The Sungai Selangor Dam (SSD) and the Sungai Tinggi Dam (STD) are regulating dams located respectively at the riverheads of Sungai Selangor and Sungai Buloh, major tributaries of Sungai Selangor.

SPLASH is tasked to efficiently manage and regulate the water releases from these two dams to enable sustainable storage and to ensure sufficient quantity of raw water in the river to meet the water treatment plants’ requirements and other functional needs.

With the existence of these regulating dams, during rainy season the rain water would be collected and stored in the dams’ reservoirs instead of wastefully flow to the sea. During dry season, the stored water will be released into Sungai Selangor to augment the flow of the river hence preserve the ecosystem of the river.

Jawatankuasa Penaja Persatuan Pengguna - Pengguna Air Prihatin Selangor dan Wilayah Persekutuan Kuala Lumpur dilaporkan mengadakan satu demonstrasi di hadapan pejabat MTUC sebelum menyerahkan memorandum membantah tindakan MTUC dan CAWP menghantar memorandum "membantah penswastaan air dan peningkatan tarif air Selangor, Kuala Lumpur dan Putra Jaya" kepada Perdana Menteri Malaysia.

Inilah kali pertama dalam siri tamaddun manusia ada sekumpulan orang yang mengaku mewakili pengguna - pengguna Air menyokong SYABAS - sehingga sanggup melaung - laungkan Hidup Syabas - Hidup Syabas seakan merayu kepada SYABAS supaya menaikkan tarif air.

Pengerusi Penaja Persatuan tersebut adalah Dato Muhammad Azaham bin Abdul Wahab menyerahkan memorandum kepada MTUC kononnya berasa hati dan kecewa dengan Memorandum MTUC dan CAWP membantah penswastaan air dan penaikan tarif air yang dihantar kepada Perdana Menteri Malaysia.

Water cut in KL and Selangor


SEVERAL areas in the federal capital and Selangor will experience water supply disruption between May 21 and June 4.

Syarikat Bekalan Air Selangor Sdn Bhd (Syabas) corporate communications manager Abdul Halem Mat Som said in a statement, that the disruption was due to upgrading work on the water supply service.

The disruption in Kuala Langat will be on May 21 and 25, and June 1 and 4, from 9pm to 9am the following day.

The areas affected include Taman Amanah, Taman Sentosa, Taman Ria, Taman Yayasan, Taman Seri Jarom, Taman Desa Jarom, Kampung Jenjarom, Sungai Rambai, Taman Rambai Indah, Taman Kota, Kampung Seri Cheeding, Taman Periang, Taman Bakti, Taman Sejati, Taman Seri Manggis, Taman Seri Telok Datok, Telok Datok government quarters and the Telok Datok dialysis centre.

Other affected areas are Taman Mesra, Taman Seri Damai, Taman Nilam, Taman Orkid, Taman Kenanga, Taman Kemuning, Taman Cempaka, Taman Budiman, Taman Baiduri, Taman Kanchong Darat, Kampung Sungai Lang, Jalan Morib, Taman Desa Jaya, Taman Bersatu, Taman Sri Putra, Taman Setia Jaya, Taman Banting Jaya, Taman Banting Baru and Kampung Sungai Buaya.

In the federal capital, Alam Jaya, Wangsa Cheras, Sunway Cheras, Taman Mudun, Taman Emas and Taman Permata will experience water supply disruption from 10pm on May 21 to 5am the following day.

Several areas in Petaling will also face water cut for 12 hours beginning from 5pm on the same date, including Bandar Kinrara 19, Kinrara Industrial Park, Bukit Jalil fire station, Jalan Puchong Sungai Besi, Taman Alam Sutera, Bukit Jalil Temporary Detention Centre, Taman Mutiara, Enggang Apartment, Taman Mesra, Taman Aman Sari, Kinrara Business Centre and Lavender Condominium.

On May 25, the areas affected will be Kampung Kerinchi, Bukit Angkasa, Panorama Condomi-nium, Section 5, Section 16, Section 17 and Section 19 of Petaling Jaya, International Islamic University of Malaysia (IIUM) matriculation centre and Pantai Hillpark.

Consumers are advised to store sufficient water for their needs.

Persatuan-persatuan Pengguna Prihatin Air Selangor, Wilayah Persekutuan dan Putrajaya didalangi orang yang sama dengan orang yang berada di dalam Persatuan Air Selangor yang mana presiden atau pengerusi persatuan itu merupakan Tan Sri Rozali yang merupakan juga pengerusi kepada syarikat Syabas dan Puncak Niaga.

2. Dato’ Muhammad Azaham ialah Timbalan Presiden Persatuan Air Selangor yang dipengerusi oleh Pengerusi Eksekutif Puncak Niaga.

3. Jabatan Audit Negara telah mendedahkan bahawa Puncak Niaga dan Syabas tidak mematuhi beberapa aspek perjanjian konsesi AIR.

Demikian dinyatakan Setiausaha Politik Menteri Besar Selangor, Nik Nazmi Nik Ahmad.

Menurutnya, persatuan itu diwujudkan untuk menjaga kepentingan syarikat-syarikat konsesi air Selangor yang mana pengerusi penajanya adalah Dato’ Muhammad Azaham Abdul Wahab.

Dato’ Muhammad Azaham juga merupakan Timbalan Presiden Persatuan Air Selangor yang dipengerusi oleh Pengerusi Eksekutif Puncak Niaga, Tan Sri Rozali Ismail.

“Ia tidak mengejutkan saya kerana persatuan ini didalangi orang yang sama dengan orang yang berada di dalam Persatuan Air Selangor yang mana presiden atau pengerusi persatuan itu merupakan Tan Sri Rozali yang merupakan pengerusi kepada syarikat Syabas dan Puncak Niaga.

“Jadi tidak terkejutlah bila kita melihat bagaimana menerusi Dato’ Muhammad Azaham, Persatuan Pengguna Prihatin Air Selangor, Wilayah Persekutuan dan Putrajaya menjadi perkakas kepada Syabas dan Puncak Niaga untuk mempertahankan kepentingan komersial mereka,” katanya menambah ianya jelas menunjukkan bukan kerajaan negeri yang menipu rakyat sebaliknya syarikat konsesi sendiri yang mempertahankan agar industri air terus dikendalikan oleh mereka.

Nik Nazmi berkata demikian kepada TV Selangor ketika mengulas kenyataan Persatuan-persatuan Pengguna prihatin Air Selangor, Wilayah Persekutuan dan Putrajaya yang mendakwa risalah yang disebarkan kerajaan Selangor tidak tepat dan berbau fitnah.

Beliau yang menyanggah tuduhan itu berkata maklumat dalam risalah yang disebarkan kerajaan negeri itu berdasarkan fakta yang betul.

Menurutnya, jika benar persatuan itu prihatin terhadap kebajikan penduduk di Selangor mereka sepatutnya menjawab tentang isu-isu yang telah dibangkitkan oleh Jabatan Audit Negara tentang bagaimana Puncak Niaga dan Syabas tidak mematuhi beberapa aspek perjanjian konsesi dan mereka juga seharusnya menjelaskan adakah persatuan mereka menyokong gaji sehingga RM5 juta setahun yang diterima pengerusi Syabas, Tan Sri Rozali.

“Ini sepatutnya menjadi perkara atau isu yang perlu dibangkitkan oleh persatuan pengguna prihatin kalau mereka benar-benar mewakili rakyat Selangor yang mahukan perkhidmatan air yang baik, berkualiti dan memastikan kebajikan rakyat terpelihara,” katanya.

Menurut Nik Nazmi lagi, kerajaan negeri juga akan terus berusaha mengambil alih pengurusan air yang dikendalikan Puncak Niaga, Syabas, Syarikat Pengeluaran Air Selangor Holdings Berhad (Splash) dan Konsortium ABASS Sdn Bhd (Abass) bagi memastikan kadar tarif air diturunkan manakala pemberian bekalan air percuma 20 meter padu dapat diteruskan bagi faedah rakyat.

Katanya, kerajaan negeri akan meneruskan usaha termasuk mengambil tindakan undang-undang bagi memastikan hak pengguna dilindungi dan tiada kenaikan air dilakukan.

“Kita sudah melantik pihak peguam dan kita juga sedang mengkaji tindakan di mahkamah dan pada masa yang sama kita mahu rakyat faham tentang isu yang mendepani kita kerana sebarang perubahan termasuk tarif dari segi kenaikan air dan sebagainya perlu mendapat persetujuan kerajaan negeri tapi kita lihat bagaimana kerajaan persekutuan membelakangi kerajaan negeri dalam banyak perkara,” katanya.

The ‘politics’ of water


Both the Federal and Selangor governments are currently interlocked in negotiations with water concession companies in the state. The aim, both say, is to ease the burden on the public due to escalating water tariffs as stipulated in concession agreements signed in 1994.

For the federal government, this is part of its efforts to restructure the water industry under the Water Services Industry Act 2006 where licences will be given either to the state government or concession companies to manage the utility.

However, their approaches are different. For the state, the main aim is to buy out the companies involved – Syarikat Bekalan Air Selangor (Syabas), Puncak Niaga Sdn Bhd (PN), Syarikat Pengeluar Air Sungai Selangor Sdn Bhd (Splash) and Konsortium Abass Sdn Bhd (Abass) – so that it can pull the plug on excesses which have bled the companies, and with that, reduce water tariffs by 10% instead of allowing the scheduled hike of 31% to kick in after March 31.

The federal government, on the other hand, is wary of the state’s ability and resources to manage the utility and reduce tariffs. The federal government said if its takeover of water management through the Ministry of Finance Incorporated’s Pengurusan Aset Air Bhd (PAAB) goes ahead, the hike will be lower than 31%.

However, there is growing agitation among the public over the frequent hikes of everything from water to toll rates which have been blamed on lopsided deals struck with concessionaires.

This issue was raised by parliamentarians on both sides of the divide last week following the scheduled toll hikes which have since been postponed.

The concern over postponements is that the public will still have to bear the cost of penalties to the concession companies. The only difference is that it is paid via their taxes and not at the toll booth or in water bills.

Just two weeks ago, Kinabatangan MP Bung Mokthar Radin, in invoking the details of the declassified toll concession agreements, questioned the competence and interest of government lawyers for signing agreements that are clearly skewed towards concessionaires – and suggested that parliamentarians be allowed to give their input on these matters in future.

However, unlike the declassified toll agreements, the lid is still shut where Selangor’s water concession agreement, signed between the state, federal government and Syabas, is concerned. An application for judicial review to declassify the concession agreement by the Coalition Against Water Privatisation in Malaysia is still pending in court.

In addition, the excesses of the four concession companies, in particular the high annual allowance of RM5.1 million paid to Syabas and Puncak Niaga executive chairman Tan Sri Rozali Ismail, the monthly RM700,000 management fees Syabas pays to its parent company Puncak Niaga and Rozali’s close ties with Umno leaders have also come under scrutiny.

Questions have been raised over the prudence of returning the concession or licence to the concessionaires, despite the fact that they have raked up a collective debt of almost RM6 billion. Also, audit reports have shown that Syabas, in particular, had breached several terms in the concession agreement.

As far as the state’s water review panel, which has gone through the books is concerned, PAAB taking over constitutes a bailout of the bleeding companies which are calling on the federal government to lick their wounds.

In general terms, if PAAB takes over, people living in Selangor will probably face hikes at a lower rate than the initial scheduled hikes up to 2035 but the bigger picture will show that the cost of the lower hikes are to be borne by all Malaysian taxpayers.

In a letter dated Feb 19, 2009 from Puncak Niaga Sdn Bhd to the National Water Commission Malaysia (Span), among the terms proposed is for PAAB to take over its RM2 billion of loans and liabilities, that PAAB is to absorb all costs in relation to workers affected by the migration for concession to licensing and that the interests of shareholders and bond holders will be taken care of.

The state has therefore asked Energy, Water and Communication Minister Datuk Shaziman Abu Mansor to invoke his powers under the Water Services Industries Act to back the state’s efforts to buy over water assets of the four companies in the interest of protecting consumers from further hikes. Under the provisions of the Act, the minister’s decision on the matter cannot be challenged, appealed against, reviewed, quashed or questioned in any court.

However, this is a double-edged sword because the federal government has raised doubts that the state’s resources are enough to afford the promised tariff reductions. Shaziman last week said the state would have to compensate the concession companies some RM38 million a month to reduce the tariffs.

He also questioned the price offered to the concessionaires by the state which was way below what the concessionaire pay the bond holders.

"If the price offered is way lower than what the concessionaire pays the bond holders, I don’t think it will go through," Shaziman said.

"If we are going to the capital market to raise bonds, we cannot allow the confidence of the bond-holders to be jeopardised; otherwise, our plan of raising cheaper bonds will not go through.

Selangor Water Review Panel member Tony Pua, however, said the companies have excessively leveraged their assets.

"They have taken more loans and bonds than necessary to operate these entities and then, after facing problems paying these loans, expect the state to rescue them.

"Our philosophy is that we will pay a reasonable return on invested capital," he said.

"They knew of the takeover following the implementation of the Water Services Industry Act and refunded all the cash to the shareholders and left the bonds as they are; so if you are looking at invested capital they have taken all their invested capital back and expect whoever comes in to pay their bonds. This is very unfair.

"We need to take away the returns taken, and if after that they find they do not have enough to pay their bonds, then the shareholders would have to be responsible, because the state is not responsible for a bailout. The state is here to pay a reasonable price," added Pua.
