From the "Leftists are Leeches" File.

I have to pay for PACERS and filing fees and taxes, and I didn't get extra points for a faux-oppressed minority background, so this kind of thing, particularly from someone who preaches that people who work hard and are succesful are somehow greedy for not letting the government bleed them a "little more" so that they can give it away to similar underserving leeches, really irritates me.

Professor Jacobsen writes about Elizabeth Warren:

Warren falsely and without any legitimate legal basis claimed to be Cherokee for employment purposes. Warren also chintzed by failing to register for the Massachusetts Bar despite an active practice of law in Cambridge since the mid-1990s, thereby evading Bar registration dues. Howie Carr has a great column today about Warren’s class warfare phoniness.

Add another example to the long list: Warren obtained fee waivers from at least 50 federal bankruptcy courts so she would not have to pay for access to the federal PACER system, even in years when she had a high 6-figure income and an 8-figure net worth.

Laws are for the little people.

Progressive diva and Massachusetts' Senate Candidate Elizabeth Warrent practiced law without a license, and collected more than $200,000, while keeping her day job at Harvard. But you should pay more in taxes because you didn't build the roads or somesuch.

Professor Jacobson writes:

Soon after my original post, Elizabeth Warren’s law license problem, Mark Thompson at The League of Ordinary Gentlemen wrote a post taking an opposite view, No, Elizabeth Warren Did Not Engage in the Unauthorized Practice of Law.
That post by Thompson was cited far and wide, including at Memeorandum as well as at friendly conservative blogs which wanted to present the case for Warren to provide balance.
In light of my post this morning that Warren represented a Massachusetts client in Massachusetts on an issue related to Massachusetts law, Thompson has concluded in a new post today:
Professor Jacobson has uncovered this morning a case in which Elizabeth Warren entered an appearance in a federal appellate court as a representative of a Massachusetts client in a case that appears to have clearly implicated Massachusetts law. Although this is still a federal appellate court, because we’re dealing with a Massachusetts client and issues of Massachusetts law, this looks really, really bad for Professor Warren. With this bombshell, I would no longer view the case against her as weak.
Thompson also has updated his original post:
UPDATE 4 9/27: Professor Jacobson has uncovered new facts that I view as a gamechanger. Although I stand by my above analysis as applied to the facts known at the time, Professor Jacobson’s discovery this morning answers my objections to his arguments.
Making progress.
More to come.
Update: Thompson emails, for attribution:
Professor Jacobson:
I couldn’t figure out how to leave this as a comment at your site, but I wanted to let you know ASAP that I concede that your discovery this morning answers all of my arguments and is a gamechanger. Your diligence in investigating this matter is commendable.
Regards,
Mark Thompson
Jack Marshall at Ethics Alarms adds:
Prof Jacobson, on his blog Legal Insurrection, is in line for an Ethics Hero award with his tenacity regarding Elizabeth Warren’s dubious qualifications to engage in the practice of law in Massachusetts. The overwhelming reaction by his colleagues in legal academia, and mine in the legal ethics community, has been to airily dismiss his arguments as trivial, far-fetched and thinly disguised political warfare, since Jacobson is an unapologetic conservative blogger (and a distinguished one.) Meanwhile, the mainstream media has, I think it is fair to say, completely ignored the story….
The rude brush off Prof. Jacobson is getting in this wagon-circling exercise is wrong in every way, and does injustice to every person and institution involved, including the Massachusetts legal establishment, the legal profession, ethical lawyers (which, believe it or not, the vast majority of them are), Senator Brown, the U.S. Senate, Massachusetts voters, and the American public….

Racial Opportunism/Racial Double-standards.

When a blonde, blue-eyed, middle-class white woman claims preferences based on her dubious, and, at best, theoretical Native-American ancestry, the cover is blown on the race industry.

This is a jarring "stop and smell the coffee" article on the shameless double standard that permeates le affair Elizabeth Warren:

Imagine if a Republican candidate claimed, confidently, that she was part Native American. Imagine if she had actually used that identity to have herself listed as a minority at Harvard, qualifying her for special treatment and celebration as proof of how diverse and progressive her department is. Imagine if, many years later, it turned out that her claims to Native heritage were dubious and, when pressed for proof, she offered her “high cheekbones.” Oh, and she once contributed a recipe to a Native American cookbook called “Pow Wow Chow” (that may even have been plagiarised).

Chances are, that Republican candidate would be hounded night and day by the press, branded a racist and probably be winding down her political career. Right now, she’d be sitting by the phone, praying for a call from the producers of Celebrity Apprentice (gotta pay the mortgage on that wigwam somehow).

The incredible thing is that all this has happened to a Democratic senatorial candidate called Elizabeth Warren. And not only has she been given a pass by her party, which normally treats race with the respect it deserves, but also by the mainstream media. Last night she was chatting with Chris Matthews on MSNBC and Matthews failed to mention the scandal once. If there’s any one reason why Democrats and liberals aren't showing the expected anger about this, it’s because their section of the media has declined to discuss it.

The sad thing is that Warren is, otherwise, an intelligent and credible candidate for the Senate. The product of a working-class family, this self-made academic was one of the bright sparks behind the Consumer Financial Protection Bureau and is one of the leading liberal minds of her generation. She’s competing in a naturally Democratic state (Massachusetts) that turned bellwether when it elected Tea Party Republican Scott Brown. The 2012 senate race ought to be about jobs and the economy.

Alas, Warren’s bizarre posturing as a Native American (which she has pursued with all the conviction of a full blown delusion) has sapped her credibility. Race shapes a lot of the way that Democrats think about economics and social justice – and within that narrative, Native Americans were the very first minority that the Europeans oppressed on American soil. It thus ought to be not just odd but immoral that Warren would try to borrow their heritage of suffering in order to advance her political career. Worse still, the Harvard Law Journal described her as a “woman of color,” as if it was translating her claimed identity into proof that it was reaching out to African-Americans. A lot of liberals invested a lot of emotional effort into sustaining this myth. This sort of thing is just as inappropriate as Mitt Romney suddenly claiming to be the descendent of slaves.
