So this happened quietly last week:

A federal judge approved a settlement resolving the class action lawsuit filed on behalf of demonstrators who were pepper-sprayed at UC Davis in 2011.

U.S. District Court Judge John Mendez on Wednesday gave the final approval for the $1 million settlement, initially filed in September.

As part of the settlement, the university has agreed to pay $30,000 to each of the 21 plaintiffs, a total of $250,000 to their attorneys and a total of $100,000 to 15 other claimants.

The settlement also stipulates that UC Davis Chancellor Linda Katehi issue a formal written apology to the students and alumni who were pepper-sprayed. It also calls for the university to develop new policies regarding student demonstrations and use of force.

In the very same week...

• A military judge agreed that U.S. Army Private Bradley Manning's pre-trial confinement, for having allegedly leaked classified diplomatic cables, was excessively harsh, but refused to dismiss the charges against him. Instead, the judge reduced 4 months from Manning's potential life sentence that he hasn't even received yet while being jailed for 2 years and 8 months, so far, waiting for his day in military court. The judge also delayed the start of his trial for another 3 months in the bargain.

• 26-year old activist and Internet prodigy and pioneer Aaron Swartz killed himself after what his family describes as bullying by a federal prosecutor who filed felony charges against him --- with potential penalties of nearly 50 years in prison --- for something that has never been a crime and has no victims.

Meanwhile, just a few weeks earlier...

• Britain's largest bank, HSBC, was slapped on the wrist with a $1.9 billion settlement (a few weeks of profit) for having knowingly laundered billions of dollars for drug cartels and terrorist organizations and rogue states after federal prosecutors in the U.S. decided that any harsher punishment --- such as larger fines or taking them to court or, God forbid, sending any single one of their employees or board members to prison for even a day --- would potentially result in bankruptcy for the "too big to jail" international bank.

And, a few weeks before that...

• Oil giant BP pleaded guilty to 11 counts of manslaughter and other criminal charges related to the massive oil spill and deaths of 11 men on the Deepwater Horizon oil rig in the Gulf of Mexico in 2010. They agreed to pay $4.5 billion in fines (they made more than that in profit alone in the third quarter of 2012) over a five year period. Nobody would face any jail time in the settlement.

Yet, all the while...

NRA stooges continued to pretend that their big bad assault weapons are responsible for keeping this country safe from big government tyranny.

What the fuck is wrong with this picture, those people, this Administration, our Dept. of Justice, and this country?

A few items of late that have caught our eye, but we haven't had time to cover in detail. So, you get the Readers Digest versions for now. You're welcome!

Susan Rice and the Democrats once again succumb to the demands of terrorists.

• Whodathunkit? But questions arise about the legitimacy of the claims made by Fox' latest wannabe James O'Keefe, about that video purporting to show an "unprovoked attack" by "union thugs" outside the capital building in Lansing, MI this week. The most amazing part? Someone at The New York Times --- yes, that New York Times --- is one of those actually noticing the big honkin' edit in the middle of the video, rather than just reporting it all as unquestioned fact.

Eric Holder spoke about the need to protect voting rights at the John F. Kennedy Presidential Library. We have more than a few bones to pick about it, but we'll just point you to the actual speech for the moment.

• What's the difference between this and just stealing? House Republicans secretly --- secretly --- authorized $500,000 in tax payer dollars to defend the unconstitutional "Defense of Marriage Act". More of that small government "conservatism", apparently.

• Finally, for now, the critically acclaimed Zero Dark Thirty, the new theatrical film about the manhunt for Osama Bin Laden, reportedly glorifies the torture that led to his capture and killing, even though no torture whatsoever actually led to his capture and killing.

So who will head up the CRIMINAL investigation? Karl Rove?...

Florida's Republican Governor Rick Scott's announcement yesterday would be somewhat akin to George W. Bush asking then FEMA Chief, Michael "Heckuva Job" Brown to head up a review of how FEMA and the Federal government performed in responding to Hurricane Katrina. Or, perhaps asking Karl Rove or Dick Cheney to get to the bottom of that whole Valerie Plame outing thing.

The only worse, less independent person who could possibly be chosen to head up a "review" of what went wrong in this year's disastrous election in Florida would be Scott himself.

But since his hand-picked Sec. of State Ken Detzner carried out every single one of Scott's horrendous, un-American orders to restrict voting and voter registration and to try and toss eligible voters off the rolls this year, resulting in even active-duty military voters getting purged, all while ignoring actual, massive voter registration fraud carried out by the Republican Party of Florida itself (until it could no longer be ignored), it may as well be Scott himself in charge of this so-called "review" in which Detzner has been assigned to tell us all why it was that, among other things, voters were still in line trying to cast their votes at 2am on Wednesday morning in Miami-Dade, even as the President of the United States was delivering his re-election victory speech in Chicago.

Heckuva job, Scottie!

Scott has already, repeatedly since Election Day, declared that he did "the right thing" by slashing Early Voting from 14 days to just 8 in Florida this year, and then refusing to expand those hours on the weekend before the election --- unlike both of his Republican predecessors Governors Charlie Crist and even Jeb Bush --- once it became clear that voters were standing in line for 6, 7 hours and longer simply trying to cast their vote...

More progressive talk pushed off OUR PUBLIC AIRWAVES and, again, in one of the nation's most progressive cities...

[UPDATE: As of 6:00pm PT, the KPOJ website has now flipped to "Fox Sports AM 620 Portland".]

This is horrible. Tonight, without warning, Clear Channel Communications-owned 620 AM KPOJ in Portland, Oregon, one of the most progressive cities in one of the nation's most progressive states, has flipped from its years-long progressive news and talk format over to Fox Sports as of 5:30pm local time.

KPOJ was the only commercial progressive talk radio station in Portland. The city will still have several other Rightwing talk radio stations, including one owned by Clear Channel, and they already have two sports stations, but the Bain Capital-owned media conglomerate is now killing yet another progressive voice from our publicly-owned airwaves.

An earlier piece today in The Oregonian had reported that the station would be flipping as of Monday. An UPDATE in the Willamette Weekly, however, reports that the station, which had long featured Ed Schultz, Randi Rhodes, Mike Malloy, Thom Hartmann (who had broadcast for years out of KPOJ until moving his show to Washington D.C.) and other progressive talkers, will change to its Fox Sports format as of this evening.

The BRAD BLOG can now confirm that KPOJ has flipped its programming format and website to Fox Sports as of 6:00pm PT tonight.

When one company owns "competing" talk radio stations in the same town, and gets to decide which one enjoys a stronger signal and which one receives promotional dollars (and which one doesn't), "competition" in the market place is a mirage. It's the equivalent of a Coca-Cola distributor owning the sole rights to distribute both Coke and Pepsi in the same town. Which one do you think is going to sell better there? That's precisely what talk radio is like in almost every major market in the country now. One company, usually Clear Channel, generally owns both the "Right" and "Left" talk stations. (In Portland, Clear Channel owns Rightwing talk outlet KEX as well as KPOJ.) Promoting one station would likely decrease listeners and ratings --- and, thus, ad dollars --- for the other. Thus, there is no "free market" competition in talk radio.

This is hardly the first time that Clear Channel has done the same thing, in very progressive cities, underscoring yet again that there is no real, "free market" competition in talk radio over our publicly-owned airwaves. The market place is decidedly rigged...

On Friday, the U.S. Department of Justice announced that its Civil Rights Division will be deploying "more than 780 federal observers and department personnel to 51 jurisdictions in 23 states for the Nov. 6, 2012, general election."

Their news release, posted in full below, notes that "The Voting Rights Act prohibits discrimination in the election process on the basis of race, color or membership in a minority language group."

"The observers and department personnel will gather information on, among other things, whether voters are subject to different voting qualifications or procedures on the basis of race, color, or membership in a language minority group; whether jurisdictions are complying with the minority language provisions of the Voting Rights Act; whether jurisdictions permit voters to receive assistance by a person of his or her choice if the voter is blind, has a disability, or is unable to read or write; whether jurisdictions allow voters with disabilities to cast a private and independent ballot; whether jurisdictions comply with the voter registration list requirements of the National Voter Registration Act; and whether jurisdictions comply with the provisional ballot requirements of the Help America Vote Act."

The announcement also includes DoJ contact numbers and websites for voters who have problems on Election Day. It also specifies the county and state jurisdictions where DoJ monitors will be on hand across the country.

Please note, however, that no matter how many monitors and attorneys and poll watchers are on hand, none of them can see inside an electronic voting system --- either touch-screen system, or paper-based optical-scan system --- to determine whether those computers have accurately tabulated the intent of the voters.

Broader investigations are being sought, on a number of fronts, into the nationwide GOP Voter Registration Fraud Scandal including, finally, an investigation by the U.S. Department of Justice.

Over the weekend, a Democratic state legislator in Virginia asked the state's Republican Attorney General to open a statewide probe, though AG Ken Cuccinelli has said he has no plans to carry one out. Given the photographs recently posted of Cuccinelli on Twitter (see below), that's probably a good thing.

On Monday, however, a number of Democratic U.S. Congress members from Virginia sent a letter to U.S. Attorney General Eric Holder seeking a nationwide investigation. Also, the three ranking Democrats of the U.S. House Judiciary, Elections and Oversight committees are pressing Republican National Committee Chairman Reince Priebus for answers as to why his party hired a shady GOP operative with a long history of voter registration fraud allegations against him, and whether the RNC intends to truly cut ties with him, and his many companies working for Republicans across the country.

All of this comes on the heels of the GOP Voter Registration Scandal widening to Virginia last week, when 23-year old Colin Small was arrested and charged with 8 felonies and 5 misdemeanors after being seen allegedly dumping voter registration forms into a dumpster near a shopping mall in Harrisonburg.

Small, a Pennsylvania resident who claimed on his LinkedIn profile to be a "Grassroots Field Director" for the Republican National Committee, had been hired to do voter registration work by Strategic Allied Consulting, a company formed this summer at the request of the RNC and headed by Nathan Sproul, a shady GOP operative and paid political consultant for Mitt Romney's campaign.

The firm was supposedly fired by the RNC late last month after hundreds of apparently fraudulent registration forms collected by the company on behalf of the Republican Party of Florida were discovered by election officials in some twelve counties in the Sunshine State. The RNC had reportedly paid Sproul's firm at least $3 million since August to carry out voter registration efforts in five battleground states, including VA, despite many years of allegations that his companies had destroyed Democratic registration forms in a number of states.

The arrest of Small revealed that the supposed firing was a deception, as Sproul's employees and Republican voter registration machine were kept in place, but run by local GOP officials and paid by PinPoint Staffing, one of the employment agencies Sproul tells The BRAD BLOG he had used in a number of states...

[EDITOR'S NOTE: Our guest blogger Dana Siegelman is the daughter of Don Siegelman, the former Democratic Gov. of Alabama. He is scheduled to report to federal prison on September 11 to serve the remaining 6 years of a prison sentence after being prosecuted and found guilty in 2006 by friends and colleagues of Karl Rove, on charges of bribery. The former Governor received no money, or anything of tangential value in the transaction, and no explicit quid pro quo was found in his trial. The supposed "bribe" was by a local hospital executive, Richard Scrushy, who donated $500,000 to a fund favored by Siegelman, and meant to support a state lottery that would send underprivileged children to college. In return, prosecutors charged, Siegelman appointed Scrushy to a state hospital board, even though he had already been appointed to serve on the same board under three previous Governors (two Republicans and a Democrat). Such a transaction has never before been considered a crime in this country.]

There was rumor of Karl Rove's presence echoing in the halls of the Time Warner Cable Arena at the Democratic National Convention in North Carolina on September 5th, 2012. For some reason, since he dared show up to the DNC, I immediately felt it was meant to be that I meet him in person.

I mean, here I am petitioning for a Presidential pardon to lift my father's 78 month prison sentence that came at the hands of many GOP operatives set on taking my dad --- a Democrat, and the only man to have served in every statewide office in Alabama --- out of politics.

One of those operatives even swore under oath, in front of Congress, that Rove played a key role in making sure the U.S. Department of Justice was on board to see my dad's political prosecution --- as CBS' 60 Minutes reported back in early 2008 --- through to the end.

As you may imagine, my heart was beating at the prospect of confronting Rove in person, if the opportunity arrived. He had refused to testify when he was subpoenaed by Congress, and while several journalists have asked him about it, he has dodged the questions by saying he only learned of the case by reading it in the news, or that he only met some of the prosecutors involved, but not the woman who claimed she actually spied on my dad at the direction of Rove. As ABC's George Stephanopoulos told Mr. Rove after asking him about the Siegelman case, "But that's not a denial." I agree!

The main players in my father's prosecution, U.S. Attorney Leura Canary, her husband Bill Canary (who ran my father's opponent's campaign), former Alabama Attorney General now 11th Circuit Federal Judge Bill Pryor, and Federal Judge Mark Fuller have all been connected to Rove.

Political prosecutions were prevalent during the Bush years. The federal judges he appointed to the bench were vetted by Rove, and Bush loyalists were hand-selected to serve as U.S. Attorneys. Studies have shown that prosecutions were brought against Democrats at a rate of seven-to-one over Republicans during the Bush regime. Many of those prosecutions were completely political, amounting to hundreds of ruined political careers and the imprisonment of innocent people, such as my father.

I didn't know what I was going to say to Rove when and if I met him, but I felt I should say...something. Ironically enough, I was standing in the middle of the hall at the Charlotte Arena, waiting to meet a young man to introduce to my father for possible media coverage. That man was also named Karl. I didn't know what this Karl looked liked, so I was looking around to make eye contact with someone that I was supposed to meet.

Then, I saw Rove walking directly toward me with his security...

3-judge panel finds law discriminatory under Voting Rights Act, would 'disenfranchise minorities and the poor'...

Following on the U.S. Dept. of Justice finding last March that the Republican-enacted polling place Photo ID restriction law in Texas was discriminatory, in violation of the U.S. Voting Rights Act (VRA), a three-judge U.S. District Court panel has again blocked the law from being implemented.

The decision by the federal panel, which included one judge appointed by George W. Bush, was unanimous.

Texas had appealed the DoJ decision earlier this year, seeking a declaratory judgment from the court, after the federal agency had found the state had not met its "burden of showing that a submitted change [to an election law] has neither a discriminatory purpose nor a discriminatory effect," under Section 5 of the VRA, which requires preclearance for new election laws in 16 different U.S. jurisdictions with a history of racial discrimination. The Lone Star State is one of those jurisdictions.

The DoJ had determined [PDF] that, based on the state's own statistics, the law would have disproportionately disenfranchised registered Hispanic voters in the state. The found that registered Hispanics are anywhere from 46% to 120% more likely than non-Hispanics to lack the type of state-issued Photo ID that would have now been required to vote under the new law.

The 56-page ruling by the U.S. District court panel in D.C. today [PDF] found that "the law will almost certainly have retrogressive effect" as "it imposes strict, unforgiving burdens on the poor, and racial minorities in Texas [who] are disproportionately likely to live in poverty."

"Crucially," the court added, "the Texas legislature defeated several amendments that could have made this a far closer case" when they ignored warnings that the law "as written, would disenfranchise minorities and the poor."

In Texas, as Democratic lawmakers had pointed out while the bill was being debated, some registered voters would have to travel as far as 250 miles round trip to receive their "free" ID from a state Dept. of Public Safety (DPS) driver's license facility, presuming they owned or were able to afford buy the underlying documentation required to obtain that "free" ID. The burden would be especially difficult for those without drivers licenses in the first place. Moreover, as the DoJ had previously found, "in 81 of the state’s 254 counties, there are no operational driver’s license offices," and many of them have limited hours of operation.

The court blasted both the Republican lawmakers and the attorneys who presented their case. "Everything Texas has submitted as affirmative evidence is unpersuasive, invalid, or both. Moreover, uncontested record evidence conclusively shows that the implicit costs of obtaining [Photo ID that would satisfy the new law] will fall most heavily on the poor and that a disproportionately high percentage of African Americans and Hispanics in Texas live in poverty. We therefore conclude that SB 14 is likely to lead to 'retrogression in the position of racial minorities with respect to their effective exercise of the electoral franchise.'"

This was the second stinging loss for Texas Republicans in one week. On Monday, their plan for Congressional Redistricting in the state, on the heels of four new seats gained after the 2010 Census, was also struck down by a three-judge federal panel for violations of the VRA...

As we reported last September, the U.S. Dept. of Justice found that the state Republican's Congressional redistricting map for Texas, as signed by Gov. Rick Perry, was in violation of the federal Voting Rights Act. The DoJ found that the new plan --- which added four Congressional seats in the state after an increase in population was found by the 2010 Census --- was purposefully discriminatory against minority voters.

The DoJ asserted that the plan "was adopted, at least in part, for the purpose of diminishing the ability of citizens of the United States, on account of race, color, or membership in a language minority group, to elect their preferred candidates of choice to the Texas House of Representatives."

Texas appealed that ruling to a Federal District court which made its ruling yesterday. They agreed with the DoJ that the state was discriminating against it's own minority citizens, as Ari Berman reports at The Nation...

Today a three-judge federal court in Washington concurred with DOJ, writing that Texas’s redistricting plans were “enacted with discriminatory purpose” and did not deserve preclearance under Section 5 [of the federal Voting Rights Act.]

Here are the relevant facts of the case: Texas gained 4.3 million new residents from 2000–10. Nearly 90 percent of that growth came from minority citizens (65 percent Hispanic, 13 percent African-American, 10 percent Asian). As a result, Texas gained four new Congressional seats, from thirty-two to thirty-six. Yet under the Congressional redistricting map passed by Texas Republicans following the 2010 election, white Republicans were awarded three of the four new seats that resulted from Democratic-leaning minority population growth. The League of Women Voters called the plan “the most extreme example of racial gerrymandering among all the redistricting proposals passed by lawmakers so far this year.”

Berman has more details on the specific findings in the ruling, and notes that a lawsuit filed by civil rights groups late last year asserts that "even though Whites’ share of the population declined from 52 percent to 45 percent, they remain the majority in 70 percent of Congressional Districts." He also notes that the court found "Texas Republicans not only failed to grant new power to minority voters in the state, they also took away vital economic resources from minority Democratic members of Congress."

The state may now, and likely will, appeal the ruling to the U.S. Supreme Court. In the meantime, says Berman, "An interim map drawn by a federal court in San Antonio in February will be used for the 2012 election."

Earlier this year, the DoJ similarly rejected a new polling place Photo ID restriction law enacted by Republicans also in violation of the Voting Rights Act. Based on two differing sets of data supplied by the state, the DoJ found [PDF] that currently registered Hispanic voters were anywhere from 46.5% to 120% more likely than registered white voters to lack the type of state-issued Photo ID which would now be required to vote under the GOP's new law.

The state appealed that ruling as well to the same federal District Court panel in D.C. which heard the redistricting case. Their ruling on the Photo ID restriction law is expected very soon.

UPDATE 8/30/12: The federal court has similarly rejected the Texas Republicans' polling place Photo ID restriction law, finding it, like the Congressional Redistricting map, to be purposefully discriminatory against minorities. Full details on that ruling now here...

Federal lawsuit to prevent mass disenfranchisement may be imminent...

Pennsylvania has refused to turn over documents that the U.S. Department of Justice (DoJ) had sought in order to determine whether the state's new polling place Photo ID restriction law is in violation of Section 2 of the Voting Rights Act (VRA) and other federal laws.

As previously reported by The BRAD BLOG, on July 23, Assistant Attorney General Thomas E. Perez submitted a four-page letter [PDF] to Carol Aichele, the Acting Secretary of the Commonwealth of Pennsylvania (coincidentally, the wife of Gov. Tom Corbett's Chief of Staff), requesting information in electronic format for 16 broad categories of documents that the DoJ felt were needed to evaluate whether the Keystone State's Photo ID law complied with federal laws barring discriminatory election laws.

In an Aug. 17 letter [PDF], the Commonwealth's General Counsel, James D. Schultz, responded to Perez, by telling him that PA would not comply with what Schultz described as an "unprecedented attempt to compel [PA], a state not within the purview Section 5 of the VRA, to present information concerning compliance with Section 2 of the VRA."

Section 5 of the VRA requires some 16 different jurisdictions in the U.S., with a history of racial discrimination, to get pre-clearance for new election-related laws. Pennsylvania is not one of those jurisdictions. However, all 50 states are barred from instituting discriminatory laws under Section 2 of the act.

Schultz accused the DoJ of targeting "a growing number of states…simply because they instituted legislation designed to insure the integrity of the voting process"...

In the third of our three-part series on the U.S. Government's failed 'War on Drugs,' earlier this year, we noted that drug prohibition was vital to the very existence of the deadly Mexican drug cartels. As we noted, the carnage, which included 13,000 deaths inside Mexico in "the first three quarters of 2011 --- a number that does not include the more than 5,000 people who have disappeared" --- is now spilling over the border into the U.S.

Over the past five years, some 60,000 have died in the Mexican drug war, and "the U.S. has played a big part in it," according to a new video from the Brave New Foundation on behalf of GunWar.org. The free flow of increasingly sophisticated weaponry from the U.S. to Mexico --- extremely profitable for the U.S. small arms industry and deadly for innocent civilians --- is part of the very "scourge" which the U.N. was seeking to address in its Arms Trade Treaty negotiations before the Obama Administration caved in the face of the National Rifle Association's campaign of blatant lies about the accord.

All of the Mexican carnage, as the video explains, is due, in no small part, to the tremendously lax oversight of the sale of such weapons here in the U.S., thanks to the political strong-arming by groups such as the NRA who oppose virtually any and all oversight or regulation of any type.

"Around 70% of all firearms seized in Mexico and submitted for tracing, come from the United States," Brave New World explains. "Most gun sellers don't care. The more they sell, the more they profit."

The additionally tragic irony underscoring these facts: All of this has played out even as Republicans have spent the last year or so pretending to be concerned about their so-called "Fast and Furious scandal", the poorly-considered ATF "gun walking" program begun by the Bush Administration and continued by members of the ATF based in Arizona during the Obama Administration. A federal program designed (poorly or otherwise) to try and catch gun-runners and drug lords: Bad --- at least when it's carried out by a Democratic administration. Little to no restriction on the "legal" purchase of military-grade assault weapons in the U.S., resulting in tens of thousands of them pouring over the border for decades: That's just one of the many benefit that members receive in exchange for sending their hard-earned cash to the terrorist-enabling NRA...

Yet mainstream media misreport easily verifiable facts, continue to fall for FL Governor, Secretary of State's deceptive spin...

Florida Governor Rick Scott's attempted purge of "potential non-citizen" voters --- a purge which Scott's Republican predecessor Gov. Charlie Crist described last week as a "shameless," "mean-spirited," "insidious" and "sweeping" effort to gain partisan advantage "under the guise of removing non-U.S. citizens" --- has been an abject failure.

Scott's claims of success in unearthing "non-citizens" said to be registered to vote in the Sunshine State, repeated by his hand-picked Sec. of State Ken Detzner and uncritically echoed by a compliant mainstream corporate media, have amounted to less --- far less --- than meets the eye.

Over the course of our months-long investigation, which included public records requests and interviews with state and county officials, The BRAD BLOG has discovered that the Scott/Detzner claim of having captured some 107 "non-citizens" on the Sunshine State voter rolls as a result of their purge is, at best, a reckless overstatement. Yet, that number (107), which Scott described as "alarming," has been uncritically accepted as fact by corporate mainstream media.

Even if it had been accurate, 107 would amount to an infinitesimal percentage of the original 182,000 who had initially been identified as "potential non-citizens" by Florida officials --- 107 as against Florida's 11.2 million legally registered voters, with an untold number of perfectly legal voters threatened with losing their right to vote as collateral damage of the state's attempted purge.

But the 107 number isn't even close to being accurate. To the contrary, Florida election officials have been unable to confirm that more than ten percent of those whom Scott and Detzner claim their purge captured were in fact non-citizens.

For example, in the two counties, Lee and Collier, where 92 of Scott and Detzner's claimed 107 have been removed, just nine (9) of them have actually been verified, to date, as "non-citizens" named by Scott and Detzner on their list of "potential non-citizens" sent to county election officials for purging earlier this year. The rest have either been removed from the rolls without independent verification of whether or not they are lawfully registered U.S. citizens, or they were removed after their names surfaced on a separate list that had nothing to do with the list compiled by Scott and Detzner. That separate list, as gathered by a local news outlet, similarly, may or may not accurately identify the named registered voters as "non-citizens".

Despite the extraordinary failure to date, Scott and Detzner have repeatedly proclaimed "victory" in their voter purge scheme. Making matters worse for the general populace trying to make sense of what is actually going on, numerous corporate-owned media outlets have compliantly echoed their extraordinarily misleading and deceptive spin...

If there was any doubt before, after several findings by several courts that the Wisconsin GOP's attempts to institute polling place Photo ID restrictions were in strict violation of their state Constitution, yesterday's verdict ought to (but probably won't) put a hard end to that question...

A Dane County judge on Tuesday permanently barred enforcement of the photo identification requirements of Wisconsin's voter ID law, saying that it imposes too great a burden on voters in Wisconsin than the state constitution allows.

Circuit Judge David Flanagan ruled that Wisconsin Act 23, the voter ID law, "tells more than 300,000 Wisconsin voters who do not now have an acceptable form of photo identification that they cannot vote unless they first obtain a photo ID card."

That requirement, he wrote, imposes a "substantial burden" upon a significant proportion of state residents who are registered or eligible to vote because of the cost and difficulty of obtaining documents needed to apply for a state photo ID. That creates a "substantial impairment" to the right to vote guaranteed by the Wisconsin Constitution, he wrote.
