• President Obama names Vice-President Biden to head up a task force to work on new gun safety regulations to be submitted to him by January. Press conference transcript here.

• Supreme Court rulings on what gun control measures are allowed by the 2nd Amendment are actually quite narrow and leave a lot of room for further interpretation and rulings. Here's a quick legal analysis of where the court seems to stand at the moment.

• Robert Bork dies. In an attempt to be generous upon the occassion of his passing, we'll associate with Ian Millhiser who observes today: "At his best, Bork was a voice for the kind of judicial restraint that conservatives all but abandoned the minute President Obama took office." Bork had been selected by Mitt Romney to help him select judges as President. Mitt Romney's dream died first.

• 3 State Dept. officials resign after a report on Benghazi attack finds "grossly inadequate" security measures at the U.S. consulate on the night Ambassador Christopher Stevens and three other Americans were killed last September 11th. "We did conclude that certain State Department bureau-level senior officials in critical positions of authority and responsibility in Washington demonstrated a lack of leadership and management ability," said report panelist Adm. Mike Mullen. In response, Sec. of State Hillary Clinton accepted all 29 of the panel's recommendations, while nursing her reported recent concussion that has, to date, kept her from testifying to Congress on the matter.

• Something or other occurred today in regards to the so-called "fiscal cliff" negotiations, but we couldn't care less what it was. At this point, after Sandy Hook, the "fiscal cliff" stupidity feels a whole lot like the "Summer of Sharks" did, in retrospect, after 9/11. Of course, after Obama's prepared remarks at his presser on guns today, the D.C. press wanted to ask him, almost exclusively, about "fiscal cliff" bullshit. Same as it ever was.

The Rightwing finally choked on their own internal feedback loop last night. Mitt Romney paid the price for it. It could be a big one.

During the 2nd Presidential debate, as Obama responded to the phony Rightwing charge that it took him two weeks to refer to the deaths of four U.S. State Department officials in Benghazi, Libya as an act of terror, I tweeted the moment this way: "Obama's best answer of the night was on Libya."

When Romney took the bait and fell back on a false Fox "News" talking point, only to be corrected by the moderator, I followed with: "Candy Crowley does LIVE fact-checking! He DID call it an act of terror. #Journalism!" and then, as Romney kept digging: "Boom. Libya discussion just makes TOP of every post-debate wrap" and finally "If he doesn't screw up hereafter, Obama may have just won the Presidency in that Libya moment."

Here was the moment in question...

Indeed, as I also noted on Twitter just afterwards, the President had, in fact, referred to Benghazi as "an act of terror" during his first statement on the tragedy on the day following the incident.

Here's a helpful mashup of Romney stepping in it last night, contrasted next to Obama's actual Rose Garden comments from 9/12/12:

Adam Sewer at Mother Jones offers about as good of an explanation as I've seen for what I believe will be regarded as Romney's historic debate failure, and why the Right was finally hoisted publicly on their own insulated petard.

To put a sharper point on what went so desperately wrong for them, and what will continue to go wrong on the Right until they break out of their Karl Rove "we create our own reality", Fox "News" internal feedback loop trance, Rightwingers would have been far better served here if they had bothered to heed the advice that was also ignored by Tony "Scarface" Montana: "Don't get high on your own supply."

For the historic record, Obama referred to the Libya attack as an "act of terror" both on the day following the attack and then again on the day afterward. The direct quotes of both of those responses follow below...

On Friday, ABC's George Stephanopoulos caught Republican Presidential nominee Mitt Romney speaking out of both sides of his mouth. (Not that it's all that hard to do.)

As TPM's Josh Marshall described the remarks --- tongue only somewhat in cheek --- "Romney Apologizes to Muslim Rioters".

Romney, over the course of his lengthy ABC interview, finally acknowledged that the statement issued by the Cairo Embassy condemning "the continuing efforts by misguided individuals to hurt the religious feelings of Muslims --- as we condemn efforts to offend believers of all religions" was made before the protests began.

However, the GOP candidate, who had shamelessly seized upon that statement to falsely accuse the Embassy and President Obama of having "sympathize[d] with those who waged the attacks," evaded a direct answer to Stephanopoulos' direct question: "Where do they show sympathy for those who waged the attacks?"

Instead, Romney insisted it was "inappropriate" for the Cairo Embassy to leave the statement up on its website after its wall was breached. "The statement was reiterated after they had breached the sovereignty of the embassy," Romney proclaimed.

After its wall was breached, the Cairo Embassy tweeted: "This morning's condemnation (issued before protest began) still stands. As does our condemnation of unjustified breach of the Embassy."

Without explaining why he felt it was inappropriate for the Embassy to retain its condemnation of the film's scurrilous slander of the prophet Muhammad while simultaneously condemning the "unjustified breach of the Embassy," Romney followed up with a criticism of the film that was virtually indistinguishable from that which had been initially issued by the Cairo Embassy...

Yesterday, Alabama's former Democratic Governor Don Siegelman returned to federal prison to complete his 6 and a half year sentence on a bribery conviction for a transaction which has never before been considered "bribery" in the history of this nation.

The prosecution was brought about during the Bush Administration by close friends of Karl Rove and presided over by Judge's who served as his clients. Despite a plea from 133 former state Attorneys General, both Republican and Democratic, detailing the political nature of the prosecution and the dangerous precedent set by charging "bribery" against someone who never received a penny of person enrichment, the Supreme Court declined to hear the case earlier this year, and Siegelman was forced to return to prison yesterday, ironically enough, on September 11th.

I interviewed Siegelman just over one week ago, as he and his daughter Dana were about to head to the Democratic National Convention in Charlotte, NC to raise support for a petition campaign for a Presidential pardon. I aired the maddening interview today on my KPFK/Pacifica Radio show.

Aside from the obvious horrific nature of this prosecution, it was instructive to hear, once again, about Siegelman's 2002 re-election which, he says, was stolen from him after he went to bed on Election Night having been named the winner, only to be awoken the next day and told that some 5,000 votes had been supposedly mis-allocated by the electronic tabulation system and re-allocated, in the middle of the night in one Republican county, without the public or media watching, from him to his opponent Bob Riley (whose campaign manager was both a close friend of Rove and the husband of the U.S. Attorney in Alabama.)

Siegelman was never allowed to count the paper ballots that were supposedly mistabulated by the electronic voting system. (Also, see my short video interview with Siegelman on this at the DNC in Denver in 2008, shortly after he was freed on bail during his appeal.)

After the interview with the former Governor, who was once believed to be Presidential timber before being taken down by Rove, I was joined live on the show by his daughter Dana. She updated us on her difficult day saying goodbye to her father yesterday when she and the rest of her family dropped him off at the federal facility in Oakdale, LA. She also discussed her pardon campaign at FreeDonSiegelman.org and her bizarre, chance meeting with Rove himself at last week's DNC, which she guest blogged about here at The BRAD BLOG earlier this week.

"It's disgraceful," Republican Presidential nominee Mitt Romney proclaimed, "that the Obama administration's first response was not to condemn attacks on our diplomatic missions, but to sympathize with those who waged the attacks."

Except, none of what Romney said was actually true.

While factual misrepresentation has proved to be a hallmark of the Romney/Ryan campaign (e.g. the lie that Obama stole $716 billion from Medicare to fund "Obamacare" or the bogus claim that the President's Ohio lawsuit, which sought to open Early Voting for all, was actually an effort to suppress the military vote), the effort to exploit a tragic assault that killed U.S. Ambassador Chris Stevens and three of his aides was seen by Robert Dreyfuss of The Nation as so despicable as to "disqualify" Romney as a candidate for our nation's highest office.

The statement which Romney seized upon was not made by the President or anyone on its staff, but from the Cairo Embassy. More importantly, Michael Tomasky of The Daily Beast observed, the Cairo Embassy statement was issued before either it or the U.S. Consulate in Benghazi was attacked.

For the same reasons expressed by General David Petraeus two years ago when he warned that a plan to commemorate 9/11 by burning Qurans would endanger U.S. troops in Afghanistan, the U.S. Embassy in Cairo had sought to prevent a violent reaction by condemning "the continuing efforts by misguided individuals to hurt the religious feelings of Muslims --- as we condemn efforts to offend believers of all religions."

Nonetheless, TPM's Benjy Sarlin notes that Romney shamelessly refused to back off his inaccurate critique of the President --- in the midst of a very live, ongoing crisis during which the whereabouts of a U.S. Ambassador remained unknown --- even when confronted by reporters about the chronology of events, because the Cairo Embassy apparently was not as swift as Romney felt they should have been in taking down their tweets in the wake of a violent assault on their Embassy and the one in Libya. Romney insisted the President was responsible for the Embassy's statement, which statement, the GOP Presidential candidate claimed, was "akin to [an] apology."

In truth, neither the President nor the Embassy "sympathized" with the attack or the attackers. To the contrary, the Cairo Embassy followed the attack with this tweet (emphasis added): "This morning's condemnation (issued before protest began) still stands. As does our condemnation of unjustified breach of the Embassy."

But the incident has turned out to be rather revealing about the GOP nominee's readiness to serve as President of the United States...

Wow. Until very recently (like, today recently, when Newt Gingrich --- yes, Newt --- found himself atop two new national polls! Party like it's 1994!), this man was the front-runner for the GOP nomination for President of the United States...

UPDATE: NBC's Chuck Todd tweets to say the Cain campaign responded to the video above by saying he "Didn't say anything wrong or inaccurate, it just took him a while to recall the specifics of Libya."

And NBC's Andrew Rafferty tweets: "Cain camp tells @NBCNews that Libya video being taken out of context. Cain going on 4hrs sleep, just took him a while to gain bearings."

The complete, 5-minute answer above was..."taken out of context." Got it.

Now back to news that actually matters. Sorry for the distraction there. But sometimes the insane freak show that has replaced actual political affairs in this nation is just too much to not take notice of here. This has been one of those moments.

Anti-war sentiments today are strikingly similar to what they had been in March 1968 when Sen. Eugene McCarthy (D-MN) challenged fellow Democrat and incumbent President Lyndon B. Johnson in the New Hampshire primary. In March 1968 only 41% of Americans said "no" when asked whether we made a mistake in sending troops to Vietnam. Today six out of every ten Americans surveyed (70% of Democrats) favor an immediate end to the war in Afghanistan. Another 59% oppose our involvement in Libya.

While opposition to war is similar, the "democracy deficit" --- what Prof. Noam Chomsky refers to in Failed States as the significant gap between the policy positions of the electorate and their elected representatives --- is much wider today than it had been in 1968.

Medicare, the centerpiece of President Johnson's Great Society, like Social Security, the centerpiece of FDR's New Deal, remains immensely popular with the American people. As revealed by a recent Washington Post poll, 78% of Americans oppose cutting Medicare. 72% favor raising taxes on incomes over $250,000 and only 17% oppose raising taxes on those making more than $250,000.

Yet, the political elites of both major parties, operating, as they did during the Wall Street bailout of 2008, under a contrived crisis mode, are advancing alternative deficit reduction proposals that will, in the words of Sen. Bernie Sanders (I-VT) (see video below) "do just the opposite of what the American people want."

While third parties are an option, today we sorely need an option that was available in 1968: a Eugene McCarthy...

Who coulda guessed it? And, once again, a nation built on the premise of self-governance owes its continuing great thanks to WikiLeaks and Bradley Manning.

Choosing an interesting way to 'celebrate' the 8th anniversary of the launching of Tomahawk cruise missiles into Iraq kicking off our invasion there on March 19th, 2003, the U.S. Commander-in-Chief Barack Obama approved the launching of Tomahawk cruise missiles into Libya on the anniversary today, as a five-nation coalition began to carry out a U.N.-approved No Fly Zone mandate over yet another oil rich Middle Eastern nation.

In response, the Tokyo Electric Power Co. (TEPCO), General Electric, The Shaw Group, the U.S. Chamber of Commerce, and the rest of the nuclear energy lobby sent a thank you note to Libyan dictator Col. Muammar Gaddafi, as the world media quickly turned their attention en masse to the new military action in the Middle East and away from the still-pending nuclear disaster at the Fukushima Daiichi nuclear plant in Japan.

In related sarcastic and fake news, Wisconsin Governor Scott Walker (R-Koch) tore off all of his clothes and danced naked with glee in celebration, by himself, in the middle of the capital rotunda in Madison. No media were there to capture the moment.

Meanwhile, in news that is neither sarcastic nor fake, but seemingly impossible upon everything else, a giant 100-mile oil slick has been spotted in the Gulf of Mexico, off the coast of Louisiana near the site of last year's BP deepwater oil drilling disaster. And yet with all of that, CNN has still not announced plans to scale back the 150 staff contingent they are set to deploy to cover next month's Royal Wedding in the UK.

In still more, let's call it irony, over a 100 demonstrators, including "Pentagon Papers" whistleblower Daniel Ellsberg, were arrested at the White House Saturday, protesting all the wars we were in prior to today, as well as against the reportedly deplorable conditions of detainment for 23-year old Army Private Bradley Manning, accused of leaking classified war documents and diplomatic cables to WikiLeaks. Many of the same protesters were arrested in a similar protest at the White House in December, also for failing to obey orders as they handcuffed themselves to the White House fence, though few media bothered to cover that demonstration either. Another rally is set for tomorrow in support of Manning, also sure to be ignored, at the Quantico Marine Corps Base in Virginia where he has been held in solitary confinement, reportedly, 23 out of 24 hours of each day for the last nine months.

At Fukushima today, only a bit more noticed, McClatchy reports that the spent fuel rod pool at reactor No. 3 is said to be "stabilized," with radiation levels dropping there after 13 hours of sea water was sprayed onto it with water cannon trucks [* See UPDATES below for more on Unit 3 issues.]; the Unit 4 fuel pool --- where, as we reported last night a "renewed nuclear chain reaction [was] feared" --- may in fact be cracked and leaking water, but with Unit 3 "stabilized" for now, fire fighters have turned the water cannon trucks onto that unit in hopes of cooling it down as well; and late last night, power was restored to Units 5 & 6, with pumps said to be working and the cooling ponds in both reactors cooling from their previously reported temperatures around 65C, back towards the desired temp of 25C. The readings there today were 37C and 41C respectively, in what can certainly be considered a bit of good news in a story desperate for some...
