in Northumberland County, PA's election were ordered impounded by a judge Tuesday night after complaints from both the Republican and Democratic parties. Officials from both parties had filed requested action following reports from voters that straight-party ticket votes were not showing voters the names of their selection for President on the summary screen near the end of the 100% faith-based touch-screen voting process.

Problems with straight-party voting, particularly on touch-screen voting systems, were reported in a number of states that allow the practice, during the early voting period in the days leading up to Election Day.

While one Diebold AccuVote touch-screen machine was impounded by an official in Colorado following reports of votes flipping on the screen from Democratic to Republican candidates in early voting --- and even with hundreds of similar startling problems reported directly to the Obama campaign as The BRAD BLOG reported exclusively on Monday --- no other action was taken on or before Election Day to remove these wholly unverifiable systems from use until Tuesday night's court-ordered quarantine of the Northumberland County machines.

The same unverifiable machines made by Diebold were used in a number of states, including the entirety of Georgia where a run-off has been scheduled following a tight race for the U.S. Senate there. The same models were also found, by a landmark Princeton study in 2006, to be easily susceptible to malicious viruses that could result in a flipped election which would be difficult, if not impossible, to discover...

Two pieces of malicious software detected Thursday have been removed from Pinellas County's voting tabulation system.

The two bugs, known as Flush.G and W32.SillyDC, work in tandem and go from computer to computer redirecting Internet browsers to sites the user hasn't selected, officials said. The worm is carried through removable media like USB drives, is easily detected and, officials say, rather harmless.

Pinellas Deputy Supervisor of Elections Rick Becker said the worm isn't the kind of Trojan horse that would be used to corrupt a computer voting system and was unsure just where it came from.

And yet, we're often told by voting machine companies that viruses can't get into these systems. Then there are the election officials who have bought into these systems, yet know nothing about them, who respond to the public and the media as if they do, regularly making ridiculous claims that such problems can't happen because "at no time are our systems connected to the Internet."

Whether they are or aren't, it's an absurd response. Malicious software can get into the system any number of ways, via non-Internet networking, USB thumb drives, etc. It can then undedectably affect an election without detection.

In the Summer of 2006, after my organization, VelvetRevolution.us, was given a Diebold touch-screen system from an insider source, we loaned it to Prinecton for testing and they were able to insert a vote-flipping virus via the memory card which could pass itself from machine to machine and flip an entire election without detection.

And, of course, on the first day of Early Voting in the now-infamous FL-13 Congressional race in 2006 where 18,000 votes mysteriously and still-inexplicably disappeared, a malicious viral worm took down a key part of the network infrastructure on which the registration system ran, grinding voting to a halt that day.

Similarly, exclusively reported thereafter, the scientists who studied the ES&S voting machines used in that FL-13 election discovered that the ES&S touchscreen systems --- used in some 16 different states --- were also vulnerable to the same type of virus that Prinecton was able to insert into the Diebold machines. To this day, despite being told about it by the scientists who discovered the problem, the U.S. Elections Assistance Commission (EAC) refuses to warn jurisdictions that use the same machine model about its vulnerability, even though it was described as potentially even more serious than the one discovered in the Diebold systems.

Other than that, everything's fine. Nothing to see here. Move along, folks.

UPDATED WITH EXCLUSIVE NEW DETAILS: Sequoia CEO Jack Blaine Admits Company Does Not Control the Intellectual Property Rights for Sequoia's Voting Machines!

The BRAD BLOG learned this morning that a New Jersey judge has today given plaintiffs and Princeton University computer scientists the right to examine the state's Sequoia AVC Advantage touch-screen voting machines which failed to record voter totals accurately, in at least six different counties, during the Garden State's recent Super Tuesday primary.

Sequoia had previously both threatened legal action against the professors, despite a unanimous request from a state association of county election clerks, and attempted to quash the court-ordered subpoenas to have the machines impounded and examined independently.

The Courier-Post confirms this afternoon, and publishes the following account of the Judge's decision today...

A New Jersey judge says voting rights activists should have a chance to examine the programming of touch-screen voting machines.

The order was issued today by Superior Court Judge Linda Feinberg in Trenton. She dropped a May trial date on the reliability of the machines but says the trial should start by September.

She has been asked to decide if the state's 10,000 electronic voting machines should be scrapped, as the voting rights advocates contend.

The state of New Jersey says the machines should continue to be used in elections.

The manufacturer of the machines, Sequoia Voting Systems, has resisted efforts to have the machines tested independently.

The BRAD BLOG has covered this (sometimes very amusing) saga in great detail, since it first came to light following the election (and even on Election Day, when machine failure kept the NJ Governor from being able to cast his own vote for 45 minutes).

Judge Orders Mandatory Testing of Machines After Company Previously Threatened Legal Action Against Princeton Professors if They Dared To Examine Machines...

Just out from the NJ Star-Ledger...

Subpoenas were issued in six New Jersey counties today, demanding that officials turn over for testing all voting machines where discrepancies were found in the presidential primary tallies.

Election officials in Bergen, Gloucester, Mercer, Middlesex, Ocean and Union counties were instructed to turn over the machines by April 15. Activists trying to persuade Superior Court Judge Linda Feinberg that electronic voting machines should be discarded succeeded in convincing her that examining these counties' machines is critical to their case.

"In order to succeed in our case and show Sequoia machines are insecure and can be hacked into, we need to look at these machines," Venetis argued. Clerks in the six counties uncovered discrepancies in 60 machines when they doubled check the vote tallies after the Feb. 5 presidential primary.

Michelle Shafer, a spokeswoman for Sequoia in California, said her company would try to have the subpoenas quashed. But no motions were filed today with Superior Court Judge Linda Feinberg, who is presiding over the case in Trenton.

Cringely takes notice of BRAD BLOG's exposé from earlier this week, on the man Sequoia Voting Systems is paying to "independently" review their failed AVC Advantage touch-screen machines (the ones that failed in NJ recently, but which are still set for use in the upcoming, crucial PA primary). He was as amused/horrified at whom they'd hired, instead of the actually qualified computer science professors at Princeton University whom Sequoia had threatened with legal action, should they dare a real examination of the company's faulty machines.

Cringely sums up our report succinctly this way...

While I was digging through the Net looking for the skinny on Sequoia Voting Systems and its mystery contractor Kwaidan Consulting (aka Mike Gibbons), the Bradblog's Brad Friedman was doing the same. He managed to unearth a cached version of Gibbons' MySpace page that's just a wee bit different than the current model. Instead of a photo of Gibbons shaking hands with Bush I, this one shows a good-old-boy leaning against the hood of a pickup. The list of people Gibbons wants to meet has changed too. Instead of Jesus, Einstein, and Newton, Gibbons was looking for “a well endowed blonde nymphomaniac ... that likes to be under the influence of Jim Beam whiskey in a dimly lit room at least 3 times a week.” (Hmm, Jesus or a busty nymphomaniac – that's a tough call.) It's nice to know the gatekeepers of our electoral system go shopping for their code experts in New Orleans bordellos.

One small thought in response to the good Cringely here. Sequoia are not the "gate-keepers," they just think they are, and therein lie the problems. He, we, and you are the gate-keepers. And until now, we've failed horribly to keep the crooks and liars --- like the folks at Sequoia and Diebold and ES&S and Hart InterCivic (take a look at that report please Robert, and the stunning complaint downloadable with it!) --- outside of those gates.

By the way, with the crush of other news elsewhere, and even at The BRAD BLOG this week, our rather jaw-dropping report on Gibbons (even if we say so ourselves) was largely overlooked out there by the CMSM and even the blogosphere. These stories --- the embarrassing Gibbons/Kwaidan report, the remarkable federal fraud case against Hart, and all the others here --- don't spread themselves around. Please do not misunderestimate the importance of your DIGGING, REDDIT-ing, and otherwise emailing and linking up to these stories far and wide. Notifying your local media about them (include the URL when you email them), can make all the difference.

We're doing our part, and appreciate whatever hand you can lend in return. It matters.

As we often say, this democracy ain't gonna save itself. And the gates ain't gonna keep themselves, either.

Meet Mike Gibbons of 'Kwaidan Consulting': Seeking 'Well Endowed Blonde Nymphomaniacs'...Or 'Jesus Christ, Isaac Newton and Albert Einstein,' Depending on Whose Paying...

Last week, in the wake of their AVC Advantage touch-screen voting systems having been found to have failed in at least six counties following New Jersey's Super Tuesday Primary, and on the heels of much-deserved ridicule for having threatened Princeton computer scientists with legal action should they go forward with an independent technical review of their voting systems, as requested by NJ election officials, Sequoia Voting systems issued a laughable press release headlined "Sequoia Voting Systems supports third party reviews and testing of its election equipment," which John Gideon appropriately eviscerated for all of the (putting it nicely) "misleading half-truths" therein from the dishonest, desperate folks at Sequoia.

The company, which claims their oft-hacked votings systems (accidental hack here, on purpose hack here) are secure and "tamperproof", subsequently saw their own website ignominiously hacked thereafter late last week.

But, as if the constant predilections of Sequoia VPs Michelle Shafer and Edwin Smith to slap "kick me" signs on their own backs wasn't enough, they then went on to release another statement last Thursday announcing they were commissioning their own "external review" of their own voting systems "that includes review by an independent company," which nobody has ever heard of.

So who is this "Kwaidan Consulting of Houston, Texas," whom the geniuses at Sequoia have selected to carry out their independent, third-party review? You're not gonna be believe this one...

We can't think of a clever enough turn of phrase this morning to adequately cover the full irony here... Via Computerworld...

A company whose e-voting machines have come under fire from election officials in New Jersey confirmed today that its Web site had been hacked.

A section of Sequoia Voting Systems Inc.'s Web site was hacked overnight, and when the company realized what had happened, it took the site down and removed the "intrusive content," Sequoia spokeswoman Michelle Shafer said via e-mail.

Sequoia made "security enhancements" to protect the site from further hacking, and it was back online this afternoon, Shafer said. The company is investigating the origin of the attack.

The hack was noticed Thursday morning by Ed Felten, a computer scientist who has been asked to investigate voting-machine discrepancies in the state's primary election.

Yes, that would be the same Ed Felten, computer science professor of Princeton, who last week was sent a threatening email from a Sequoia executive, warning of legal trouble should he dare examine the Sequoia AVC Advantage touch-screen voting machines which failed in New Jersey's Primary Election in February.

In the wake of this latest PR nightmare for the company, as John Gideon pointed out last night, they've decided to mount a Campaign of Lies instead of simply allowing their "tamperproof" e-voting systems to be examined by a third party. Brilliant strategy, guys. As usual.

The same failed Sequoia touch-screen systems, which have never been tested by any independent third-party, are currently set for use in Pennsylvania's Primary next month. We continue to encourage readers to click here to encourage NJ's AG to immediately commission a complete technical review of NJ's voting machines to determine what went wrong.

VP Edwin Smith Warns Scientists, in Email Obtained by The BRAD BLOG, of Plans to Take 'Appropriate Steps to Protect Against Publication of Software, Its Behavior or Reports Regarding Same'

Sequoia Voting Systems has sent a legal threat to Princeton University computer science professors Ed Felten and Andrew Appel warning them of legal action should they proceed with an analysis of New Jersey's touch-screen voting machines as unanimously recommended last week by an association representing election clerks across the state.

In a terse email sent last Friday, obtained today by The BRAD BLOG, Sequoia's Edwin Smith, Vice-President of Compliance/Quality/Certification, warns the university academics that the company has "retained counsel to stop any infringement of our intellectual properties, including any non-compliant analysis."

"We will also take appropriate steps to protect against any publication of Sequoia software, its behavior, reports regarding same or any other infringement of our intellectual property," Smith threatens.

The email from Smith to Felten and Appel is posted in full at the end of this article. Felten has confirmed its authenticity late this afternoon.

The call by state election officials for the independent study of Sequoia's AVC Advantage touch-screen machines comes in the wake of a recent finding that the systems mistallied voter turnout totals across at least six different counties in New Jersey's February 5th Presidential Primary Election. During a post-election canvass, it was found that the number of voters for each party, as reported by the internal printouts on the electronic voting machines, failed to match totals on the internal memory cards inside the same systems in a number of instances across the state.

Sequoia's explanation for the problem, essentially blaming voters and poll workers for pushing a complicated series of buttons, was found lacking by the state election clerks.

The discovery of mistallies followed on previous embarrassment for Sequoia and New Jersey when several machines failed to boot up at all on the morning of the Super Tuesday Election, causing a 45-minute delay for NJ's Governor John Corzine before he was finally able to cast a vote at his polling place in Hoboken.

The very same Sequoia AVC Advantage systems which failed in New Jersey, will be used across Pennsylvania in that state's upcoming --- and rather important --- Primary Election next month.

Sequoia has good reason to be concerned about what may come of an analysis by professors Felten and/or Appel. Both of them have previously detailed major voting machine security flaws, and the ability to easily hack into such systems made by both Sequoia and Diebold Election Systems...

The Newark Star-Ledger is reporting that New Jersey election officials have found a discrepancy in the state's Primary Election results as reported on the Direct Recording Electronic (DRE) voting machines used on Super Tuesday. Voter totals reported by the internal paper tapes on their Sequoia AVC Advantage DRE in a number of counties are failing to match up with totals found on the memory cartridges, used for both ballot definition and results storage, on the same machines, according to the report today...

As Union County Clerk Joanne Rajoppi tried to verify returns in this month's historic presidential primary, she kept coming up with errors for a handful of voting machines.

The numbers from the cartridges that print out vote tallies and the paper-tape backup within the machine didn't match. Rajoppi asked her colleagues in other counties to perform the same test, and similar problems were found in voting machines for Bergen, Gloucester, Middlesex and Ocean counties.

Problems with Sequoia's AVC Advantage systems also emerged early on the morning of Super Tuesday, forcing a 45 minute delay for the state's Governor, who was unable to cast his vote when the machines failed to boot up on Election Day. In February of last year, the same machines were hacked by a Princeton University Professor after he'd been able to purchase a number of the $8000 systems for just $86 apiece on the Internet.

The Star-Ledger today goes on to report some of the details on the latest failures now emerging in New Jersey during the state's post-election canvassing...
