Seat up for special election: Tuesday 21 May 2024 Special Election - Caused by the resignation of Member of Congress Kevin McCarthy (Republican). On 8 January 2024, Governor Gavin Newsome (Democratic) called a special election to fill the vacant seat. All candidates, both party members and independents, participate in a 19 March 2024 non-partisan Special Primary. If one candidate receives a majority (50% + 1) of the primary vote, that candidate is elected. Otherwise, the top two vote getters, regardless of party, advance to a 21 May 2024 Special General Election. Candidate filing is 19 to 25 January 2024. In the event of a vacancy, Colorado law requires the Governor to set the date of the special election no less than 85 days and no more than 100 days after the date the vacancy occurs.
