Italian High Court Declares Amanda Knox and Raffaele Sollecito Innocent

Meanwhile, the victim’s mother, Arline Kercher, reacted with shock.
Her daughter had been found partially nude, sexually assaulted and stabbed to death in her bedroom in the Perugia cottage she shared with Knox back in November 2007.
“They have been convicted twice, so it’s a bit odd that it should change now,” the mother said.
Knox had repeatedly insisted that she was innocent in the roomie’s brutal death.

Within weeks, another man, Rudy Guede, was linked to the bloody crime scene by DNA. Guede is serving a 16-year sentence for the death.
Other DNA evidence — now discredited — linked Knox and her boyfriend to a kitchen knife found in the boyfriend’s apartment, where both insisted they spent the night of the murder having sex and smoking marijuana.

Italian Judge Explains Why He Voted For Re-Trial Of Amanda Knox

If the high court accepts Nencini’s verdicts, the two will be required to serve their prison sentences in Italy. Knox has vowed she will not return to Europe, but Sollecito, unless he escapes, won’t be as lucky.

The court also scoffed at certain rulings laid out by the first appellate court, saying that the court’s reasoning that it would have been easy for “a young athlete” like Rudy Guede to scale the wall and enter the apartment, was borderline racist.

If she is definitively convicted, she will likely face an extradition order to come back to Italy to serve out her sentence. There are very few legal loopholes that would allow an American citizen to escape a court decision by a country, like Italy, that shares extradition treaties with the U.S.

The lesson here is that denying a suspect a lawyer can result in terrible injustice. If Knox had been provided with one, she would not have been allowed to succumb to police pressure and give untrue statements that resulted in her arrest, as well as that of two other innocent people.
Meanwhile, forensic evidence would have unambiguously identified the perpetrator as Rudy Guede — and there would have been no need for a prosecutor to conjure up a non-existent orgy out of thin air.

Bad news: Amanda Knox has called the reversal by the Cassation 'painful' but said she is confident she would be exonerated
Italy's high court today faulted the acquittal of Amanda Knox by the appeals court for the murder of her roommate, ruling that it WAS a 'sex game gone wrong' and ordered her back for trial.
The Supreme Court said the ruling was full of 'deficiencies, contradictions and illogical' conclusions and ordered the new appeals court to look at all the evidence to determine whether Knox helped kill the teen.
